Mayor Helm said that three residents of Ward 1 expressed an interest in being appointed to the
vacant Ward I council seat. All three were interviewed by the remaining councilors on Monday,
December 16, 2002. The Mayor called for nominations for the appointment. Ms. Armstrong
nominated Mr. Craig Thoendel, seconded by Mr. Cochran.

The consent agenda included minutes of the December 3, 2002 regular meeting, by reference
made a part hereto. Item B on the consent agenda included the following claims: (1) General
Fund $302,099.15; (2) Ambulance Service Fund $5,150.70; (3) E-911 Fund $2,034.76;
(4) Capital Projects Grants Fund $183.30; (5) Bond Projects Fund $2,840.00; (6) City Garage

E. Action Relating to an Amendment to the FY02-03 Capital Projects Grant Fund,
Wherein Revenues for the Fund are Increased by $42,000 and Estimated
Expenditures are Increased by $42,000.
D. Action Relating to Ordinance #730, an Ordinance Providing for the Annexation of
Approximately 1.08 Acres Located at the Southeast Corner of East 103rd Street
North and U.S. Highway 169 East Side Service Road (Ward 1).

bench.
ITEM 6: ADMINISTRATION OF OATH OF OFFICE TO WARD 1 COUNCILOR.
Motion carried 4-0, and Mr. Thoendel was appointed to fill the vacancy in the Ward 1 council
office.

Mr. Moore said that the Community Development Depmiment has been working to update the
sign code in order to protect the local business environment. Difficulty by staff in interpreting
the cun-ent code leads to an inconsistent level of enforcement. In addition to providing a more
user-friendly format, several sections of the existing code have been modified either by new
language, the rewording of some language and/or the exclusion of wording entirely. The City
Council has reviewed the proposed code in work sessions, and it has been recommended for
approval by the Planning Commission. Staff has also visited with several area community
leaders, businesses and citizens concerning the proposed amendment. If the request is approved,
an ordinance will be presented to the council on January 7, 2003. The only question raised at the
council meeting regarded large balloon-type signs on the top of buildings, and whether or not
they would be allowed under the proposed code. Mr. Moore responded that they would, indeed,
be illegal under the new code. Prior to casting her vote, Ms. Armstrong said that she has some
concems regarding pennanent signs and would be voting against the amendment. Mr. Cochran
moved, seconded by Ms. Kimball, to repeal the sign regulations contained in Appendix F of the

SIGN REGULATIONS! OF THE ZONING CODE FOR THE CITY OF OW ASSO.

Mr. Wiles presented the item. The proposed action would amend the Zoning Code of the City of
Owasso to permit mini-storage units in CS, CG, and CH zoning districts by special exception
only. Because ofthe populmity of mini-storage units, staff believes it is in the best interest ofthe
citizens that each request be reviewed on a case-by-case basis, and that public input be allowed.
If approved, all future zoned or rezoned commercial property would allow mini-storage units in
CS, CG and CH districts by special exception only. The other change would allow a two-year
window on all property that is cun-ently zoned commercial for the regulations to apply. The
Planning Commission has considered this amendment and unanimously recommended approval.
It has been discussed in other settings. If approved, an ordinance will be presented to the
Council on January 7, 2003 Mr. Cochran moved, seconded by Ms. Armstrong, to approve the
text amendment to the Zoning Code to permit mini-storage units in CS, CG, and CH zoning
districts by Special Exception only.

Mr. Moore said that the City has received a request to rezone approximately 5 acres located on
the west side ofN. 129th East Ave, approximately 2400 feet north ofE. 96th St. N. The request is
to rezone the property from RE (Residential Estates) to CS (Commercial Shopping Center). The
Technical Advisory Committee and Planning Commission have reviewed the request and both
bodies have recommended approval. Mr. Cochran moved, seconded by Ms. Kimball, to approve
the requested rezoning.

Mr. Moore presented the item. Central Baptist Church is requesting the rezoning of
approximately 2.02 acres on their property located at the southeast comer of Birch and Second
St. The request is to rezone the property from RM-1 (Residential Multi-Family) to OL (Office
Light) in order to convert the existing church to office uses. The Technical Advisory Committee
and Planning Commission have reviewed the request and both bodies have recommended
approval. Ms. Kimball moved, seconded by Mr. Cochran, to approve the requested rezoning.

Mr. Moore presented the item. The City of Owasso has received a request for the closing of the
stOlIDwater detention easement located on a portion of Lot 1, Block 2, Ram Plaza addition. The
applicant is requesting the easement closure to allow the existing structure to remain by right.
When the original site plan was approved, stormwater detention issues were incorporated into the
approved plans for the buildings now occupied by Dickinson Theatre and the Owasso Mid-High
SchooL According to staff at the time, stormwater detention facilities on those two properties
were more than sufficient to accommodate stormwater runoff from the property in questions.
The Technical Advisory Committee and Planning Commission have reviewed the request and
recommended approval subject to the following condition:
1. The applicant must provide an official copy of the easement closure to the Community
Development Department.
Mr. Cochran moved, seconded by Ms, Kimball, to approve the requested easement closure,
subject to the above-mentioned condition, and to adopt Ordinance #732.
ITEM 13 : CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE
#732, AN ORDINANCE PROVIDING FOR THE CLOSING OF A
STORMW A TER DETENTION EASEMENT LOCATED IN LOT 1, BLOCK 2,
RAM PLAZA ADDITION.

Mr. Moore said that Simmons Homes has requested the closing of the north 2' of the south 11-
foot utility easement on Lot 43, Block Sawgrass Park at Bailey Ranch. The closure is being
requested based on the incorrect placement of a single family structure. The encroachment was
made primarily out of confusion between the easement location and the setback requirements.
The Technical Advisory Committee and Planning Commission have reviewed the request and
recommended approval subject to the following conditions:
1. The applicant must provide an official copy of the easement closure to the Community
Development Department.
2. The applicant must coordinate the relocation of the City's sewer line with the Public
Works Department.
Ms. Kimball moved, seconded by Mr. Cochran, to approve the easement closing subject to the
conditions mentioned, and to adopt Ordinance #731.
ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE

Because the settlement of the pending legal action will not be accomplished until the ordinance
becomes effective, it is in the best interest of the citizens of the city to attach an emergency
clause so that the ordinance will become effective immediately upon passage and publication.
Ms. AImstrong moved, seconded by Mr. Cochran, to approve the attachment of an emergency
clause to Ordinance #728.

ATTACHMENT OF AN EMERGENCY CLAUSE TO ORDINANCE #728.

Mr. Ray said that the City Council adopted Ordinance #727 on November 19, 2002, wherein the
City's pelmit fee for the collection of commercial refuse was repealed. The action was taken
based on the recommendation of the staff and City Attorney as a method of resolving a lawsuit
against the City filed by American Waste Control Inc. At the time there was also a request to
modify language in the original ordinance in the near future relating to the transporting of waste
on city streets. Mr. Gray was recently notified by American Waste's attorney that the lawsuit
would be dismissed only when the action to repeal the section relating to transporting waste on
city streets was accomplished. Ordinance #728 repeals the language prohibiting the transport of
waste on city streets and new language has been written so that commercial trash haulers
collecting trash within the City of Owasso will have to be permitted in order to transport the
trash. Haulers simply going through the city from another location will not have to be permitted.
Mr. Cochran moved, seconded by Ms. Kimball, to approve Ordinance #728, repealing Article B,
Section 17-206 of the Code of Ordinances and adopting a new Section 17-206 relating to
collection and hauling of waste without a permit.

Mayor Helm said that the council discussed the contract for services with the city manager at the
November and December work sessions. The contract is basically the same as the cunent year,
with an increase in salary to $97,000, an increase in vacation benefit to three weeks per year, and
language added regarding termination and severance and notices of non-renewal. Mr. Cochran
moved, seconded by Ms. Kimball, to approve the agreement for services between the City of
Owasso and the City Manager for the period January 1,2003 through December 31,2003.

The proposed change is two-fold. The first change, which would occur on all fuhlre zoned or
rezoned commercial property, would permit mini-storage units in CS, CG, and CH districts by
Special Exception only. The second change would allow a two-year window on all property that is
currently zoned commercial for the current regulations to apply. In ShOli, the Special Exception
requirement would not go into effect on all propeliy that is currently zoned CG or CH until two
years from the date of publication of the ordinance.
The staff believes a change in the zoning code that would require the Board of Adjustment to
approve mini-storage units by Special Exception in all commercial districts is appropriate. It would
allow the City to review each proposal on a case by case basis, consider the development trends of
the area, the future development potential of the subject and slmounding property, and allow for
public input on a process that is currently restricted in two of the three commercial zoning code
classifications.
PROPOSED CHANGE TO THE REGULATIONS:
The City of Owasso currently permits mini-storage units in CG and CH districts outright, while it
requires approval from the Board of Adjustment by means of a Special Exception in a CS
(Commercial Shopping Center) district. It appears that at the time of establishing the zoning code,
mini-storage units were not as widely popular as they are today for the consumer, nor was there any
thought given to the amount of growth that the City of Owasso would experience.
At their regular meeting on December 17th, the Owasso City Council approved a change to the
zoning code. The change requires that proposed mini-storage uses in CG (Commercial General)
and CH (Commercial High Intensity) districts obtain Special Exception approval from the Board of
Adjustment. With the approval, the Council directed the staff to prepare an ordinance reflecting
such change for the consent agenda to be considered at the city council meeting on January 7th. The
proposed Ordinance 733 reflects this change in the zoning code.

RECOMMENDATION:
The Planning Commission considered the proposed amendment in a slightly different form in June,
and unanimously recommended City Council approval ofthe change in the zoning text.
PLANNING COMMISSION:
The integrity of established commercial neighborhoods could also be impacted by the development
of mini-storage units. Fmther, the ambiance and desirability of residential neighborhoods could be
impacted by an adjacent mini-storage use. In some cases, they could provide a suitable buffer
between residential and commercial propeliies. In other cases, mini-storage units could supply a
service to an area that has a demand for storage space. Under the proposed change, the Board of
Adjustment would have the ability to make sure that the demand for mini-storage uses could be
accommodated when appropriate while protecting the business districts (and adjacent residential
ar'eas) that might house the mini-storage uses.
Typically, there is minimal supervision of the types of equipment and materials stored in mini-
storage units. Furniture, lawn maintenance equipment, chemicals, and all manners of other
household items are placed in the facilities. The storage of such a wide array ofthings would be an
appropriate use of industrial land, but might be inappropriate or even hazardous in some
commercial areas,
The possibility of potentially valuable sales tax generating property being occupied by mini-storage
units is not desirable. Many major intersections in Owasso are zoned or These districts
are designed to accommodate a wide variety of commercial uses such as retail, lodging, dining, and
others. Uses such as these constitute a major economic impact in the community. The staff finds
that the location of mini-storage units in commercial areas should be considered on a case by case
basis so that the potential affect on the city's sales tax base might be taken into account.
The staff finds various reasons to consider the Board of Adjustment review for all mini-storage
developments in commercial distticts.

RECOMMENDATION:
December 31 S\ 2002 is the last day of employment for Phil Lutz. Mr. Lutz has been employed
with the City for an excess of five years and falls between ages 55 and 65. Therefore, Mr. Lutz
meets both requirements for Early retirement.
Oklahoma Municipal Retirement Fund (OMRF), the retirement plan for non-police and fire
employees, requires the City Council acting as the OMRF Retirement Committee to approve
applications for retirement. To be eligible for retirement through OMRF an employee must have
a minimum of five years of employment. Once an employee has five years of service he/she is
considered vested and, upon leaving employment with the City, has three retirement options,
depending upon his/her age. The first option, NOlmal retirement, is available to a vested
employee age 65 or older. The second option, Early retirement, is available to a vested employee
between ages 55 and 65, and the third option is Deferred retirement. Deferred retirement is an
option available to vested employees under the age of 55. This allows an employee to "defer"
his/her retirement benefits to a future date, at which time he/she would begin receiving monthly
retirement benefits.

The primary election is set by Charier and will be March 4, 2003. If a general election is
necessary, it will be held on April 1, 2003. A general election will be held ifone candidate in the
primary election does not receive a majority of all the votes cast for that Ward. The elected
councilor will be sworn in at the first meeting in May (May 6, 2003).
The filing period is February 3, 4, & 5, 2003. All candidates must file a Declaration of
Candidacy with the Tulsa County Election Board between 8:00 a.m. and 5:00 p.m. on one of
those days. Only qualified electors who have resided in Ward 1 for at least six months prior to
filing a declaration of candidacy shall be qualified to hold the office of Ward 1 Council Member,
and only qualified electors who have resided in Ward 2 for at least six months prior to filing a
declaration of candidacy shall be qualified to hold the office of Ward 2 Council Member. All
registered voters residing within the city limits of the City of Owasso will be able to vote for the
candidates.
Staff has prepared Resolution #2003-01 which, if approved by Council, calls for an election to be
conducted for these Wards and allows for proper notification to. the Tulsa County Election
Board. It also identifies the process that must be followed to meet all legal requirements.

J'ECHNICAL ADVISORY COMMITTEE
The Owasso Technical Advisory Committee reviewed the proposed annexation at their
November 27, 2002 regular meeting. At that meeting, no opposing comments were sited
by staff or utility providers.
If this Commission approves the annexation petition, the petition will be forwarded to City
Council for final review and approval.
Staff published legal notice of the annexation petition in the November 14,2002 edition of
the Owasso Reporter. Staff has received no phone calls or correspondence concerning the
request. Staff will publish two consecutive legal notifications in the Owasso Reporter prior
to City Council review ofthe petition.
A copy of the Annexation Policy is attached for your information and review. subject
property meets all of the requirements included within the policy with the exception of tract
size. However, staff should point out that the policy is merely a guideline and should not
be considered concrete. Staff recommends that this Commission exercise some flexibility
in reviewing the applicant's request. Staff feels that it is in the best interest of the City of
Owasso to have the City's development standards govern the development of this parcel
rather than Tulsa County.

1. While there is no minimum tract size, properties of larger than 20 acres are preferable.

further development of their property. All legal uses annexed into the City will be legal,
but non-conforming, which means that they may continue but cannot be expanded
without proper zoning.
4. All public infrastructures that do not meet City standards will not be improved by the
City until brought to the City standard and accepted by the City Council. Such public
facilities must be improved at owners expense by the establishment of a special
assessment district or some other financing method.
5. Where a City limit boundary ends at a dedicated street, the boundary will not include the
street right-at-way. This policy will establish consistence and allow City employees and
citizens to know where the City boundaries are.

The City of Owasso Annexation Committee reviewed the proposal at the November 27, 2002
Special Meeting and unanimously recommended approval.
ANNEXATION COMMITTEE:
If the annexation were approved and prior to any development, the applicant would be required
to apply for and receive plat approval from the City of Owasso. This approval would consist of
not only the Preliminary and Final Plat reviews by the Technical Advisory Committee and
Planning Commission, but also Final Plat approval from City Council. Any development that
potentially occurs on the subject property would be required to adhere to all subdivision and
zoning requirements including but not limited to paved streets, sidewalks and stormwater
detention facilities.
The applicant is requesting this annexation petition in order to construct RS-3 (Residential Single
Family High Density District) typical homes. The subject propeliy is cunently zoned AG
(Agricultural) in Tulsa County. All property annexed into the City is required to be zoned the
lowest zoning classification (AG) or retain the zoning classification obtained in Tulsa County. A
potential rezoning request to allow for residential uses would require notification to property
owners within 300' of the property as well as publication of a legal advertisement in the Owasso
Reporter. Additionally, a rezoning sign would be posted on the property at such time that a

RECOMMENDATION
Staff recommends approval of the request by the Phyllis J. Sokolosky Living Trust to annex
into the corporate limits of the City of Owasso approximately 49.99 acres +/-.
Staff contacted the Oklahoma State Department of Mines for clarification on the issue
surrounding the Annexation Committee's condition of approval. Attached for your
information and review is a copy of the letter submitted by Ms. Everette, Coal Permitting
Officer for the Department of Mines. Staff feels that the information contained within the
attached letter is sufficient for the Annexation Committee's purposes.
OW ASSO ANNEXATION COMMITTEE
The Owasso Annexation Committee, at their November 27, 2002 Special Meeting,
reviewed the proposed annexation. At that meeting, the Annexation Committee
recommended conditional approval subject to the following condition:
1. The applicant provides clarification as to whether or not the site is contaminated or
requires environmental remediation prior to development.
TECHNICAL ADVISORY COMMITTEE
The Owasso Technical Advisory Committee reviewed the proposed annexation at their
November 27, 2002 regular meeting. At that meeting, no opposing comments were sited
by staff or utility providers.
If this Commission approves the annexation petition, the petition will be forwarded to City
Council for final review and approval.
Staff published legal notice of the annexation petition in the November 14,2002 edition of
the Owasso Reporter. Staff has received one phone call in opposition to the request. Staff
will publish two consecutive legal notifications in the Owasso Reporter prior to City Council
review of the petition.

1, While there is no minimum tract size, properties of larger than 20 acres are preferable,

3. All properties should be annexed into the City limits as the lowest zoning classification,
that is, Agricultural (AG)o landowners may then petition for rezoning if they desire
further development of their property. All legal uses annexed into the City will be legal,
but non-conforming, which means that they may continue but cannot be expanded
without proper zoning.
4. All public infrastructures that do not meet City standards will not be improved by the
City until brought to the City standard and accepted by the City Council. Such public
facilities must be improved at owners expense by the establishment of a special
assessment district or Some other financing method.
5. Wllere a City limit boundary ends at a dedicated street, the boundary will not include the
street right-of-way. This policy will establish consistence and allow City employees and
citizens to know where the City boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for a
six month period after rejection by the City Council.
The following annexation policy for the City of Owasso is provided as a guideline and should
not be construed as inflexible requirements for annexation.
