Stephenson City Planner CASE: OBOA 11 -03- DATE: November 29s :201 1 BACKGROUND: The City of Owasso received a request for a Variance to allow for a pole sign to be constructed that would exceed the maximum height and maximum square footage allowed by Owasso City Code. The property contains a Reasors grocery store and is part of a commercial development along E. 1 161h Street North called the Shops at Garrett Creek, located directly west of US -169. The physical address of the site is 11560 North 135th Street East. SIZE OF LOT: 13.8 acres EXISTING LAND USE: Commercial SURROUNDING LAND USE: North: Commercial, CS South: Commercial, CS East: US -169 Highway West: Residential, RS -3 and Commercial, CS PRESENT ZONING: CS (Commercial Shopping) APPROVAL PROCESS SECTION 1270 VARIANCES 1270.1 General The Board of Adjustment, upon application, and after notice (when notice is required) and public hearing, may grant variances from the terms of this code only upon a finding that the variance will not cause substantial detriment to the public good or impair the spirit, purposes and intent of this code, or the Comprehensive Plan, where by reason of exceptional narrowness, shallowness, shape, topography, or other extraordinary or exceptional situation, condition, or circumstance peculiar to a particular property, the literal enforcement of the code will result in unnecessary hardship. The Board shall not vary any jurisdictional requirements such as notice. EIMAWMR The total sign area is proposed to be approximately fifty (50) feet in height by twelve (12) feet in width, with this area including the structural poles. The actual signage is proposed at approximately thirty -six (36) feet in height and twelve (12) feet in width, or four hundred thirty two (432) square feet.--Asra pQht- cfreference, the average- �rAi s.43pproxi=teiy4ourt"n (1�) - -. —_. _--„� feet by forty -eight (48) feet, or six hundred seventy two (672) sq. ft. The City of Owasso does not allow pole signs to- be-more- than- 4hirty (30) -feet in height =and does -nat allow a =sign to- be,larger =F than 150 sq. ft. This proposed Variance would exceed the allowed height by twenty (20) feet and would exceed the allowed square footage by two hundred eighty -two (282) square feet. This proposed sign would be taller than most others sign in the City of Owasso and would be much larger as well. Signs for large developments consisting of multiple tenants have the ability to apply for a Unified Sign Permit. This application is reviewed by the Planning Commission and can offer variation to the sign code for larger unit designs. This type of application has been used for larger signs in multi- tenant developments such as those for Smith Farms and the new Tulsa Technology Center. A Unified Sign Plan appears to be a viable alternative for the applicants. Any Variance to City Code has to meet certain criteria in order to be approved. Section 1880 of the Owasso Zoning Code reads: 1880 SIGN VARIANCES. The City of Owasso Board df Adjustment may grant a variance to the requirements of this Code only if the applicant demonstrates compliance with the following criteria: (1) That the variance is necessary due to extraordinary or peculiar circumstances related to the size, shape, topography, or location of the subject property. (2) That the extraordinary or exceptional conditions of the subject property are not a direct result of the actions of the applicant. (3j That the variance as granted represents the least deviation from the prescribed regulations necessary to accomplish the purpose for which the variance is sought and which is consistent with stated intent of this Code. (4) That the granting of the variance shall result in greater convenience to the public in identifying the business location for which a sign code variance is sought. (5) That the granting of the variance will not be detrimental to the public welfare, will not constitute a public nuisance or adversely affect public safety. (6) That the granting of the variance will not interfere with the location and identification of adjacent businesses, buildings or activities. After reviewing the criteria, staff has made the following findings for each of the listed criteria: 1. The variance does not appear to be warranted due to any special circumstances on the property. The area is highly visible from the elevated US -169 highway and signage that meets City Code would appear to be acceptable to meet the applicant's needs. 2. There do not appear to be any special circumstances on the property and there does not appear to be any condition that is a result of actions by the applicant. 3. If the Variance were to be granted, the proposed sign does not appear to be the minimum available variance to City Code. The proposed sign is twenty (20) feet higher than allowed by Code and nearly three (3) times the allowable sign size. Additionally, there is a city process (Unified Sign Plan) that the applicant could use to accomplish some of the desired variances. 4. The location of the property appears to be quite visible as it is situated below the US -169 highway and is located close to the roadway of E. 1161h Street North. A sign that meets City Code at thirty (30) feet tall and one hundred fifty (150) square feet appears to be sufficient for visibility in this area. 5. If the Variance were to be granted it could be seen as a nuisance due to its proposed height and size. Residential properties would have to see the sign and its illumination. 6. The variance proposal does not appear to interfere with the location identification of adjacent businesses, buildings or activities. A variance of this nature is not warranted and would set a very dangerous precedent on the Owasso community. Letters were mailed to all property owners within three - hundred (300) feet of the subject property and the request was advertised in the Owasso Reporter. Staff received no objections concerning OBOA 11 -03. RECOMMENDATION: Staff recommends denial of OBOA -11 -03 ATTACHMENTS: 1. General Area Map 2. Sign Drawings 3. Site Plan 4.
