proclamation to Cindy & James Thomas, honoring Thomas Auto Repair & Detailing as Business
of the Quarter for the First Quarter of2003. He then read and presented a proclamation to Cliff
Motto & Roger Voss, recognizing the week of Febmary 9-15, 2003 as Oklahoma Emergency
Management Week in the City of Ow as so.

The Owasso City Council met in regular session on Tuesday, February 4, 2003 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin at 4:00 p,m. on Friday, January 31,2003,

Mr. Carlson presented the item. This item was tabled from the January 21, 2003 City Council
meeting to allow time for the City Attorney to research a question raised by Mr. Groth relating to
the cost of the proj ect being taken from the General Fund instead of the Golf Authority Fund.
More specifically, the question was whether or not the City of Owasso could spend General Fund
monies to construct a restroom on property owned and operated by public tmst authorities, with
the City of Owasso as the beneficiary entity. The City Manager requested a legal opinion from
the City Attorney. After researching the concern with the Oklahoma Municipal League, as well
as reviewing the Oklahoma Constitution, Oklahoma State Statutes, City Charter, and City Code,
Mr. Gray concluded that "the City of Owasso may spend public funds of a general nature to

Mr. Ray introduced Fire Chief Lonny Fisher, who presented the Character Trait for the month of
Febmary - Flexibility. Chief Fisher also gave an update on the condition of Chris Demauro.
Sgt. Doug Driver gave an update on the condition of his daughter, Kristin.
ITEM 9: REPORT FROM CITY MANAGER

Mr. Rooney presented the item. He said that the City Council approved Resolution #2002-10 on
August 20, 2002 as part of the application process requesting financial assistance from the
Oklahoma Department of Commerce under the FY 2002 Small Cities set-aside funding. The
application was specifically directed toward improvements relating to the Americans With
Disabilities Act, with the intent to improve access ramps and sidewalks throughout the expanded
CDBG district. An inventory of existing sidewalk facilities was conducted, and recommended
improvements were presented at a public hearing on August 20, 20020 The staff received notice
on January 20,2003 that funding in the amount of $67,132 has been approved. Ms. Annstrong
moved, seconded by Mro Thoendel, to accept the grant from ODOC and authorize the Mayor to
execute the appropriate documents.

ACCEPTANCE OF CDBG FUNDS; AND AUTHORIZATION FOR THE MAYOR

course was constructed, the citizens were promised that no public funds would be expended for
the project. With no further discussion, Mr. Cochran moved, seconded by Ms. Armstrong, to

Owasso City Council
Mr. Carlson said that year end results for Bailey Ranch Golf operations showed losses for the
fiscal year that were unacceptable. The City has undertaken a full review of operations. As a
ITEM 4: DISCUSSION RELATING TO GOLF COURSE FEES:
Mr. Wiles said that the City of Owasso staff is participating with the City of Collinsville to
develop a proposal to be submitted to the City of Tulsa/Tulsa County relating to a regional
county park north of Owasso and south of Collinsville. There is no county park in the area and
staff believes that such a facility is needed. Recreational opportunities could include a driving
range, amphitheater, trails for pedestrians and equestrians, playground, a community center, and
other amenities. The park would need to be situated on a tract of at least 50 acres, and Tulsa
County would construct, operate, and maintain it. A Tulsa County bond issue would fund the
project. Staff is ready to prepare and submit the proposal.
ITEM 3: DISCUSSION RELATING TO A REGIONAL PARK PROPOSAL.
Mr. Wiles said that the zoning request turned in for the land west of the public works facility on
76th Street had an inconect legal description and was tabled to the March meeting. There were
no other items to be taken to the Council. The controversy regarding a recent annexation request
is close to being resolved.

Mayor Helm called the meeting to order at 6:00 p.m.
The Owasso City Council met in a special meeting on Tuesday, February 11, 2003 in the Main
Conference Room at Owasso City Hall per the Notice of Public Meeting and Agenda posted on
the City Hall bulletin board at 4:00 on Friday, February 7,2003.

Mr. Hayes updated the Council on a prospective company that is considering locating in Owasso.
In June of 2001, the City Council adopted Ordinance #680, approving a resolution of the golf
authority to increase fees at the golf course. An ordinance is not necessary to establish those
fees, and staff has pre~ared an ordinance repealing Ordinance #680 to be presented to the
Council on February 18t .
The History Society is struggling to keep their museum open. In the last three years the Society
has experienced declining revenues from its fundraising efforts, and it is difficult to find enough
volunteers to keep the museum open. Based on discussion with the Owasso Historical Society,
staff proposes that the City assume ownership of the Historical Society property and facilities,
that the City assume responsibility for operating expenses and maintenance, and that an advisory
board be created so that the Historical Society will have input into future operations and
development The City would located an employee at the museum, who would be responsible
for extending the operating hours and recruiting and coordinating volunteers. The employee
would be assigned duties at the museum in addition to his or her existing responsibilities, adding
no additional cost to the City budget Staff is working on an agreement to be take to the Council
for action.
Mr. Ray said that the staff is requesting the establishment of a Veterans Memorial Fund to
facilitate the receiving and disbursing of funds for the proposal memorial. The City Attorney has
determined that the City's status as a recipient of tax deductible donations may be utilized.
Payment for expenses for the memorial could then be made with the approval of the City
Council, as required for any city funds. An unofficial understanding will be that no expenditures
will be made without the consent ofthe Veterans Memorial Committeeo This item will be on the
February 18th City Council agenda for action.

Ms. discussed the financial reports the month January, as well as year~to-date
revenues and expenditures. She discussed the sales tax receipts, and said that sales tax was down
significantly for the last reporting period. She is going to check with the tax commission to see
if someone reported late. We won't know until the next reporting period if we are seeing a trend
toward less sales tax receipts.

and revenues for prime time and twilight and to increase the number of tournaments and other
group outings. In some instances the rates will be slightly higher than at present, and in some
instances they will be slightly lower. The proposal also includes memberships, which is new. A
resolution adopting the proposed fees will be on the agenda on February 18th.

Staff recommends Council acceptance of the Villas at Bailey Ranch sanitary sewer system and
water system.
RECOMMENDATION:
The contractors have provided a one-year In-evocable Letter of Credit for the sanitary sewer
system and water system (see attached),
Final Inspection of the sanitary sewer system was conducted on January 13, 2003 and the final
inspection of water system was conducted on January 10, 2003. All items identified at the final
inspection requiring conection to meet city standards have been completed.
FINAL INSPECTIONS:
The subject property is a 132-unit apartment complex located at 8251 North 97th East Avenue,
approximately 0.1 miles north of the northeast comer of East 86th Street North and North 97th
East Avenue intersection (see attached map). The sanitary sewer system consists ofa total of 742
linear feet of 8-inch PVC sanitary sewer line. The water system consists of 1,120 linear feet of
6-inch PVC water line, Public Works personnel reviewed and approved the design and inspected
the construction of the systems. The Oklahoma Department of Environmental Quality has
reviewed and permitted the project.

"The City of Owasso has issued a building permit for the construction of 132 apartment units
known as The Villas at Bailey Ranch (hereinafter "The Villas") located at 8751 North 971h East
Avenue, Owasso, Oklahoma. The Villas has constructed certain utilities, more specifically,
sanitary sewer, storm sewe!:, and water mains (hereinafter "utilities") as per building plans
submitted to and approved by the City of Owassoo The City of Owasso has conducted inspections
on the "utilities", has discovered defects in material and/or workmanship related to the "utilities"
and has so notified The Villas. The Villas has failed to remedy the defects and the attached draft
represents the amount due the City of Owasso as a result of this failure.

RECOMMENDATION:
On June 16, 2001, the Ow as so City Council adopted Ordinance #680, an ordinance approving
Resolution #2001-03 ofthe Owasso Public Golf Authority increasing green fees, cart rentals, and
range fees at Bailey Ranch Golf Club, An ordinance is not necessary to establish those fees.
Therefore, staff is requesting that the City Council repeal Ordinance #680. Ordinance #741
would repeal the action taken by Ordinance #680.
Normally rates and fees are not expected to be permanent. Most rates and fees do not need the
enforcement power of an ordinanceo (Utility rates are enacted by ordinance to provide greater
enforcement authority.) A resolution is the best method to establish most operating fees.
A resolution is defined to mean "a special or temporary act of a governing body which is
declaratory of the will or opinion or a municipality in a given matter and is the nature of a
ministerial or administrative act. A resolution is not a law and does not prescribe a permanent
rule of conduct or government." (Title 11, Section 1-102)
An ordinance is defined by state law as "a formal legislative act ofthe municipal governing body
which has the force and effect of a continuing regulation and a pelmanent rule of conduct or
government for the municipality." (Title 11, Section 1-102)

However, there is one concern/problem that, with the City's help, can be resolved in a manner
that will save the committee both time and money.
The design of the memorial is an ongoing process, with the assistance of an architect from Akins
America, the same firm that is designing the city's water system improvements. The site
location process has nanowed the potential sites to three, and a decision reached by the end of
March. Fundraising has been initiated, and $5000 has been banked, with another $26,000
pledged. Obviously, all three of the committee's prime initiatives are moving forward with good
progress.
Since November the committee, composed of Vice Mayor Cochran, Melinda Voss (citizen
representative), Canoll Harris (VFW), John McDaniels (American Legion), and Pete Kourtis
(citizen representative), has met and initiated efforts in the areas of design, funding, and location.
Their goal is to initiate construction of a memorial in July, with a completion and dedication of
the memorial set for November 11 th ofthis year.
On November 11, 2002, a group comprised of city officials, veterans organization
representatives, and private citizens announced the creation of an "Owasso Veterans Memorial
Building Committee." This announcement came after two months of preliminary discussions
between the organizations, that resulted in an agreeable concept for planning, funding and
constructing a veterans memorial in Owasso.

The staff has reviewed this matter and recommends Council approval of the creation of a special
account for the Owasso Veterans Memorial Building Fund.
RECOMMENDATION:
3. An unofficial understanding should be reached that no expenditures will be made without the
consent ofthe committee.
2. Many donors will be more comfortable if the City offers its stability to the effort.
1. The City most likely will be the owner of the completed memorial, so there will be
involvement from the City.
COMMENT:
After discussions with Ms. Bishop and the City Attorney, an option was developed that can
utilize the City's status as a recipient oftax deductible donations. The City Council may approve
the creation of a restricted city fund to which donations for the memorial can be made. Payment
for expenses for the memorial could then be made from that fund with the approval of the City
Council, as is required for any city funds.
PARTIAL SOLUTION:
The problem is the creation of an independent entity that can accept tax deductible donations
(501(c)3). It appears that, in the committee to eligible for such designation, it
will cost fees of approximately $2500 and to two months review time the
