7. Consideration and Appropriate Action Relating to a Request for Approval of the Consent

routine and will be enacted by one motion, Any Councilor may, however, remove an itern

ITEM 10: PRESENTATION AND OPEN DISCUSSION, INCLUDING PUBLIC
COMMENT OF THE 013 114 BUDGET,
Mr. Ray, assisted by Ms. Bishop, presented the proposed Fiscal 2003-2004 budget. Wall charts
and a power point presentation were utilized. Following the presentation, there was a time for
public comments.
Mr. Ray introduced the Character Trait for the Month of June — Security: Structuring my life
around that which cannot be destroyed or taken away. He also introduced Michele Dempster,
a said that she has accepted the added responsibility of Character Coordinator. Mr. Ray sai-h
that Marcia Boutwell has been promoted to the position of Special Projects Director and will be

handling -various special projects, including the museum. Her office will be at the museum.
Where will be a restructuring of her current duties.

ITEM 13a REPORT FROM CITY COUNCILORS,
Mice Mayor Kimball reported on the success of the Delay for Life event held on Friday evening.
Over $60,000 was raised, compared to $29,000 last year. She thanked the firefighters and all of
the city staff for the participation and suppoit.

RACKGROUNk.
The subject subdivision is located on North Mingo Road about one4orth mile north of 96'h Street
North (see attached location map). The water and sanitary sewer systems were accepted by the
council on April 16, 2002. Designs for the streets and stormwater drainage systems were approved
and construction inspected by the Public Works Department.
Final inspections were completed on the streets and stormwater drainage systems on August 7,
2002. Recommendation for acceptance has been delayed awaiting completion of the stormwater
punchlist. All identified deficiencies requiring correction to meet city standards are complete.
The construction contractors have provided a one-year maintenance bond for the storm drainage and
a two-year bond for the streets (see attached).
Staff recommends acceptance of the Honey Creek streets and stormwater drainage systems.

WHEREAS- It is the intent of the Owasso City Council to adopt an operating budget for
fiscal year 2003 -2004; and
WHEREAS- The adoption of such budget is vital to the continuation of services to the
citizens of Owasso; and
WHEREAS. Public access to the adopted budget is desired; and
WHEREAS. Certain publication and filing requirements are mandated by State
Statutes.
NOW THEREFORE, RESOLVED BY THE CITY COUNCIL OF THE CITY 01
'T HAT. The revenues, expenditures and transfers as shown. on Attachment "A"
shall be appropriated for each Band; and
THAT: The encumbrances and unexpended appropriation balances for the Capital
Improvements Fund, the Capital Projects Grant Fund and the Bond
Projects Fund for Fiscal Year 2002-2003 be and the same are hereby
reappropriated to the same fiends, accounts and for the same purposes for

Section 2 -6 of the Charter of the City of Owasso states that the City Clerk shall be elected by the
Council for an indefinite term, provided, that the Council by ordinance may provide that the City
Treasurer shall be ex- officio City Clerk. Section 26 of the Charier is attached for your information
and review.
Section 2 -102 of the Code of Ordinances of the City of Owasso allows the City Manager to appoint a
City Treasurer to an indefinite terra. A copy of Section 2102 of the Code of Ordinances of the City
of Owasso is also attached for your information and review.
Ms. Boutwell has been recently named to coordinate special projects and now offices out of the
Owasso Museum. Rather than filling the position of City Clerk with another individual, I believe the
most efficient solution would be to appoint Ms. Bishop as City Clerk/Treasurer for signatory
purposes, while having the remaining functions of the City Clerk distributed among existing staff.
Ordinance No. 759 would combine the offices of City Clerk and City Treasurer as provided for by
Section 2 ®6 of the City Charter.

WHEREAS, Section 2-6 of the Charter of the City of Owasso states that the City Clerk

WHEREAS, the Owasso City Council has considered the recommendation of the City
Manager and all statements for and against the recommended action.

Owasso Reporter on May 15, 2003
The Planning Commission considered the request at a public hearing on June 9Y11° At the meeting,
the Planning Commission unanimously voted to recommend council approval of the rezoning.

BACKGROUND-.
Owasso Land Trust has submitted an application to the Planning Commission for approval of a
final plat for Coffee Creek Office Condominiums located on the northeast corner of the N. 138'h
E. Ave. and U.S. Highway 169 service road intersection. The applicant wishes to create 5 lots on
I block on 4.24 acres for the purpose of constructing 4 office condominiums. A general area map
is attached.
The property is approximately 4.24 acres in size. The existing land use is vacant for the subject
property. The property to the north is zoned CS (Shopping Center District) and is currently vacant.
The property to the south is zoned RS-3 and presently contains an elementary school and daycare. The
property to the east is zoned RS-3 and contains the newly built Water Colours residential
condominiums. U.S. Highway 169 runs along the western border of the property.

The applicant is requesting this review in order to construct 4 office condominiums on lots 2-5.
The subject property is zoned OM Office Medium District. According to the City of Owasso
Zoning, Code, office condominiums are included within Use Unit I I (Offices and Studios) and ars

SUBJECT. SICK LEAVE PAYOUT UPON DEATH OF EMPLOYEE
DATE: June 12, 2003
A review of the two contracts and the Personnel Manual Sick Leave policy has been conducted
and staff proposes to request a revision of the Personnel Manual Sick Leave policy allowing the
beneficiary of a nonunion employee to receive a payment equal to 50% of the employee's
accrued sick leave upon death of the employee. Staff s proposal is based on the belief that there
is currently an inequity between the police and fire contracts and the personnel manual.
Staff recommends approval of the revised Sick Leave policy allowing a beneficiary to receive a
payment equal to 50% of an employee's accrued sick leave upon death of the employee,

B. Eligible employees of the Police and Fire Departments shall receive holiday time according to their contract

Vacation time is intended to benefit the employee and serve as a time of mental and physical refreshment.
Therefore, employees are encouraged to use their vacation time.
B. EXPENDITURE
Vacation leave shall not be expended in less than a one hour unit. Vacation leave shall not be expended for
more than the actual number of hours available.
It shall be the responsibility of each Department Director to report vacation leave used by each employee on
the timesheets. Such records shall be submitted to the Payroll Clerk bi-weekly.
C. The following chart indicates the amount of vacation time that accrues for City employees. As reflected in the
chart, vacation time shall not accumulate for more than the "Maximum Limit" at any given time during the
year.

D. Vacations will be scheduled by the Department Director to meet the operating requirements of the City and,
whenever possible, the preference of the employee. Requests for vacation leave should be submitted to the
Department Director a minimum of ten (10) working days in advance of proposed vacation.
An employee may accumulate sick leave upon completion of his first full month of employment.
A. ACCRUAL
(1) Sick leave is accrued in units of one day per month worked.
(2) Sick leave accrual for employees whose regular shift is not 40 hours per week will be prorated. The
proration factor is calculated through a formula that divides the regular weekly hours by forty hours.
Example: an employee who works a regular work week of 42 hours will have a proration factor of 1.05
that was determined by dividing 42 by 40. The normal accrual of 8 hours is then multiplied by that factor,
in this case 1.05. Thus, an employee who works a 42 hour regular work schedule would calculate sick
leave accrual by multiplying 8 hours X 1.05 for a total accrual of 8.4 hours sick leave for the month.
B. EXPENDITURE
Sick leave may be expended in units of no less than one hour. Any sick leave extending for part of three (3)
consecutive days or three (3) days in any three (3) consecutive months must be accompanied by a physician's
written statement certifying the employee's condition or his immediate family's condition that prevented the
employee reporting to work. Any abuse of sick leave is justification for disciplinary action and possible
dismissal
C. ELIGIBILITY
An employee is eligible to take sick leave for one of the following reasons:
(1) Personal illness or physical incapacity other than incurred on the job, including medical, dental, or optical
diagnosis or treatment, and pregnancy.
(2) Serious illness of a member of the employee's immediate family requiring the employee's personal care or
attention. Immediate family shall include husband or wife, father or mother of the erwployee, sister or
brother of employee, children or legally adopted children of husband or wife both, or any other person
whose relationship could justify the employee's absence, providing special approval by the Department
Director is first obtained.
(3) Exposure to a contagious disease that, in the opinion of the attending physician, could, jeopardize the
health of others.
(4) All disabilities caused or contributed to by pregnancy, childbirth or related medical conditions. For all
job-related purposes, said disabilities shall be treated as disabilities caused or contributed to by other
medical conditions.
D. PROCEDURE
An employee who is unable to report for work due to one of the above reasons shall report his absence to his
supervisor within one hour of the tirne he is expected to report for work.
A. The City provides health insurance to all full-time employees. Employee premiums are paid in full by the
City. The employee has the option of purchasing coverage for dependents with the City paying a portion of
the premium as budgeted.

B. Under the COBRA Act of 1986, employees who terminate employment or dependents of employees who are
no longer eligible for coverage by the City health plan, are eligible to continue this coverage for a limited
tune. Coverage may be extended for up to 36 months depending on the reason for termination. Contact the
Personnel Clerk for more information.
5 -'7 WORKER'S COMPENSATION
The City of Owasso is self- insured for worker's compensation coverage. As a result, all payments for on the
job injury related medical attention, prescriptions and /or equipment, and temporary total disability (TTD) benefits
shall be paid directly by the City of Owasso through the appropriate designated fund. The City of Owasso, does,
however, maintain an insurance relationship specifically for "excess coverage" in the event that an incident of
catastrophic nature should occur.
B. An employee who is injured as the result of an accident that occurs during the course of his /her performance
of duty with the City (such accident not occurring as a result of negligence or misconduct on the part of the
employee) shall be placed on accident compensation - AC payroll status, according to the following schedules

At any time during AC Status leave, the City may require the employee to submit to a medical examination by
a medical doctor designated by the City for the purpose of determining the status of the injury. In the event an
employee refuses to submit to such examination by a physician designated by the City, the refusal shall be
cause for terminating any City benefits provided in this section.

The City provides a life insurance plan for employees that is paid for by the City. The plan provides a death
benefit of a minimum of $30,000, for all employees under the age of 65. Death benefits are reduced for employees

The City of Owasso offers an optional credit union program for all employees.
5 ®10 EDUCATIONAL CCOMPENSATION
A. An employee may be reimbursed one hundred percent (100 %) of the general enrollment fee for tuition
expenses upon satisfactory completion (minimum of a grade "C ") of a course or school that is directly related
to his job duties or in pursuit of an undergraduate degree. The course(s) on which reimbursement will be
requested must be app roved by the Department Director prior to enrollment (Personnel Form number 10).
Employees may also be reimbursed for satisfactory completion (minimum grade "E °) of courses taken in
pursuit of a graduate degree. The course(s) on which reimbursement is requested must be approved by the
City Manage prior to enrollment (Personnel Form 10). Approval by the City Manager shall be made
following the City Manager's determination that the course and graduate .degree: will benefit both the employee
and the City of Owasso.
If a personnel form number 10 is not on file in the personnel office, reimbursement will not be made. Fees
for advance standing credit hours will not be reimbursed.
B. Maximum reimbursement is based on the general enrollment fee per semester credit hour as set by the State
Regents for Higher Education. To receive reimbursement, the employee must present die final grade earned
in the course with tuition expense receipts to the Department Director for inclusion in the normal purchase
order procedure.
C. Educational advancement is an employee development program with high priority. Decisions relating to
authorizing reimbursement will not be based on departmental budget consideration.
5 -11 EMPLOYEE ASSISTANCE PROGRAM
The City provides payroll deductions for a variety of optional benefit programs. More detailed information
may be obtained from the Personnel Clerk.
