Attachment #7 ®E The staff recommends that the Council authorize the completion and execution of all closeout documents related to #9716 CDBG-00, Small Cities Grant for transmittal to the Oklahoma Department of Commerce. Action Relating to a Request to Designate the Mayor at the City's Certifying Officer as Provided for by the National Environmental Policy Act of 1969 for the Purpose of Assuming Overall Responsibility for the Environmental Review Process for #10629 CDBG 02, Small Cities Grant. See Attachrnent #7-F The staff recommends Council designation of the Mayor as the City's certifying official for environmental documents required by the grant and authorized by the Council. G. Action Relating to a Request that a Finding of "No Significant Impact on the Environment" Will Occur as a Result of the #10629 CDBG 02 Program Activity. See Attachment #7-F The staff recommends Council approval of the INCOG report and finding of no significant impact on the environment as a result of the CDBG program activity, and that the Mayor be authorized to execute the Certification of Continued Environmental Compliance. H. Action Relating to a Request for Council Authorization for the Mayor to Execute an Environmental Certificate and Request for Release of Funds for Project #10629 CDBG 02. See Attachment #7-F The staff recommends City Council authorization for the Mayor to execute the Environmental Certificate and Request for Release of Funds as required by the grant conditions. I. Consideration and Appropriate Action Relating to a Request for Council Approval of an "Antidisplacement Plan" for Project #10629 CDB G 02. See Attachment #7F The staff recommends Council adoption of an Antidisplacernent Plan for the project, and that the Mayor be authorized to execute such plan document. J. Action Relating to Resolution #2003-03, a Resolution Committing up to $67,132 as Leverage from the City of Owasso, Oklahoma to Project #10629 CDBG-02. See Attachment #7-F The staff will recommend Council approval of Resolution #2003-03. Owasso City Council April 15, 2002 Page 4 Public Hearing Relating to Community Development Project Activities and Needs Within the City of Owasso, Oklahoma. Mr. Wiles Attachment 98 A public hearing will be held for the purpose of receiving recommendations on community development needs within the City of Owasso, as well as for the purpose of receiving comments on the performance of the City in regard to sidewalk improvements completed under previous CDBG program. 9. Consideration and Appropriate Action Relating to an Application for Funds from the Oklahoma Department of Commerce (ODOC) for the Small Cities Program. Mr. Wiles See Attachment #8 The staff will recommend approval of Resolution #200304, requesting financial assistance from the Oklahoma Department of Commerce, and authorizing the Mayor to execute an application in the amount of $67,132 for the FY 2003 Small Cities Program. 10. Consideration and Appropriate Action Relating to a Request for Council Approval of a "Citizen Participation Plan" for the FY 2003 Small Cities Program. Mr. Wiles See Attachment #8 The staff will recommend Council approval of the required Citizen Participation Plan and that the Mayor be authorized to execute documents relating to that plan. Consideration and Appropriate Action Relating to Resolution #2003-05, a Resolution Approving the Continued Participation of the City of Owasso in the Metropolitan Tulsa HOME Consortium. Mr. McElrath Attachment #11 The staff will recommend City Council approval of Resolution Pr-200305 approving continued participation in the Metropolitan Tulsa HOME Consortium, and authorizing the Mayor to execute the cooperation agreement. 13. Consideration and Appropriate Action Relating to OZ-03-03 a Request to Rezone Property Located at the Southwest Comer of South Birch Street and East Third Avenue (304 S. Birch St.), from RS-3 (Residential Single Family High Density) to CG (Commercial General), Containing .32 Acres More or Less. Mr. Moore Attachment # 13 The Owasso Planning Commission has held a hearing on this request and recommends Council approval of the requested zoning. The staff concurs with the recommendation. Consideration and Appropriate Action Relating to Ordinance #750, an Ordinance Providing for the Partial Closing of a Utility Easement Located Along the South Edge of the NSP Property (301 E. Fifth Ave). Mr Moore Attachment # 14 1- 4 The staff will recommend approval of the casement closing and adoption of Ordinance #750. 15. Consideration and Appropriate Action Relating to Ordinance #751, an Ordinance Providing for the Closing of Dedicated Right-of-Way Located on the North Side of East Fifth Avenue, Along the South Edge of the NSP Property (301 E. Fifth Ave.). Mr. Moore Attachment # 15 The staff will recommend approval of the right-of-way closing and adoption of Ordinance 9751. 16. Consideration and Appropriate Action Relating to a Request for Council Approval of a Final Plat for Garrett Creek Estates, an Addition to the City of Owasso, Tulsa County, State of Oklahoma. Mr. Moore Attachment # 16 The Owasso Planning Commission has conducted a hearing on this request and recommends Council approval of the final plat for Garrett Creek Estates, a 21.86 acre subdivision containing 84 residential lots on 5 blocks, located southeast of the comer of N. 129th East Ave and E. 116"' St. N. Consideration and Appropriate Action Relating to the Acquisition of Real Property Located at 109 Forth Birch (Central Baptist Church), Owasso, OIL. Mr. Ray Attachment #17 The staff will recommend City Council approval of a contract for the purchase of property located at 109 N. birch, such purchase in the amount of $650,000, and authorization for the Mayor to execute all documents necessary to the closing of the purchase. 18. Consideration and Appropriate Action Relating to the Award of a Contract for FY 2001 CD13O ADA Sidewalk Rehabilitation Project. lbs. Stagg Attachment #1 8 Staff has completed the bidding process, reviewed the bids received, and will recomm end contract a awarded to Horizon Construction Owasso, OK in the amount of specifications, $135,463.56 for the FY 2001 CDBG Sidewalk Rehabilitation Project consistent with bid award d' base bid plus alternate fla (relocation of two fire hydrants). 19. Consideration and Appropriate Action Relating to Resolution #2003 ®06, a Resolution Declaring City of Owasso Adoption and Support of A Company, 1St Battalion, 502" Infantry Regiment, 101St Airborne Division. Mr. Rooney Attachment #19 The staff will recommend Council approval of Resolution #2003 -06, providing for City of Owasso adoption and support of A Company, 1St Battalion, 502nd Infantry Regiment, 101st Airborne Division. Michael Helm, Mayor OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, April 1, 2003 The Owasso City Council met in regular session on Tuesday, April 1, 2003 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, March 28, 2003, and Addendum to Agenda posted on the City Hall Bulletin Board at 5:00 p.m. on Monday, March 31, 2001 ITEM 1: CALL TO ORDER Mayor Holm called the meeting to order at 6:32 p.m. ITEM 2: INVOCATION The invocation was offered by Pastor David Vert, Associate Pastor at Owasso First Assembly of God Church. Councilor Thoendel led in the flag salute. STAFF Rodney J. Ray, City Manager Marcia Boutwell, City Clerk Stephen P. Gray, City Attorney A quorum was declared present. WE" 0=11! "AL, Mayor Helm read a letter of resignation from the City Council submitted by the Ward 2 councilor, Rebecca Armstrong, which states: "I wanted to let you know that although I have enjoyed serving on council; right now I have a child starting on the high school baseball team. I want this chance to spend this time watching my children in their sports. Therefore 1, Rebecca Armstrong, hereby resign effective 3/31/03." Ms. Boutwell administered the oath of office to Mr. Cataudella, and he was seated at the council bench. ITEM 8: READING OF MAYOR'S PROCLAMATION. Mayor Helm invited the council to join him at the podium as he read and presented a proclamation to Scott Yandell, honoring Bank of the Lakes as Business of the Quarter for the Second Quarter of 2003. OWASSO SERTOMA CLUB'S NATIONAL HERITAGE MONTH ESSAY C,*'LTTF.Q,T Mr. Ray introduced the fifth grade students who were winners of Sertoma's National Heritage Essay Contest. Because of Spring Break, the first and second place winners were unable to be present at the March 18"' meeting when the third place winner read her essay. Second place winner Aileen Gunter and first place winner LeAnne Layton, both students at Northeast Elementary School, read their essays. Mayor Helm and the city council presented a certificate of recognition to each of them, and also recognized their parents. Action Relating to Ordinance #746, an Ordinance Providing for the annexation of Approximately 30.54 Acres, Generally Located on the South Side of East 106th Street North, Approximately 1320 Feet East of North Garnett Road (Ward 2). Mr. Moore said that the Watercolours at Coffee Creek contains 40 townhouse lots within five blocks on approximately 5.96 acres, and is located at the northeast corner of E. 103rd St. N. and N. 138th East Ave. The Technical Advisory Committee reviewed the final plat and made 12 requirements. The Planning Commission reviewed the final plat and recommended approval, subject to the Technical Advisory Committee comments being met. All of those comments have -3- Owasso City Council April 1, 2003 been addressed. Mr. Thoendel moved, seconded by Mr. Cochran, to approve the Watercolours at Coffee Creek final plat. The proposed agreement contains no wage increases. It includes two new articles — a physical fitness program, and a re-opener article. The re-opener allows the IAFF to re-open negotiations at their request if the sales tax projections should change. IAFF Local #2789 has ratified the agreement. -4- Owasso City Council April 1, 2003 Ms. Kimball moved, seconded by Mr. Cochran, to approve the agreement between the City of Owasso and IAF'F Local #2789, providing for wages, benefits and other working conditions. Councilor Kimball commented on the firefighters and their willingness to ratify their contract with no raises. Ms. Kimball moved, seconded by Mr. Cochran, to adjourn. ITEM 6: DISCUSSION OF ISSUES OF MUTUAL INTEREST TO THE CITIES OF COLLINSVILLE AND OWASSO. Mayor Sirmon adjourned the Collinsville City Commission. ITEM I EM 1: CALL T 0 ORDER. Mayor Holm called the meeting to order at 6:00 p.m. STAFF Rodney J Ray, City Manager Timothy Rooney, Assistant City Manager Marcia Boutwell, City Clerk STLM ITEM 2: DISCUSSION OF PUBLIC WORKS ITEMS. A. Stormwater Management B. Other Items Mr. Carr discussed the EPA requirements relating to stormwater management. He said there are regulations that will need to be implemented, but that the City is already doing some of the required items. The City will be proposing a stormwater management fee to fund the program requirements. This item will appear on the Work Session agenda in May with a proposed fee structure and ordinance establishing the fees. ITEM 3: DISCUSSION RELATING TO PLANNING ITEMS. A. Zoning Requests B. Right-of-Way Closure C. Easement Closure D. Other Items Mr. Wiles discussed the items that appeared on the Planning Commission agenda at their meeting on April 7`". There were two zoning requests that were approved and will be placed on the City Council agenda for action. A right-of-way closure and an easement closure were also approved and will be on the City Council agenda on April 15'x'. Also on the Planning Commission agenda were four preliminary plats, which were also approved. Owasso City Council April 8, 2003 ITEM 4: DISCUSSION RELATING TO CENTRAL BAPTIST CHURCH BUILDING. ITEM 5: DISCUSSION RELATING TO AN WTERLOCAL AGREEMENT BETWEEN THE CITIES OF OWASSO & COLLINSVILLE PROVIDING FOR THE USE OF AVAILABLE JAIL SPACE. ITEM 6: REPORT FROM CITY MANAGER. A. Status of Negotiations B. Status of Budget Preparation for FY04 C. Status of FY03 Finances and Impact on Current Budget D. Other Items Mr. Rooney said that a contract has been developed with the YMCA allowing them to use the ballfields in front of the facility. He also said that a lease agreement for use of the fields at McCarty Park has been developed. The third item he discussed was "Adopt A Troop:, whereby the City would, through a resolution, adopt a military unit deployed to Iraq as a way to show support. Since there is no local unit, Mr. Rooney requested that a unit be assigned. Although that has been done, there was some discussion concerning another unit. Mr. Rooney will follow UP. Mr. Ray discussed that status of negotiations with the City's bargaining units. The contract with IAFF has been approved, however the City is still in negotiations with the FOP. Ms. Bishop and Mr. Ray discussed the status of budget preparation for FY04. Some requests from department directors have been cut, and the budget process is continuing. Each step requires formal action by the Council, however, these steps are generally considered to be "house cleaning" type actions. First, an Environmental Review Record must be prepared. This record consists of a request for review being sent to various state and federal agencies and a documentation of their responses in the form of a statutory checklist and an environmental assessment. The staff has determined that this project will have no significant effect on the environment. As a result of this determination, the Council is in a position to designate the Mayor as the certifying officer to execute the Environmental Certification and Release of Funds Request and to make a finding of No Significant Environmental Impact. In addition, the Council must approve an Antidisplacement Plan even though no displacement will occur as a part of the program. The INCOG staff has prepared those documents. The City is also required to adopt a resolution pledging an equal match of $67,132 towards the completion of the project. This match has been budgeted by the City of Owasso. It is anticipated that future actions may have to be taken by the Council to complete other grant requirements not directly related to environmental concerns. However, at this point the following is a specific explanation of each current request by agenda item. AGENDA ITEM V. F DESIGNATION OF MAYOR AS CERTIFYING OFFICE, R BACKGROUND: Federal and state regulations require that each grant recipient designate a certifying official. This official is typically the mayor when the recipient of a grant is a municipality. The certifying official (through use of the staff and contractually with INCOG) assumes responsibility for the environmental review process, making findings, and signing certifications. The staff recommends Council designation of the Mayor as the City's certifying official for documents required by the grant and authorized by the Council. This will be accomplished by: I. Providing frequent and timely public notice of CDBG program activities by posting at City Hall and by placing articles of interest in the local newspaper. 2. Adopting a comprehensive CDBG Statement of Needs. 3. Conducting a Special Public Hearing to inform citizens of the proposed CDBG project and authorizing the Mayor to sign a CDBG application in a formal City Council Meeting. Ensure that citizens will be given reasonable and timely access to local meetings, information, and records relating to proposed and actual use of funds, including, but not be limited to: 1. The amount of CDBG funds to be made available for the current fiscal year, if the proposed project is approved. 2. The range of activities that may be undertaken with those funds. 3. The estimated amount of those funds proposed to be used for activities that will benefit low and moderate-income persons. 4. The proposed CDBG activities likely to result in displacement and any anti-displacement and relocation plans developed by the City of Owasso in accordance with Section 104(d)(1) and (2) of the Act. 5. The basis on which the City of Owasso may provide technical assistance to groups representative of persons of low and moderate income that may request assistance in developing proposals. The level and type of assistance to be provided is at the discretion of the City of Owasso and does not necessarily include providing funding to such groups. 6. This requirement will be accomplished by discussing the CDBG proposal during regular City Council meetings and in one formal public hearing prior to the submittal of the CDBG application. During the hearing the five (5) items listed above will be explained to the public. However, every effort will be made to accommodate the needs of any non-English speaking citizens who wish to participate. EXTENSION OF HOME CONSORTIUM AGREEMENT DATE: April 9, 2003 Attached to this memo is a memorandum from Rich Brierre, Deputy Director of INCOG, in which he details the history of Owasso's participation in the Metropolitan HOME Consortium. As Mr. Brierre indicates, the current agreement was for three years and will expire September 30, 2003. INCOG staff is recommending that the City Council approve continued participation in the HOME Consortium. The City of Owasso has benefited from participation in the Consortium in a number of ways. Most importantly, our membership has made us eligible to receive federal monies for the various housing programs available. In 1996, by virtue of our participation in the Consortium, eligible citizens of Owasso received approximately $75,000 in low- or no-interest loans for housing rehabilitation. The City has applied and been approved for $97,580 more of these same type funds this year. In addition, through our representation on the HOME policy board, we have had the opportunity to exercise both voice and vote in decisions concerning allocations of the various HOME monies that are available to the participating entities. Finally, through membership on the policy committee, we have experienced the benefit that comes from contact with others who experience problems and challenges similar to our own. Based upon the positive experiences of the last nine years, staff concurs with WCOG staff in recommending that the City Council of the City of Owasso adopt a resolution approving participation in the Metropolitan Tulsa HOME consortium for FY 2004-2007 and authorizing the Mayor to execute a home investment partnership act consortium agreement. The authority is given only to develop, approve and implement a downtown plan. Issues arising from concerned surrounding property owners should have been addressed at the time of the adoption of the Downtown Plan, not as staff is attempting to implement the plan through appropriate rezoning requests. Therefore, staff suggests that the land use designation delineated in the Owasso Downtown Development District Plan would and more importantly, should supercede the Owasso 2010 Master Plan designation. Assuming the above assertion to be true, the discussion should now focus on the land use designation listed in the Owasso Downtown Development District flan. The plan calls for a mixture of uses in the area of this request. The site is labeled as having a land use of light industrial, warehousing and /or City services. The west 600 subject property is located approximately feet we i of the E. 5t" Ave. and U.S. Hwy 169 Service Road intersection, further described as 301 E. 5 41i Ave. The applicant is requesting this closure to permit the expansion of the existing National Steak. & Poultry facility. A general area map and complete legal description have been included with your packet. National Steak & Poultry, Inc., is requesting the closure of the southern 17.5' utility easement in an effort to expand the existing facility. This expansion, according to National Steak & Poultry estimates, would create an additional 30 to 50 new jobs in the City of Owasso. National Steak & Poultry has stated that the manner in which the request is shown on the attached plot plan is necessary based on the internal workings of this meat processing plant. The internal flow of the meat processing procedure requires that the addition be constructed in the proposed location, rather than the other vacant areas shown on the attached plot plan. City staff agrees. The City of Owasso Community Development Department and Public Works Department have had several opportunities to review the proposed addition. After those reviews, all interested departments have concluded that the benefits of such a proposal outweigh any of the potential negative impacts. City engineers have concluded that the only issue that needs to be addressed is the construction of a marked barricade located at the southeastern corner of the addition. The applicant has agreed and the construction of the barricade will coincide with the construction of the building addition. The City of Owasso Public Works Department has authorized the building expansion to come within 5 feet of the existing roadway. However, the applicant has submitted a proposal that would construct the addition within 12 feet of the existing roadway. And, with an existing right- of-way width of 80 feet, staff finds that any future roadway expansion on E. 5"' Ave. could be accommodated without issue. Furthermore, the applicant has received Board of Adjustment approval for the encroachment into the minimum 50 foot building setback line on property zoned IL (Industrial Light District). A general area map and complete legal description have been included with your packet. t National Steak & Poultry, Inc., is requesting the closure of a portion of the northern 40' right-of- way in an effort to expand the existing facility. This expansion, according to National Steak & Poultry estimates, would create an additional 30 to 50 new jobs in the City of Owasso. National Steak & Poultry has stated that the manner in which the request is shown on the attached plot plan is necessary based on the internal workings of this meat processing plant. The internal flow of the meat processing procedure requires that the addition be constructed in the proposed location, rather than the other vacant areas shown on the attached plot plan. City staff agrees. The City of Owasso Community Development Department and Public Works Department have had several opportunities to review the proposed addition. After those reviews, all interested departments have concluded that the benefits of such a proposal outweigh any of the potential negative impacts. City engineers have concluded that the only issue that needs to be addressed is the construction of a marked barricade located at the southeastern comer of the addition. The applicant has agreed and the construction of the barricade will coincide with the construction of the building addition. The City of Owasso Public Works Department has authorized the building expansion to come within 5 feet of the existing roadway. However, the applicant has submitted a proposal that Would construct the addition within 12 feet of the existing roadway. And, with an existing right- of-way width of 80 feet, staff finds that any future roadway expansion on E. 5t" Ave. could be accommodated without issue. Furthermore, the applicant has received Board of Adjustment approval for the encroachment into the minimum 50 foot building setback line on property zoned IL (Industrial Light District). The approval was received at the March 25, 2003 regular meeting. The Owasso Technical Advisory Committee reviewed the proposal at their March 26, 2003 regular, meeting. At that meeting, the following comments were noted, 1. Community Development - - The City of Owasso City Council must approve the right-of-way closure. 2. Community Development — The applicant must provide an official copy of the right-of-way vacation to the Community Development Department after District Court approval. 3. Public Works -- The applicant must construct a collision barricade. The construction of the barricade must coincide with the construction of the building addition. The Owasso Planning Commission at the April 7, 2003 regularly scheduled meeting heard the request. While there had been a potential purchaser and a signed contract, that offer was withdrawn and the building is once again available. It is my understanding that there is one, and perhaps two, anticipated offers (contract) for the property that will be presented in the immediate future. The single biggest opportunity to the City as a result of this purchase is the acquisition of the land. This opportunity to acquire two acres of land contiguous to our current facility is a good business decision and should not be passed. While it is true that the building can be used to good advantage, there are other buildings that could serve the city's needs. It is, however, the chance to secure the land at a favorable price that should be the basis of a purchase decision. CENTRAL BAPTIST CHURCH PROPERTY APRIL 119 2003 PAGE 2 There are several identified potential uses of the Central Baptist Church structure. Immediate use of the structure for City meetings (City Council, Planning Commission, Board of Adjustment, and City Court) would free up much needed evenings at the Owasso Community Center. Currently, the City of Owasso uses the Community Center up to nine nights per month for meeting use, thus limiting its potential use by the community. Lastly it would allow for the expansion and/or relocation of portions of existing city offices in the future. Portions of the Police Department operations that are not site specific could be located in the structure as well. Such a use will extend the life of the recently constructed Municipal Building/Police Department for as much as ten to fifteen years without added construction. TIMOTHY ROONEY ASSISTANT CITY MANAGER SUBJECT- AMERICA SUPPORTING AMERICANS RESOLUTION NO. 2003-06 DATE: April 10, 2003 BACKGROUND: America Supporting Americans (ASA) was founded in 1968 to provide a mechanism to allow for the 66 adoption" of all troops and branches of the United States Armed Services by cities in the United States. The program has received national attention due to the Iraqi Freedom effort resulting in the deployment of more than 200,000 troops. Recently, ASA was featured on a segment of CNN's "Larry King Live." Staff contacted ASA on Monday, April 7, 2003 regarding a unit adoption. On Tuesday, April 8, 2003 staff was notified that the City of Owasso has been assigned the following unit: "A" Company 1" Battalion, 502 Infantry Regiment, 1015t Airborne Division. This unit is in Iraq and has a proud history with participation in the Battle of the Bulge and is a sister unit of the Band of Brothers. They are elite soldiers of the Army and home based at Ft. Campbell, Kentucky. They refer to their unit as STRIKE FORCE. This unit contacted ASA regarding being adopted by a city as they were being deployed. The director of ASA commented on how "eager this group was to be adopted by a city." A resolution, to adopt this unit, is attached for your information and review. Upon approval of the resolution, contact will be made with the unit for communication preference (US MAIL or E-MAIL), the number of soldiers in the unit, soldier information, etc. The information received will then be provided to the community through the city, churches, schools, chamber of commerce, media etc., in order to encourage correspondence with this unit. Upon the unit's return from Iraq, the commanding officer of the unit and others will be invited to attend an Owasso City Council meeting in order to receive an honorary key to the City of Owasso. Ms. Voss has served our community in the past on our Council, as well as serving on the Building Fund Committee for the proposed Veteran's Memorial.
