E. Action Relating to the Appointment of an Authorized Agent for the Oklahoma Municipal Retirement Fund. Attachment #5- E The staff recommends City Council approval of Ordinance #700, and has listed this item in the consent section ofthe agenda based on Council action on January 8, 2002 to approve the detachment and authorize an ordinance. D. Action Relating to Ordinance #700, an Ordinance Providing for the Detachment of 312 Acres, More or Less, Generally Located West of the SKO Railroad Right-of-Way and North of East 76th Street North, on the West Side ofthe City of Ow as so. Attachment #5-D the Mayor to 1 funds and staff Council approval and authorization for execute the appropriate documents which approve the collection of remittance of those funds to the City of Owasso. Action Relating to an Agreement With VarTec Telecom lnc for the Collection of 911 Funds and to the Owasso. Attachment B. Approval of Claims. Attachment #5-B Owasso City Council January 22, 2002 Page 2 The Owasso Planning Commission has conducted a hearing on this request and recommends Council approval of the final plat for Honey Creek at Bailey Ranch, a 62.33 acre, 202 lot subdivision located north of E 96th St N and east of N Mingo Rd. The staff concurs with the recommendation. 8. Consideration and Appropriate Action Relating to a Request for City Council Approval of a Final Plat for Honey Creek at Bailey Ranch, an Addition to the City of Owasso, Tulsa County, State of Oklahoma (Ward 1). Ms Sorrells Attachment #8 The Owasso Planning Commission has held a hearing on this request and recommends Council approval of the requested zoning. The staff concurs with that recommendation. 7. Consideration and Appropriate Action Related to a Request for a Change to the Platted Limits of No Access Shown on the Final Plat of Exchange Bank- Owasso I, Along North Mingo Road at the Northeast Corner of North Mingo Road and East 86th Street North. Ms Sorrells Attachment #7 The Annexation Committee and the Planning Commission have conducted hearings on this request and recommend Council approval of the requested annexation. The staff concurs with the recommendation. 6. Consideration and Appropliate Action Relating to a Request for Annexation of a 4.5-Acre Tract of Land Generally Located North of East 96th Street North and East of North Garnett Road. ITEM 6: RECOGNITION OF OUTSTANl2INGEEEORT BY MEMBERS OF THE PUBLIC WORKS TEAM. Mayor Barnhouse presented a certificate and pin from the Oklahoma Municipal League to Police Chief Jim Greene for 25 years of municipal service. ITEM 2: INYOCATION at p.m. called the meeting to The Owasso City Council met in regular session on Tuesday, January 8, 2002 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, January 4,2002. OW ASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, Janumy 8, 2002 - 2 - Mr Ewing said that the Owasso Economic Development Authority has been discussing the institution of a hotel/motel tax, with funds derived from the tax used to encourage economic development, cultural enhancement, and tourism. The approval of a 3% tax would provide approximately $60,000 in annual revenue. Ordinance #699 outlines the use of the tax and the procedures to be followed in administering the tax. Mr Williams moved, seconded by Mr Brogdon, to approve Ordinance #699, providing for a 3% hotel/motel tax and dedicating the revenue for such tax to promote economic development. ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #699, AN ORDINANCE PROVIDING FOR A 3% HOTEL/MOTEL TAX, AND PROVIDING FOR THE USE OF FUNDS TO BE DEDICATED TO THE PROMOTION OF ECONOMIC DEVELOPMENT. January 8, 2002 Owasso City Council - 3 - No report. ITEM 11: REPORT FROM CITY MANAGER Motion canied 5-0. AYE: Helm, Brogdon, Almstrong, Williams, Barnhouse NAY: None Ms Sorrells said that the Larkin Bailey Trust has submitted a petition to the City of Owasso for the detachment of a 312-acre parcel of land, located north of E 76th St N and west of the SKO Railroad, The property is zone Agriculture and is vacant and undeveloped. The detachment petition was submitted on June 26, 2001; however, no annexation ordinance including the subject property is recorded, All maps produced in recent years include the area in the corporate limits of the City of Owasso. The City Attorney advised that a petition should be filed to detach the property since it shows on city maps. The Owasso Annexation Committee and the Owasso Planning Commission have reviewed the request and have recommended approval. Mr Helm moved, seconded by Mr Brogdon, to approve the requested detachment of property. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR DETACHMENT OF LAND CONTAINING 312 ACRES, MORE OR LESS, GENERALL Y LOCATED WEST OF THE SKO RAILROAD RIGHT -OF - WAY AND NORTH OF EAST 76TH STREET NORTH, illilHE WEST SIDE OF THE CITY OF OW ASSO. Motion cauied 5-0. AYE: Williams, Helm, Armstrong, Brogdon, Barnhouse NAY: None Mr Ewing said that Resolution #2002-02 calls for the proposition outlined in Ordinance #699 to be placed on the March 5, 2002 Primary Election ballot. Mr Williams moved, seconded by Mr Helm, to approve Resolution #2002-02 calling for an election for the purpose of submitting to the Owasso voters Ordinance #699 for their approval or rejection. ITEM 15: 6DJOURNMENT None. Manager. as to the City Mayor Brogdon welcomed Rodney No report. ITEM 12: REPORT FROM CITY ATTORNEY. January 8,2002 Owasso City Council Mr Carr discussed both projects. The 76th St N & Highway 169 interchange project has been awarded. The contractor has been given six months to begin the project. It is anticipated that construction will begin in May and be completed in September. ODOT has requested some changes in the design of the 86th St N & Main project. Those changes should be completed next week and the plans re-submitted to ODOT. ITEM 2: DISCUSSION OF ISSUES RELATING TO THE CONSTRUCTION OF IMPROVEMENTS TO 86TH ST N, AND THE 76TH ST N & HIGHWAY 169 EXCHANGE. Mr Carr, Mr Ray, Ms Bishop and Mr Ewing briefed the Councilor the history, construction and funding of the Elm Creek Interceptor project. Status of cunent payback for the project, as well as its relationship to the Wastewater Master Plan, was also discussed. ITEM 3: DISCUSSION RELATING TO CONSTRUCTION, OPERATION AND FUNDING OF THE ELM CREEK INTERCEPTOR. Mayor Barnhouse requested that one item under the City Manager's RepOli be presented at this time. Teresa Willson of Information Systems demonstrated a program whereby Councilors will be able to receive e-mail on their personal computers through the City's web site. A quorum was declared present. RECOMMENDATION: The latest request is from VarTec Telecom lnc, Dallas, TX. The attached agreement authorizes that company to collect the E-911 service fees assessed on local access lines and remit same to the City of Owasso. The City of Owasso provides Emergency 911 service to Owasso cItlzens with specifically identified telephone prefixes. Agreements have been made with the telephone service providers that provide, in accordance with Ordinance #571, for five percent (5%) of the customer's telephone bill to be returned to the City of Owasso to aid in the support of providing this emergency communication service. Until September of 1998, Southwestern Bell Telephone was the only emergency provider for our customers. Since then several telephone providers have requested agreements with the City to provide telephone service to our citizens, and to collect the E-911 service fee assessed on local access lines and remit that fee to the City of Owasso. The City will be responsible for implementation and ongoing administration of all E- 911 data management associated with its E-911 service. The City's responsibilities include: 2. Service is provided solely for the use and benefit ofthe City and the provision of such service shall not be interpreted or construed as creating any obligation of Vartec toward, or any right of action on behalf of any third party or other legal entity. 1. As authorized by the Nine-One-One Emergency Number Act, 63 O.S. Supp 1996, Sections 2814 and 2815, as amended, and the City's ordinance Number 571, Vartec shall collect from service users and remit to the City the E-911 service fee assessed on local exchange access lines. For this service, Vartec shall retain two percent (2%) ofthe total amount collected. NOW, THEREFORE, it is mutually agreed between the parties as follows: WHEREAS, Vartec, through SWBT resale, is willing to furnish and maintain said features, subject to the terms and conditions set forth, as well as those contained in its approved tariff. Vartec shall not be liable to the City for damages alising out of errors, interruptions, defects, failures or malfunctions of E-911 Services, including but not limited to, damages arising from errors or defects of associated equipment and data processing systems. 7. While it is the intent of the City to renew this Agreement, the parties agree and understand that the City, being a political subdivision of the State of Oklahoma, cannot be bound in th~s Agreement past its current fiscal year ending June 30, 2002. Therefore, the parties agree that the contract's term shall be from the date of execution through the end of the City's current fiscal year, and that the parties upon mutual agreement may renew this Agreement at the end of the contract term for successive one year periods. In no event shall the City be obligated financially or otherwise or be subject to any penalty or damage for failure of the City to renew this Agreement. Vartec's Credit Records and Billing Records are confidential and proprietary. The City will maintain the confidentiality of these records and will establish controls to ensure this information is used only in connection with City's provision of E-911 Service. 5. The parties hereto further agree that, in the absence of any delay occasioned by events or factors which are beyond the control of Vartec, the in-service date for the services covered by this Agreement shall be as soon as possible. 4. MSAG updates will be processed by SWBT as quickly as reasonably possible after receipt of information from the City. The ALl data file will be updated as quickly as reasonably possible following completion ofthe order for service. If a Force Majeure Condition occurs, the party whose performance is affected shall notify the other party and shall resume perfonnance as soon as reasonably possible. Mr. Cates' advised that, since the processes were all done in good faith and, since no objections to the rezoning were recorded, that we could resolve this issue by processing the annexation now and, upon the ordinance for the annexation going into full effect, amend the zoning ordinance to reflect an approval date after annexation. He feels the plat and site plan processes are less affected as no legal notifications were required. We will, however, be unable to release the submitted building permit until this issue is resolved, as we are now aware of our lack of jurisdiction. It has come to my attention that the above-referenced property has not been annexed into the corporate limits of Owasso. .
