Improvements to the Rayola Park drainage channel were included within the FY 2002-03 budget and the
bid packet for this project is nearly completed. I will brief you on the project Tuesday evening and answer
any questions you may have.

Please note that the bid specifications for this improvement were based on unit prices, and the total cost of
the improvement could be more if there is any unforeseen circumstance encountered with this project.
However, because it is an existing parking lot and the area is predetermined, the likelihood of this
occurring is minimal.
Ashlock Dozer of Skiatook, Oklahoma was the qualifying low bidder. Although not previously awarded a
contract with the City of Owasso for any type of paving improvement, a review of the references of
Ashlock Dozer were positive, with work being completed recently in the Town of Skiatook.
All bids were to be received by January 7, 2003 at 2:00 PM. A total often bid packets were picked up
from the City Clerk's office, four of which submitted bids. The City of Ow as so received bids from the
following:

A review of all bids received indicates all are in compliance with bid specifications.
In December, the Parks Department began the process of advertising for bids in order to provide an
improved surface to the parking lot. The bid packet was developed with a base bid and an alternative bid
specification. The base bid induded final grading and excavation (necessary to remove large rocks and
stones in the existing gravel parking lot) and a double bituminous surface treatment (chip seal) overlay.
The alternate included final grading and excavation and three inch asphalt overlay.
BACKGROUND:
The FY 2002-03 Budget induded funding for Capital Improvement Projects for several different projects
throughout the City of Ow as so. Included in that project list was funding to provide improvements to the
Sports Park parking lot. A total of$100,000 was budgeted for this improvement.

The CITY OF OW ASSO may waive any informalities or minor defects or reject any and all
BIDS. Any BID may be withdrawn prior to the above scheduled time for the opening of BIDS
or authorized postponement thereof. Any BID received after the time and date specified shall

copy of their power of attorney.
PERFORMANCE AND MAINTENANCE AND STATUTORY PAYMENT BONDS in the
amount of 100 percent (100%) of the Contract Price, with a corporate surety approved by the
CITY OF OW ASSO, will be required for the faithful performance of the contract.
Each Bid must be accompanied by a BID BOND payable to the CITY OF OW ASSO for Five
Percent (5%) of the total amount of the BID. As soon as the BID prices have been compared, the
CITY OF OW ASSO will return the BONDS to all except the three lowest responsible
BIDDERS. When the Agreement is executed, the bonds of the two remaining unsuccessful
BIDDERS will be returned. The BID BOND of the successful BIDDER will not be returned
until the PERFORMANCE AND MAINTENANCE AND STATUTORY PAYMENT BONDS
have been executed and approved, after which it will be returned. A certified check may be used
in lieu of a BID BOND.
Said improvements shall include items in the specifications.
Separate sealed Bids SPORTS PARKING all appurtenances thereto, will be

Again, authorizing the Mayor to sign the agreement commits the City to purchasing the property if an
election is held, if this item is placed on the ballot, and ifit is approved by the voters and prevents the land
from being developed until that time. If the issue fails to get on the ballot, or if the proposal fails, the
developers move forward with their plans.
The contract places the cost of the land at $19,875 per acre, which is comparable to other sales of large
tracts ofland in nearby areas. Staff believes this to be an excellent "window of opportunity" to be able to
secure the land at this time. It is likely that if we don't move forward, the land will develop in a single-
family nature, and the likelihood of expanding the Sports Park in its existing location would be eliminated.
Additionally, as land continues to develop residentially and costs to purchase land continue to increase, the
likelihood of purchasing large undeveloped tracts of land decreases, as does affordability.
A rough draft of the contract is attached for your information and review. The contract would prevent the
future sale and! or development of the property until such time that the City can have an election for the
purpose of purchasing the property. The election would likely be combined with other needed capital
improvement projects, as well as the third penny sales tax extension. If the measure failed, the City would
not be penalized in any manner monetarily and the current owners could move forward with their plans.
The previous owners of property adj acent to the Sports Park knew of the City's interest in the property, but
at the time of those discussions, did not provide any indication of a willingness to work with the City.
The long time owners of the property, recently sold it to the Owasso Land Trust. After hearing of plans
that Owasso Land Trust was planning to develop the tract of land into single-family housing, staff
approached the new owners regarding our desire to obtain the land for the future Sports Park expansion.
Owasso Land Trust is willing to sell the land to the City on an agreed upon price providing that a contract
is executed.
As the Sports Park property rapidly approaches "build-out" and as the population in Owasso continues at
its rapid rate of growth, it ha"l become obvious that additional recreation opportunities, both traditional and
alternative, will be needed.

2. PURCHASE PRICE: The total purchase price is $1,590,000.00 to be paid upon Closing by
cashier" check of certified funds.
3. TAXES AND PRORATIONS:
A. The SELLER shall be responsible for: (i) all special assessments against the PROPERTY
upon the date of Closing, whether or not payable in installments; (ii) all taxes, other than general ad
valorem taxes for the current calendar year, which are a lien on the PROPERTY upon the date of Closing;
and (Hi) the cost of any item of workmanship or material furnished on or prior to the date of Closing which
is or may become a lien on the PROPERTY.
B. SELLER and BUYER shan prorate the general ad valorem taxes for the Clm-ent year on
the subject PROPERTY as ofthe date of Closing.
4. CONDITION OF PROPERTY:
A. Until Closing or transfer of possession, risk ofloss to the PROPERTY, ordinary wear
and tear excepted, shall be upon SELLER; after Closing or transfer of possession, such risk shan be upon
BUYER.
B. Unless otherwise agreed upon in writing, BUYER, by Closing or taking possession of
the PROPERTY, shall be deemed to have accepted the PROPERTY in its then condition. No warranties,
express or implied, by SELLER or SELLER'S agents, with reference to the condition of the PROPERTY
shall be deemed to survive the Closing.
5. CLOSING: Subject to the provisions of paragraph three (3) and subject to the fulfillment of
any conditions to the Closing specified in paragraph seven (7), the Closing shall be held on or before the
30th day of December, 2003. If there are valid objections to title which require corrections, the Closing
shall be extended for forty-five (45) days to correct such objections. Valid objections to title shall consist
of any circumstance, item or matter appearing of record or extraneous thereto which, under the Title
Examination Standards of the Oklahoma Bar Association, would adversely affect or impair the
marketability or merchantability of title as such is defined in the Title Examination Standards ofthe
Oklahoma Bar Association. If such valid objections to title cannot be cured within the forty-five (45) day
time period, unless extended by mutual consent or, alternatively, if SELLER shall desire not to cure such
valid objection to title, then, in such event, this contract shall be thereby nullified. At the Closing, the
SELLER shall deliver to BUYER a duly executed and acknowledged warranty deed conveying indefeasible
fee simple title to the PROPERTY to the BUYER upon payment of the Purchase Price as heretofore
provided. Unless otherwise agreed to in writing, possession shall be transferred at Closing. In the event
the closing date is delayed at no fault of Seller, and in the further event that Seller desires to extend the
closing date to accommodate Buyer, then the purchase price set forth in Paragraph two shall accrue interest
thereon at the rate of seven per cent (7%) per annum from the initially required closing date through the
actual closing date as extended.
6. BREACH OR FAILURE TO CLOSE: If BUYER shall perform all ofthe obligations of
BUYER hereunder and SELLER shall breach this Contract or fail to perform any of SELLER'S obligation
hereunder, the BUYER shall be entitled to cancel and terminate this Contract, or pursue specific
performance of this Contract.
7. SPECIAL CONDITIONS:

THIS CONTRACT is entered into between Owasso Land Trust, L.L.C. ("SELLER") and The City
of Owasso, Oklahoma, an Oklahoma Municipal Corporation, ("BUYER").
Upon approval of this Contract by both SELLER and BUYER, evidenced by their signature
hereto, a valid and binding contract of sale shall exist.

A copy ofthe contract for purchase is attached for your information and review, as well as a photo of the
restroom and floor plans. Due to enlargement for printing, the quality of the photo is poor, however the
original photo can be seen at www.romtec.com.
Due to the accessibility of water and sewer in the immediate vicinity, the restroom will be located at the
Hole #7 tee box. The restroom would have both a men's and women's facility as well as a storage room at
the facility for paper products. It would feature a metal roof with split face block. Staff estimates the total
cost of the project will not exceed $35,000, well within the budgeted $40,000 for this improvement.
As ittums out, the cost of the restroom itself ($24,998) would just be within the spending limit of the City
Manager ($25,000). However, because the total cost of the restroom project (water and sewer taps, slab
and sidewalk areas, landscaping) will raise the fmal cost above $25,000, staff felt it was necessary to
obtain council approval final to moving forward.
The restroom is constructed by ROMTEC of Rose burg, Oregon which is the same company utilized by the
Oklahoma Turnpike Authority to supply their pre-fabricated restrooms. Staff initially contacted ROMTEC
because of the look of the restroom and also with the understanding that their bid would be included on the
State bid list, thus making it easier to be utilized by Bailey Ranch Golf Club.
In the fall, staff began the process of reviewing the best alternative for the restroom project. Research
included building a completely new structure (similar to the most recent restroom at the Sports park but on
a smaller scale), as well as purchasing a pre-fabricated unit similar to those found on the Oklahoma
Turnpike. After completion of the review, it was staff's opinion that purchasing a pre-fabricated unit
would be the best option due to the costs involved.

course restroom at Bailey Ranch golf Club. A total of $40,000 was budgeted for this improvement.

Romtec, Inc. (Romtec) wiII provide vaults, vault toilets, buildings or kits as listed on the reverse side hereof in accordance with the tollowing terms and conditions:
I. Terms of Payment. Payment due Net 30 days from date of Invoice.
2. Terms of Delivery. Romtec will not be liable for any delay in the performance of orders or contracts, or in the delivery or shipment of goods, or for any damages suffered by
the customer by reason of such delay, when such delay is, directly or indirectly, caused by, or in any manner arises from, fires, Hoods, accidents, civil unrest, acts of God,
war, governmental interference or embargoes, strikes, labor difficulties, shortage of labor, fuel, power, materials, or supplies, transportation delays, (whether or not
transportation is arranged by Romtec) or any other cause or causes (whether or not similar in nature to any of these hereinbefore specified) beyond its control. All goods are
shipped F.O.B. Roseburg, Oregon, which means that the risk ofloss or damage to the goods and risk of delays in transit passes to the customer when the goods arc duly
delivered to the camer at Roseburg, Oregon. Romtec has no control over arrival time of a shipment, and shall not be responsible for delays in shipments once the goods
leave Romtee's plant.
3. Claims. The following provisions apply to all claims:
a. Freight Damage Claims. If RomteG should agree to ship goods under any arrangement whereby Romtee remains responsible for risk ofloss or damage while the goods
are in transit, any claims of customer for damage in transit shall be deemed waived and released by the customer, unless made in writing endorsed on thc bill of lading at
the time customer accepts delivery ofthe merchandise. CUSTOMER SHOULD CAREFULLY INSPECT THE MERCHAN. DlSE BEFORE ACCEPTING
DELIVERY.
p, Claims of Defective Marmfadure. Claims that the merchandise was incorrectly manufactured or that it is defective in any way must be made directly to Romtec on a
product by product basis. All claims must be made within 72 hours of discovery, at time ofinstallation by the customer, of the defective condition ofthe goods. All
claims must include the following:
( I) A product serial number;
(2) Specitlc location;
(3) Names and phone numbers orindividuals who can substantiate the claim, but who do not work for customer;
(4) A detailed description of the specific problem, failure, or other event giving rise to the claim; and
(5) Supporting photographs or videos.
c. Action in Event of Established Ciaim. In the event it is determined that Romtec is responsible for a claim, Romtec may, at its option, either replace or repair the goods.
In addition, Romtec will reimburse for actual installation labor costs caused by any defect in the goods at the rate of not more than $35 per hour. Romtec also reserves
the right to establish reasonable time limits for completion of any specific installation tasks resulting from the replacement of defective merchandise.
1.1, No Third Party Claims. Under no circumstances shall Romtec be responsible for any damage claims by any party other than claims by Romtec's direct customers.
4. Description of Products. All Romtec products are built to the specifications listed in the specific products installation manual or product literature supplied by Romtec. A
customer's individual installation may exceed the limits specified in Romtec's specifications. The customer accepts total responsibility forthe customer's installation and
any structural failures and problems which may occur if the customer exceeds Romtec's specifications, unless the customer can establish that it tested the soil or other
conditions such as fill or concrete loading and that the customer did not exceed the extemalloading pressures applicable to the product.
5. The term, "Job specifications" as referred to on this page are the bid specifications the customer has received from an agency to bid the installation ofa toilet facility for
that agency. Romtec is a third party supplier to the customer. The customer is responsible tor interpreting the job specifications of a given job. Romtec wi!! not interpret the
specifications for the customer. Romtee will quote and/or ship what the customer asks Romtec to quote and/or ship either implied or expressed. By evidence of the
customer's signature on the front of the purchase order form, the customer acknowledges that he/she has read the job specifications and has independently interpreted the
scope of work prior to requesting a quote from Romtec and prior to signing the purchase order form. Customer releases Romtee of and from any and all claims, demands,
action and causes of action should the customer request a quote for or purchase the wrong goods (see item 9 Oftllis page).
6. Procedures for Handling Products. Romtec's suggested procedures for handling products are as follows:
a. SST Traditional buildings cannot be carried by the eyehook on the top of the building while on the pallet or once off the pallet. The eyehook is designed for limited lifting
and placement ofthe building.
b. Traditional buildings mnst be shipped or transported in a vertical position on their pallet.
c. Romtec buildings or building kits are not packaged or pelletized to withstand rough road transportation.
d. Romtee Traditional buildings have a door jack which holds the door in place during shipment. Once the door has been opened, the jack has been removed. Transportation
of the building without the door jack in place may damage the door frame or door. Be sure the door jack is in place when transporting the buildings.
e, Romtec buildings or building kits and tanks require special equipment to 1U1load from semi trucks. The customer willlleed a fork lift and must follow instructions in Romtee's manual for
unloading.
7. Warranties. ROMTEC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES AS TO MERCHANTABILITY OR AS TO THE
FITNESS OF THE MERCHANDISE FOR ANY PARTICULAR USE OR PURPOSE, AND SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE, DI. RECTL Y
OR INDIRECTLY, ARISING FROM THE USE OF SUCH MERCHANDISE OR FOR CONSEQUENTIAL DAMAGES, EXCEPT AS SET FORTH HEREIN.
B. Special Orders. If any merchandise is produced to meet the customer's particular specifications or requirements and is not part of Romtec's standard line offered by it to
the trade generally in the usual course of Romtec's business, customer shall pay an amount established by Romtee, in advance, before Romtec begins production of tlle
merchandise.
9. Release and Hold Harmless. Customer releases Romtec of and from any and all claims, demands, actions, and causes of action for any matters in any way arising out of or
connected with the merchandise, except for obligations expressly assumed by Romtec herein. Customer agrees to indemnifY Romtec and hold it harmless from any and all
claims, demands, actions and causes of action in any way arising or growing out of customer's use, sale, installation or misinterpretation of job spedfications.
10. Time of Shipment and Delivery. Unless the customer has otherwise specified on the purchase order, Romtec may ship goods pursuant to an order at any time after the
goods are completed and ready for shipment. Further, unless payment has been made in advance, if a carrier holding a Romtec shipment ordered by a customer is ready to
deliver the goods to the customer, the customer agrees to accept the goods at the carrier's earliest possible delivery date and time. Deliveries which are delayed by the
customer may be canceled by Romtec and the goods returned to Romtec at its discretion. Any costs or difficulties arising from the customer's act in delaying receipt of
Romtee's shipments is the complete responsibility of the customer. If the customerdoes delay receipt of the shipment, the customer agrees to pay Romtec an amount equal to
5% of the value of the shipment for each day of delay in accepting the shipment. The customer agrees to pay for the complete shipping cost if Romtec elects to cause the
goods to be returned to Romtec or delivered to another customer.
II. Controlling Provisions. The terms and conditions of this quotation or purchase order shall supersede and control any provisions, terms, and conditions conlained on any
continuation order, purchase order, or other writing the customer may give or receive, and the rights of the parties shall be govemed exclusively by the provisions, terms,
and conditions hereof. If this quotation is accepted and the customer's order form is used for the purpose, no provision of customer's order form which in any way conflicts
with any of the terms hereof or places any additional burden on Romtec, shall prevail, and any such provision shall be null, void, and of no effect, but the issuance of the
order by the customer shall constitute an acceptance by the customer of the provisions of this quotation or purchase order. This quotation or purchase order is not deemed to
be a firm offer and may be revoked at any time prior to acceptance by Romtcc of a purchase order submitted by customer.

The Owasso Technical Advisory Committee reviewed the application at their December 30,2002 regular
meeting. No comments were provided by staff or utility providers.
If the annexation petition were approved, the applicant would be required to receive plat approval from
the City of Owasso. This approval would consist of not only the Preliminary and Final plat reviews by
the Technical Advisory Committee and Planning Commission, but also Final Plat approval from City
Council. Any development that occurs on the subject property would be required to adhere to all
subdivision and zoning requirements including but not limited to paved streets, sidewalks and
stormwater detention facilities.
ANALYSIS:
The applicant is requesting the review of this annexation petition in order to construct RS-3
(Residential Single Family High Density District) typical homes. The subject property is currently
zoned AG (Agricultural) in Tulsa County. All property annexed into the City is required to be zoned
the lowest zoning classification (AG) or retain the zoning classification obtained in Tulsa County. A

within 300' as well as publication of a legal advertisement in the Owasso Reporter. Additionally, a

Adopted by City Council on March 1, 1988.
1. While there is no minimum tract size, properties of larger than 20 acres are preferable.
2. All properties should be contiguous to existing City limits.
3. All properties should be annexed into the City limits as the lowest zoning classification,
that is, Agricultural (AG). Landowners may then petition for rezoning if they desire
further development of their property. All legal uses annexed into the City will be legal,
but non-conforming, which means that they may continue but cannot be expanded
without proper zoning.
4. All public infrastructures that do not meet City standards will not be improved by the
City until brought to the City standard and accepted by the City Council. Such public
facilities must be improved at owners expense by the establishment of a special
assessment district or some other financing method.
5. Where a City limit boundary ends at a dedicated street, the boundary will not include the
street right-of-way. This policy will establish consistence and allow City employees and
citizens to know where the City boundaries are.
S. Properties that are rejected for annexation should not be considered for annexation for a
six month period after rejection by the City Council.

Staff finds little if any reason to deny the requested zoning change. As previously stated, the
applicant's proposal and that of the Momingwood Preliminary Plat are considered by staff to
be consistent with the Owasso 2010 Master Plan. Additionally, staff feels that the proposal
VIIOuld set an aesthetically pleasing precedent in the area and provide for further home
ownership opportunities within the City of Owasso.
i\J'lAL YSIS
As previously stated, the applicant is requesting concurrent review of this application in order
to construct 58 homes on 2 blocks. Staff feels that single family uses are appropriate for this
location.
Master Plan for several reasons. First, the Master Plan labels the north half of the subj ect
property as having a future land use of public. Assuming that the north half did develop with
a public use, this would be the third such land use category in this section. Staff feels that by
approving a use of high intensity residential on this site in lieu of a public use, further
opportunities for home ownership would be provided and still be adequately served by the
additional surrounding public uses. Second, the plan identifies the southern half of the site as
having a future land use of low intensity residential. The applicant's rezoning request is for
(Residential Single Family High Density District) which would seem to be inconsistent.
However, based on the definition of low density residential uses in the Master Plan, the
inconsistency would seem to a matter of confusion. The Master Plan defines
density residential as having a density 2 - 5 dwelling units acre. The Morningwood
Preliminary Plat, which the applicant is seeking concunent review with this rezoning
petition, contains 58 lots on 15.00 acres with a density of 3.8 units per acre and consistent
with the stated definition of low density residential uses per the City of Owasso 2010 Master

Upon development, the subject site would receive residential water and sewer service from
the City of Owasso while the burden of extending infrastructure to the site would fall upon
the developer. There appear to be no infrastructure issues that would limit the development
of the subject property.
ANALYSIS
As previously stated, the applicant is requesting the review of this application in order to
utilize the site in a mmmer consistent with the subdivision to the south (Metro Heights I).
Staff feels that single family uses are appropriate for this location and given the stated
definitions of low density residential development and the park and open space requirements
of the City, the application is consistent with the City ofOwasso 2010 Master Plan.
Secondly, the plan identifies northern the site as a ulture land use
park and recreational. As with any residential development in the City, park mId open space
locations or a fee in lieu of is required at the time the plat is approved. Given the definitions
of low intensity residential in the Master Plan and the City's park and open space
requirements at the platting stage of development, staff feels that the proposed rezoning is
consistent with the City of Owasso 2010 Master Plan.

The restrictions herein set forth are covenants to run with the land and shall
