The Owasso Planning Commission has conducted a hearing on this request and
recommends Council approval of the final plat for Honey Creek at Bailey Ranch, a 62.33
acre, 202 lot subdivision located north of E 96th St N and east of N Mingo Rd. The staff
concurs with the recommendation.

a Final Plat for Honey Creek at Bailey Ranch, an Addition to the City of Owasso, Tulsa
County, State of Oklahoma (Ward 1).

Mr Ray recognized and presented certificates of appreciation to members of the Public Works
team who worked over the New Year's holiday to repair the Santa Fe Lift Station.

posted on the City Hall bulletin board at 4:00 p.m. on Friday, January 4,2002.

Mr Ewing said that the Owasso Economic Development Authority has been discussing the
institution of a hotel/motel tax, with funds derived from the tax used to encourage economic
development, cultural enhancement, and tourism. The approval of a 3% tax would provide
approximately $60,000 in annual revenue. Ordinance #699 outlines the use of the tax and the
procedures to be followed in administering the tax. Mr Williams moved, seconded by Mr
Brogdon, to approve Ordinance #699, providing for a 3% hotel/motel tax and dedicating the
revenue for such tax to promote economic development.
ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE
#699, AN ORDINANCE PROVIDING FOR A 3% HOTEL/MOTEL TAX, AND
PROVIDING FOR THE USE OF FUNDS TO BE DEDICATED TO THE
PROMOTION OF ECONOMIC DEVELOPMENT.

Ms Sorrells said that the Larkin Bailey Trust has submitted a petition to the City of Owasso for
the detachment of a 312-acre parcel of land, located north of E 76th St N and west of the SKO
Railroad, The property is zone Agriculture and is vacant and undeveloped. The detachment
petition was submitted on June 26, 2001; however, no annexation ordinance including the
subject property is recorded, All maps produced in recent years include the area in the corporate
limits of the City of Owasso. The City Attorney advised that a petition should be filed to detach
the property since it shows on city maps. The Owasso Annexation Committee and the Owasso
Planning Commission have reviewed the request and have recommended approval. Mr Helm
moved, seconded by Mr Brogdon, to approve the requested detachment of property.
ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FOR DETACHMENT OF LAND CONTAINING 312 ACRES, MORE OR LESS,
GENERALL Y LOCATED WEST OF THE SKO RAILROAD RIGHT -OF - WAY

Mr Ewing said that Resolution #2002-02 calls for the proposition outlined in Ordinance #699 to
be placed on the March 5, 2002 Primary Election ballot. Mr Williams moved, seconded by
Mr Helm, to approve Resolution #2002-02 calling for an election for the purpose of submitting
to the Owasso voters Ordinance #699 for their approval or rejection.

ITEM 12: REPORT FROM CITY ATTORNEY.

Owasso City Council
Mr Carr discussed both projects. The 76th St N & Highway 169 interchange project has been
awarded. The contractor has been given six months to begin the project. It is anticipated that
construction will begin in May and be completed in September. ODOT has requested some
changes in the design of the 86th St N & Main project. Those changes should be completed next
week and the plans re-submitted to ODOT.
ITEM 2: DISCUSSION OF ISSUES RELATING TO THE CONSTRUCTION OF
IMPROVEMENTS TO 86TH ST N, AND THE 76TH ST N & HIGHWAY 169
EXCHANGE.
Mr Carr, Mr Ray, Ms Bishop and Mr Ewing briefed the Councilor the history, construction and
funding of the Elm Creek Interceptor project. Status of cunent payback for the project, as well
as its relationship to the Wastewater Master Plan, was also discussed.
ITEM 3: DISCUSSION RELATING TO CONSTRUCTION, OPERATION AND FUNDING
OF THE ELM CREEK INTERCEPTOR.
Mayor Barnhouse requested that one item under the City Manager's RepOli be presented at this
time. Teresa Willson of Information Systems demonstrated a program whereby Councilors will
be able to receive e-mail on their personal computers through the City's web site.

ATTACHMENTS:
Staff recommends Council approval and authorization for the Mayor to execute the appropriate
documentation which allows VarTec Telecom Inc to provide service to Owasso citizens and to
collect identified E-911 fees.
RECOMMENDATION:
The latest request is from VarTec Telecom lnc, Dallas, TX. The attached agreement authorizes
that company to collect the E-911 service fees assessed on local access lines and remit same to
the City of Owasso.
The City of Owasso provides Emergency 911 service to Owasso cItlzens with specifically
identified telephone prefixes. Agreements have been made with the telephone service providers
that provide, in accordance with Ordinance #571, for five percent (5%) of the customer's
telephone bill to be returned to the City of Owasso to aid in the support of providing this
emergency communication service. Until September of 1998, Southwestern Bell Telephone was
the only emergency provider for our customers. Since then several telephone providers have
requested agreements with the City to provide telephone service to our citizens, and to collect the
E-911 service fee assessed on local access lines and remit that fee to the City of Owasso.

and providing this information to Southwestern Bell Telephone on the forms
provided by Southwestern Bell.
3. The City will be responsible for implementation and ongoing administration of all E-
911 data management associated with its E-911 service. The City's responsibilities
include:
2. Service is provided solely for the use and benefit ofthe City and the provision of such
service shall not be interpreted or construed as creating any obligation of Vartec
toward, or any right of action on behalf of any third party or other legal entity.
1. As authorized by the Nine-One-One Emergency Number Act, 63 O.S. Supp 1996,
Sections 2814 and 2815, as amended, and the City's ordinance Number 571, Vartec
shall collect from service users and remit to the City the E-911 service fee assessed
on local exchange access lines. For this service, Vartec shall retain two percent (2%)
ofthe total amount collected.
NOW, THEREFORE, it is mutually agreed between the parties as follows:
WHEREAS, Vartec, through SWBT resale, is willing to furnish and maintain said
features, subject to the terms and conditions set forth, as well as those contained in its approved
tariff.
WHEREAS, Vartec, offers its subscribers Enhanced Emergency Number (E-911) Service
through resale of Southwestern Bell Telephone (SWBT) service; with SWBT providing the
actual E-911 service including, but not limited to, the development of a Master Street Address
Guide (MSAG), selective routing, Automatic Location Identification (ALI) and the Automatic
Number Identification (ANI) services; and Vartec providing the billing and collection of E-911
assessments from the end-users; and,
WHEREAS, pursuant to its obligation to provide telecommunications services to its
subscribers within its certified areas; and,

Telecom Inc ("Varteclt), a Texas company, having its princ'pal place of business at 1600 Viceroy
Dallas, TX 75235, and the City of Owasso, Oklahoma ("City"), having its principal place
business at 111 N Main, Oklahoma 74055.

8. Vartec shall not be liable to the City for damages alising out of errors, interruptions,
defects, failures or malfunctions of E-911 Services, including but not limited to,
damages arising from errors or defects of associated equipment and data processing
systems.
7. While it is the intent of the City to renew this Agreement, the parties agree and
understand that the City, being a political subdivision of the State of Oklahoma,
cannot be bound in th~s Agreement past its current fiscal year ending June 30, 2002.
Therefore, the parties agree that the contract's term shall be from the date of execution
through the end of the City's current fiscal year, and that the parties upon mutual
agreement may renew this Agreement at the end of the contract term for successive
one year periods. In no event shall the City be bound to any such renewal until and
unless the City approves the renewal and it is executed by the authorized official of
the City. In no event shall the City be obligated financially or otherwise or be subject
to any penalty or damage for failure of the City to renew this Agreement.
Vartec's Credit Records and Billing Records are confidential and proprietary. The
City will maintain the confidentiality of these records and will establish controls to
ensure this information is used only in connection with City's provision of E-911
Service.
5. The parties hereto further agree that, in the absence of any delay occasioned by events
or factors which are beyond the control of Vartec, the in-service date for the services
covered by this Agreement shall be as soon as possible.
4. MSAG updates will be processed by SWBT as quickly as reasonably possible after
receipt of information from the City. The ALl data file will be updated as quickly as
reasonably possible following completion ofthe order for service.

9. Neither party shall be held responsible for any delay or failure in performance under
this Agreement to the extent that such delay or failure is caused by circumstances
beyond the control of such party, including without limitation, fire, flood, explosion,
war, acts of omissions of carriers and other similar conditions ("Force Majeure
Condition"). If a Force Majeure Condition occurs, the party whose performance is
affected shall notify the other party and shall resume perfonnance as soon as
reasonably possible.

(b) The City shall have the right to cancel this Agreement in the event of the
violation by Choctaw of any terms and conditions hereof upon ninety (90) days
written notice of cancellation to Vartec and failure by Vartec to cure such
violation within such period.

REQUEST:
Oklahoma Municipal Retirement Fund (OMRF), the retirement plan for non-police and
fire employees, requires the City Council acting as the OMRF Retirement Committee to
designate an authorized agent. The authorized agent is responsible for signing
documents relating to employees enrolling in the system, leaving the system, and
retiring from the system. Currently Allan Harder is the authorized agent. Due to the fact
Mr. Harder is no longer with the City, a new authorized agent must be named.

This property is contiguous to existing city limits as required by the Annexation Policy. A copy of
the Annexation Policy and Procedures are attached for you information and review.
There has, however, been some reconsideration by the City Manager and the City Attorney of
simply amending the existing ordinance rezoning the property so the schedule presented to the
applicant will be modified to reflect a full rezoning process.
A letter was sent to Mr. Doug Aldridge, Tulsa Teachers' Credit Union, explaining the issue and the
schedule of necessary processes to occur with an acknowledgement signature and return requested.
The signed letter of acknowledgement is attached for your information and review.
Since the final plat and site plan did not require legal notification and were processed in good faith,
no new action was advised.
Most of you will recognize this property as one which has been processed through the rezoning,
plat and site plan phases of development It has become apparent that the property was never
annexed into the corporate limits of the City. In an attempt to resolve this issue with minimal
inconvenience to the applicant, staffhas consulted with the City Attorney, Mr. Cates, regarding this
issue. Mr. Cates' advice was to process the annexation, then amend the ordinance rezoning the
property subsequent to the effective date of the annexation, and to request the applicant
acknowledge their understanding of the implications of the error and approve moving forward as
advised.
The Tulsa Teachers' Credit Union is requesting annexation of a 4.5 acre tract of land described as
the east four and one half (4.5) acres of the South Half of the Southwest Quarter of the Southwest
Quarter (S/2 SW/4 SW/4) of Section 17, Township 21N, Range 14E. The subject property is
located north of 96th Street N. and 1/4 mile east of N. Gmnett Road and is bound by rural
residential/agricultural property zoned AG (Agriculture) to the north, south and west, and by the

I have consulted with Mr. Ron Cates, Owasso City Attorney, regarding this issue since we have,
apparently, processed all submittals for the property without actual jurisdiction. Mr. Cates' advised that,
since the processes were all done in good faith and, since no objections to the rezoning were recorded,
that we could resolve this issue by processing the annexation now and, upon the ordinance for the
annexation going into full effect, amend the zoning ordinance to reflect an approval date after annexation.
He feels the plat and site plan processes are less affected as no legal notifications were required. We will,
however, be unable to release the submitted building permit until this issue is resolved, as we are now
aware of our lack of jurisdiction.
It has come to my attention that the above-referenced property has not been annexed into the corporate
limits of Owasso. .

RECOMMENDATIONS
The Owasso Planning Commission reviewed the request at the January 17,2002 special meeting
and unanimously recommended approval.
The request was reviewed at the December 26,2001 regular meeting ofthe Technical Advisory
Committee and no comments were generated at that time. Phil Lutz, Owasso Public Works, has
issued a letter to the applicant reflecting Public Works' and Community Development's support
for the requested amendment and requesting additional information. A copy ofthe letter of
response is attached for your information.
Originally, the 50' aCcess defined by the approved plat was shown abutting the northern
boundary of the subject property. A 125' Limit of No Access was shown south ofthe access.
The applicant is requesting to shift the access point 30' south, creating a 30' Limit of No Access
north of the drive and 95' Limit of No Access south ofthe drive. A plan showing proposed
changes to the access location is attached for your information and review.
The Exchange Bank has requested~~pproval of an amendment to the limits
of access approved as shown on the final plat of Exchange Bank - Ow as so I located at the
northeast corner ofE. 86th Street N. and N. Mingo Road. A location map is attached for your
information. The referenced final plat was approved by the Planning Commission on September

RECOMMENDATIONS
The Owasso Planning Commission reviewed the final plat at the January l7, 2002 special
meeting and unanimously recommended approval.
DEQ permits for the extension of water and sanitary sewer mains were received by Public Works
on January 9, 2001. Copies ofthe permits are attached for your review.
The proposed development is subject to a $16.001 acre siren fee, totaling $1026.72. Also, to be
assessed at the time of building permit, will be a court settlement fee of $50 per water tap. Prior
to the builder's payment for a building permit, a receipt from Washington County Rural Water
District #3 verifying payment of the referenced fee must be presented to the City of Owasso. It
is staffs understanding this developer has, in the past, chosen to pay this fee at the front end on
behalf ofthe builders. This option is available to the developer, if desired.
Public Works has reviewed and approved, pending minor modifications, the streets and drainage
for Honey Creek. Although detention will be off-site from this phase of the development,
detention will be provided for phase one.
The Owasso Technical Advisory Committee reviewed the final plat at the December 26, 2001
regular meeting. The only comments recorded were from Public Works regarding drainage.
Breisch & Associates has requested review of a final plat for Honey Creek at Bailey Ranch, a
62.33 acre, 202 lot subdivision generally described as a pOliion of the Southwest Qumier (SW/4)
of Section 18, Township 21N, Range 14E. The subject property is located north ofE. 96th Street
N. and east ofN. Mingo Road and is zoned RS-3/PUD (Residential Single-Family, High
