10. Consideration and Appropriate Action Relating to a Contract for Administrative Services
Between the City of Owasso and INCOG.

11. Consideration and Appropriate Action Relating to a Request for Additional Funds for the
86"' Street North and Main Street Intersection Project.

The staff will recommend City Council approval for payment of the invoiced amount of
$39,16175 in additional local funds to the Oklahoma Department of Transportation as a
result of revised construction costs.
12. Consideration and Appropriate Action Relating to a Request to Declare Certain Mowing
Equipment Surplus to the Needs of the City, Set a Minimum Value for Each Piece of
Equipment, and Authorize Staff to Proceed With an E-Bay Auction of the Equipment.

The staff will request that the City Council declare the equipment listed in the attached
memorandum as surplus to the needs of the City, set a minimum value for same, and
authorize staff to auction the equipment on E-Bay.
The staff will recommend City Council approval of the Real Estate Purchase Contract and
request authorization for the Mayor to execute the contract.

14. Consideration and Appropriate Action Relating to CZ- 02 -06, a Request to Rezone Lot 1,
Block 1, hillside Estates, Located at the Southwest Corner of East 116}' Street North and
North Mingo road, from CAL (Office Light) to CS (Shopping Center).

Council approval to rezone the property from CAL, to CS. The staff" concurs with that
recommendation.
15. Consideration and Appropriate Action Relating to a Request for City Council Approval of
a plat Amendment for The Willows of Silver Creek, an Addition to the City of Owasso,
Tulsa County, State of Oklahoma.

recommends Council approval of the amendment to the plat for The Willows of Silver
Creek, amending the building setback lines on Lot 11, Block 5, as presented within the
"Amendment to Deed of Dedication ". The staff concurs with the recommendation.

16. Consideration and Appropriate Action Relating to a Request for City Council Approval of
a Final Plat for First United Methodist Church, an Addition to the City of Owasso, Tulsa
County, State of Oklahoma.

'The Owasso Planning Commission has conducted a hearing on this request and
recommends Council approval of the final plat for First United Methodist Church, an
11.86 -acre, one-lot subdivision located on the south side of E 106"' St N, between N 1291h
East Ave and N 145"' East Ave. The staff concurs with the recommendation.
17. Consideration and Appropriate Action Relating to an Amendment to the Owasso Zoning
Code.

The Owasso Planning Commission has conducted a hearing on this request and
recommends Council approval of a text amendment to the Owasso Zoning Code, Section
610, to permit mini-storage units in CS, CG, and CH Zoning Districts by Special Exception
only on all future CS, CG, and CH-zoned property, with currently zoned commercial
property exempt for two years from the date of publication of the ordinance.

ITEM I: REPORT FROM CITY MANAGER
Police Chief Jim Greene introduced the new Deputy Police Chief, Dan Yancey, and Mr Ray
introduced the new Deputy Fire Chief, Lonny Fisher, Mr Ray also introduced Roger Moss, and
thanked him for volunteering to assist with emergency preparedness. He also introduced Vice
Mayor Helm's daughters.
ITEM 8: REPORT FROM CII'Y ATTORNEY.
No report.
ITEM 9: REPORT FROM CITY COUNCILORS.
Council Kimball reported that over $27,000 was raised for cancer research at Relay for Life. She
thanked the City for participating with a team. Mayor Brogdon invited those present to remain
after the meeting for a reception honoring Mr Yancey and Mr Fisher, as well as all the new
appointees. He thanked Marcia Boutwell and Jan Worley for preparing the reception.

Chief Allen discussed a request to purchase an EMS technologies system that would include both
hardware and software for the storing of patient information for easy retrieval. Although the cost
for the purchase will be slightly less than the recently enacted spending limit, Council requested
that the item be placed on an agenda for approval.

ITEM 6: DISCUSSION RELATE-4G TO PARKS & COMMUNITY DEVELOPMENT
ISS'LES.
Mr Rooney discussed a proposed agreement for the acquisition of Preston Lakes Centennial
Park, mowing equipment that is no longer useful to the City and needs to be surplused and sold,
and a proposed text amendment to the Zoning Code relating to mini-storage units in
commercially zoned areas. He also discussed several planning items that will be coming to the
council.
Mr Ray reported and discussed several items of interest.

Several meetings were held and, eventually, the initial concept evolved into what all parties
agreed was a workable framework for a regional economic development effort.
Under the proposed concept, the cities, the Tulsa Chamber and PSO would join forces to develop
a "consortium" for economic development. PSO and the five cities would each contribute
$25,000 in cash to fund the operations of the consortium, while the Tulsa Chamber would
provide a minimum of $25,000 in matching services, such as space, equipment and supervision.
Working together, the consortium members would select an economic development specialist to
serve the group. That person would serve under the direction of Mr Mickey Thompson, the
Tulsa Chamber's Economic Development Manager, but would focus on the priorities of the

This request is two -fold:

Fund to the OEDA Fund, such transfer for the purpose of funding the Regional Economic
Development Consortium's "Agreement for Economic Development Services ".
2° Dart two of this request is for Council approval of a request for a "carry -over" appropriation
of $25,000 from the FY 2001-2002 budget to the FY 2002 -2003 budget, such appropriation
to the General Fund's "Transfers Out" to the OE A.
The OEDA Trustees and the staff recommend City Council approval of 1) a supplemental carry-
over appropriation in the amount of $25,000 to the FY 2002-2003 General Fund Budget
(Transfers Out); and 2) a transfer of $25,000 from the General Fund's FY 2002-2003 budget to
the 'D Fund.

This Agreement is entered into by and among the City of Bixby ("Bixby"), the Jenks
Public Works Authority ("JPWA"), the Owasso Economic Development Authority ("OEDA"),
the Rogers County Industrial Development Authority ("RCIDA"), and the Sand Springs
Economic Development Authority ("SSEDA") and the Metropolitan Tulsa Chamber of
Commerce, Inc. ("Chamber
�NHERLAS, among other things the Chamber coordinates and promotes business
activities in the greater Tulsa area;
WHEREAS, the Chamber is frequently contacted by existing and prospective businesses
with and for economic development information;
WHEREAS, the Chamber is able to provide professional economic development services
and written data relating to a variety of economic development matters beneficial to the other
parties to this Agreement; and
WHEREAS, the parties agree that it is in their mutual interest for the Chamber to employ
a full-time professional economic development staff member acceptable to the parties to this
Agreement to provide services to the parties focusing on industrial and office building economic
development;
NOW, THEREFORE, the parties agree as follows:
1. Each of the parties (other than the Chamber) agree to pay the Chamber a fee of
$25,000 annually, to be paid the first six months in advance and then quarterly upon billing to
such parties. Fees in excess of the base fee shall not be assessed without the prior written
authorization for additional services by the party requesting such services. Any additional
staffing or support requirements beyond the base level shall be assessed on a per capita basis as
may be approved by the other parties and the parent entity of each such party.
2. The Chamber will provide in-kind services equal to or greater than $25,000 in
value annually, including but not limited to office space, secretarial assistance, ordinary travel,
management supervision, and other ordinary expenses in support of the dedicated professional
position.
3. The parties understand that certain grants and donations from public and private
organizations and businesses in support of this Agreement may be received from time to time
from entities whose objects are not in conflict with the purposes and legal requirements of the
Chamber and the other parties to this Agreement.
4. Any party may withdraw from this Agreement upon six months notice. The
Chamber reserves the right to terminate this Agreement completely if any other party exercises
its right to withdraw upon the aforesaid notice.

providing services to one or more but less than all of the other parties so that the benefits of this

The 86t}' Street North and Mingo Street Intersection Improvement project was included in the
1998 Bond to improve the intersection. The project has been submitted to the Oklahoma
Department of Transportation (ODOT) for future partial reimbursement by federal funding
under the Local Government Program.
The design engineer provided an engineering construction cost estimate for these
improvements of $545,578. Additional relocation costs for gas and waterlines are estimated to
be $174,028. The total project cost estimate is therefore $720,000, ODOT may provide up to
$484,729 of reimbursement funds.
Final plans have been submitted to ODOT for review. The ODOT Right-Of-Way (ROW)
division has given approval for the City to start acquiring ROW after the Right-of-Way,
Public Utility and Encroachment Agreement with ODOT has been executed.

The Agreement outlines all responsibilities of the City and of ODOT with regards to the ROW
before, during, and after construction.
In Regards to the project ROW, the Agreement states that the City will:
• grant right of access to ODOT and its contractors,
• remove all encroachments,
• prohibit parking,
• comply with driveway standards,
• maintain all ROW, and
• be responsible for relocating all utilities.
Other provisions state that the City will regulate traffic and maintain the traffic control signals.
A Resolution providing for the execution of the agreement is attached.

hereinafter called the Department, in connection with the location and improvement of a portion of
the City Street System within the corporate limits of the City, now designated as E. 36" street and

Witnesseth:
WHEREAS, it is mutually agreed between the parties that certain improvements should be
made to the highway now as follows:
That the Department proposes construction of Intersection Modifications and Traffic Signals
at the Intersection of E. 661" street and Mingo Load.
WHEREAS, legislative authorization and the rules, regulations, and policies of the
Department provide the basis of cooperation between the parties to effect such highway
improvements.
NOW, THEREFORE, the parties hereto agree as follows:
To the location of said highway, acknowledges receipt of and adopts the plans for
said project as the official high lighting, sign lighting, grade and drainage plans of
the City for the streets, boulevards, or arterial highway included therein.
2. That prior to the advertising of the project for bids (as to that part of the project lying
within the present corporate limits) it,will:
(a) Grant to the Department and its contractors, the right-of-entry to all streets,
alleys, and other rights-of-way shown on said plans,
(b) Remove at its own expense, or cause the removal of, all encroachments on
existing streets as shown on said plans, including all signs, buildings,
porches, fences, gasoline pumps and islands, and any other such private
installations.
(c) Prohibit parking on that portion of the project within the corporate limits of
the City.

The City of Owasso has received a Community Development Block Grant (CDBG) in the
amount of $67,132 from the Oklahoma Department of Commerce Small Cities Set-aside. the
grant for FY2001-2002 is for construction of sidewalks, handicap ramps and street overlays in
an area generally bounded on the south by 5th Avenue, cast by U.S. Highway 169, north by E.
86th Street North and west by the SK&O Railroad.
The Indian Nations Council of Governments (INCOG) has provided administrative services
for previous CDBG grants awarded to the City of Owasso. Attached is an agreement for
services for the present award.
The attached agreement has been prepared in order to expedite completion of the project grant.
Involvement by INCOG in the past has provided the expertise necessary to ensure meeting
CDBG requirements.
Administrative services to be provided by INCOG include the following:
- Assisting the City in grant documentation
- Conduct of public hearings
- Processing requests for payment
- Close-out of the project.
The cost for services is proposed to be an amount not to exceed $4,000.00.

If any provision under this contract or its application to any person or
circumstance is held invalid by any court of competent jurisdiction, such
invalidity does not affect any other provision of this contract or its
application that can be given effect without the invalid provision or
application.
a. INCOG represents that it has, or will secure at its own
expense, all personnel required in performing the services
under this contract. Such personnel shall not be employees
of or have any contractual relationship with the CITY.

TERMINA TION OF CONTRACT FOR CA USE
Not withstanding the above, INCOG shall not be relieved of any liability
to the CITY for damages sustained by the CITY by virtue of any breach of
the contract by INCOG, and the CITY may withhold any payments to
INCOG until such time as the exact amount of damages due the CITY
from INCOG is determined.

The CITY may terminate this contract at any time by giving at least 30
days notice in writing to INCOG. If the contract is terminated by the
CITY as provided herein, INCOG will be paid for the time provided and
all allowable expenses incurred up to the termination date.
No member of the governing body of the CITY, and no other officer,
employee, or agent of the CITY, who exercises any functions or
responsibilities in connection with the planning and carrying out of the
program, shall have any personal financial interest, direct or indirect, in

this agreement, and INCOG shall take appropriate steps to assure
compliance.

COG, at such tunes and in such forms as the CITY may require, shall
furnish the CITY such periodic reports as it may request pertaining to the
work or services undertaken pursuant to the contract, the costs and
obligations incurred or to be incurred in connection therewith and any
other matters covered by this contract.
INCOG shall furnish the CITY narrative reports and financial reports
related to the elements of this contract in the fonn and at such times as
may be required by the CI`IY or federal and state grantor agencies.

BACKGROUND:
A "low end" construction cost estimate based on recent bid prices was prepared by ODOT as
part of a revised Agreement with ODOT approved in May 2002. The estimate for the
construction contract was $1,452,625, which was $347,335 less than the previous estimate. At
that time, the City of Owasso portion of costs was $546,250, which has subsequently been
paid to ODOT prior to bidding the project.
By approving the revision, it was agreed that ODOT would collect any shortage of local funds
after the project is bid. Bids were opened on June 20, 2002 and the Transportation
Commission awarded the project to the low bidder, Horizon Construction Company, in the
amount of $1,465,465.65 on July 1, 2002. Additionally, ODOT administrative and inspection
costs are $122,005.37, resulting in a total project cost of $1,587,471.02. As a result, the city is
responsible for an additional amount of $39,163.75. An invoice for this amount is attached.
When these funds are receive eased.
Work is expected to begin in September 2002. A 240 calendar day construction period is
included in the contract; therefore, completion is expected in May 2003. Upon project closure,
the City will be billed for any overruns encountered during construction or excess fluids will
be returned to the City.

Typically, when the City of Owasso declares items surplus, an approximate worth for the individual items
is submitted to the City Council along with the list for approval. Staff has reviewed the condition of the
equipment contained within the list, as well as auction history. The following are minimum values that
have been determined for each item:
Please note that the equipment actually has no value to our organization and are actually more expensive to
keep.
If the Council approves the minimum values established, the next step in the process would be for the City
to schedule a public auction, usually on a Saturday, in order to get rid of the surplus items. This usually
involves a considerable amount of time, effort, and expense... often times to net very little profit.
E-BAY AUCTIONS:
As you are aware, the City has been auctioning surplus vehicles on e-bay. At this time, a total of five
vehicles have been auctioned to the public, with buyers coming from as far away as Connecticut and
Nebraska. Staff feels this method of auctioning surplus items has been successful, and has resulted in the
City receiving more money for these items than if we had a local auction.
It is the opinion of staff that moving forward with an E-bay auction is the best manner in which to auction
off this equipment by opening up the auction to a wider audience. It is also viewed as the most cost
effective.
RECOMMENDATION:
Staff recommends Council approval of the following vehicles as being surplus to the City of Owasso and
establishes the accompanying amounts as minimum value amounts to be utilized for E-bay Auctioning:

PAYMENT SCHEDULE:
The proposed agreement between the City of Owasso and Preston Lakes, LLC establishes the total
cost of all improvements at $323,500. The city would pay the $323,500 in two payments, with
$150,000 being paid to the developers upon completion of the improvements and the remaining
$173,500 would be paid on July 1, 2003.
The proposal, if approved by the City Council, would provide Owasso residents with a new regional
park with the longest walking trails outside of the River Parks park system. The following items
would also be addressed:

permits be multi - family, duplex or single-family in nature), shall be subject to such Park Development
Fees. The estimated Six Hundred Sixty-Eight (668) single family residential and duplex building
permits in the Preston Lakes P.U.D. will contain such Park Development Fees in the amount of One
Hundred Fifty Dollars and Ito /100 ($150.00) each and the estimated Two hundred Twenty (220) multi-
family building permits to be issued in the Preston Lakes P.U.D. shall also be subject to a Park
Development Fee. It is neither intended nor shall Seller consider any other source of payment,
especially sales tax or general ad valorem taxes, except from the Park Development Fees. This is a
special limited source obligation intended to be in compliance with the provisions of Oklahoma
Constitution, Article 10, Section 26.
The Buyer shall pay no more and no less than the purchase price set forth above regardless of any cost
overruns or cost savings that the Seller may experience as a result of constructing the improvements
described above.

MAIMETABILITY OF TITLE
Seller shall furnish Buyer title evidence covering the Property, which shows marketable title vested in
Seller according to the title standards adopted by the Oklahoma Bar association.
(a) Such title evidence shall be in the forin of. (check one) — Commitment for Owner's Title
Insurance Policy, or _ Abstract of Title.
b) Seller shall make Seller's existing title evidence (base abstract of title or Owner's `.Title Insurance
:policy) available to the escrow closing agent within a reasonable time after the date of acceptance of this
Contract.
(c) When title evidence in the form of a Commitment for Owner's Title Insurance policy is furnished, the
cost of such policy and a loan survey shall be paid 50% by Seller and 50% by Buyer. Seller shall pay any
abstracting costs in excess of the title insurer's average abstracting cost. Such Owner's Title Insurance
Policy shall insure Buyer to the extent of the total purchase price. When a survey satisfactory to the title
insurer is furnished showing no encroachment and/or boundary disputes, such policies shall provide
usual encroachment coverage. in the event the survey discloses any encroachsnent(s) and/or boundary
dispute(s), such policies shall provide encroachment coverage with exception(s) for matters disclosed by
such survey which exception(s) shall be subject to acceptance by Buyer in writing.
(d) When title evidence in the form of an abstract of title is furnished, then a duly certified abstract of
title (including current Uniform Commercial Code Certification) shall be provided at Seller's expense
and Buyer shall, at Buyer's expense, obtain either a title opinion or an Owner's Title Insurance Policy.
(e) Upon delivery to Buyer of a current Commitment for Owner's Title Insurance Policy or the abstract,
certified to date, as the case may be, Buyer shall have a reasonable time, not to exceed 10 days, to
examine the same and return the same to Seller with any written objections concerning the marketability
of the title or such right to object shall be deemed waived. Seller shall have 60 days from such notice of
objection to correct such defects, unless such time is further extended by written agreement of the
parties.

This transaction_ shall be closed on or within thirty (30) days after completion of the improvements
by Seller's delivery to Buyer a General Warranty Deed to the park land and improvements set forth
on Exhibit ` X' hereto duly executed and in recordable form as well as any Bills of Sale or Warranty
relating to equipment installed on the park land as well as the Buyer's payment unto the Seller of the
One Hundred Fifty Thousand Dollars and No /100 ($150,000.00) provided for above. The provisions
relating to payment of installments shall survive the closing and shall to the extent as provided for
herein, constitute a continuing contractual obligation.

SPECIAL CONDITIONS
It is intended by the Seller that this park be a "passive -use" park and is not to be used by the City or by
organized leagues for use as athletic fields for baseball, softball, soccer, etc. However, it does not violate
Seller's intent of such "passive uses" to allow construction, at a later date, by the City of a basketball
court or a sand volleyball court. It is hoped that this park will be primarily used by all Owasso citizens
for uses such as hiking, strolling, nature walking, bicycling, jogging, kite - flying and picnicking. The
vision is for the playground equipment to emphasize a friendly, relaxed atmosphere where all age groups
can enjoy the outdoors.

As mentioned earlier, while the applicant requested IL (Light Industrial) zoning, staff recommended
the reduced intensity of CS (Commercial Shopping Center). The Planning Commission unanimously
approved the reduced intensity of CS zoning on the subject property at their July 8, 2002 regular
meeting. If the request is approved by the City Council, an ordinance would be presented at the
August 6, 2002 City Council meeting formally adopting the approval.

BACKGROUND:
APPLICANT AND STATUS OF APPLICANT: Randall Loescher, applicant and purchaser of
the subject property,
REQUESTED ACTION AND PURPOSE. A request to rezone the subject property from OL
(Office Light) to IL (Light Industrial) in order to allow for industrial/commercial use, more
specifically, the use of mini-storage units.
LOCATION AND SIZE- The subject property is located at the southwest corner of E. 116"'
Street North and Mingo Road. The subject property contains approximately 111,375 square feet,
or 2.55 acres, more or less. The legal description of the subject property is Lot 1, Block 1,
Hillside Estates. A location map is attached for your information and review.
EXISTING LAND USE: The subject property is currently undeveloped.
APPLICABLE REGULATIONS. The Zoning Code for the City of Owasso, Chapter 15
"Amendments" and Chapter 7 "Industrial Land Uses".
SITE INFORMATION: No unusual development hardships are noted.
SITE HISTORY: OZ-98-10 - In August of 1998, a request to rezone the subject property from
AG (Agriculture) to CS (Commercial Shopping Center) was heard by the Owasso Planning
Commission. There was considerable public opposition to the request. The application was
amended for a rezoning to OL (Office Light) instead of CS (Commercial Shopping Center) and the
request was unanimously approved. In the last three years, there have been numerous rezoning
requests within a one mile radius, all of which seem to generate a large turn out.
At the time of application, the applicant was informed of the City of Owasso's intent to amend the
zoning code to require mini-storage units to obtain a Special Exception in all levels of Commercial
zoning (CS, CG, and CH) and thus the applicant request IL (Light Industrial) zoning. When
considering this case, the Planning Commission can consider a "down zoning" to any Commercial
classification if it feels it is appropriate.
Industrial zoning of any nature is not appropriate at this location. Not only would it be spot zoning
and zoning that is not consistent with any patterns in the immediate area, but it would also be in
conflict with the 2010 Master Plan. Industrial zoning is typically found adjacent to railways, along
highways and service roads, and the zoning of the subject property to any classification would be
unwise.
As mentioned earlier in the report, however, staff believes the applicant just wants to obtain the
ability to have mini-storage units on the subject property, and thus applied for IL zoning believing
it would not be permitted by right in any commercial district. A rezoning of the subject property,
specifically to CS (Commercial Shopping Center), would be appropriate in staffs opinion.
Approximately 90 % of all commercial uses are permitted in the CS zoning classification either by
right or by Special Exception. CS is the lowest intensity of the three commercial zoning
classifications, and allows for a public input process on those uses that are permitted by Special
Exception. This allows for a public input process on any use which may be viewed as
objectionable by area residents. Uses such as automotive and allied services, mini-storage units,
and multi-family dwellings would all fall into this category.
While the applicant is requesting a zoning to permit mini-storage units outright, staff feels
commercial zoning other than a CS (Commercial Shopping Center) zoning would also be
inappropriate. Staff reviewed the zoning of property at every arterial intersection in Owasso.
Arterial streets would be Mingo, Garnett, N. 129' E. Avenue, N. 145' E. Avenue, E. 76' Street
North, E. 86' Street North, E. 96`h Street North, E. 106`" Street North, and E. 116"' Street North.

Clearly, the zoning patterns when two arterial streets intersect is for CS (Commercial Shopping
Center) . The subject property is the only property in the City of Owasso with an OL (Office
Light) designation on an arterial street. It has been zoned in such a fashion for 4 years, and no
development has occurred. It would appear that the need for OL, zoning at this location is minimal
and it would appear that CS would be most appropriate of all options.
Staff recommends denial of the rezoning request from OL (Office Light) to IL (Light Industrial),
but recommends approval of the rezoning from OL (Office Light) to CS (Commercial Shopping
Center)..

The City of Owasso has received a request from Closings of Tulsa to amend a building line on a
lot located within the previously approved Willows of Silver Creek Addition. More specifically,
to amend the building lines shown on Lot 11, Block 5 of the Willows of Silver Creek.
As a requirement for amending a plat, the applicant must supply the City of Owasso with d-co
signatures of all property owners within the addition endorsing the approval of the proposed
amendment. Staff has received a copy of those signatures and they are attached for your
information and review.
The plat amendment was reviewed by the Technical Advisory Committee at their June 26, 2002
regular meeting. At that meeting, utility companies and city departments are afforded an
opportunity to comment on the proposed amendment and site any concerns regarding the request.
No opposing comments were received by planning staff.
Staff recommends Council approval of an amendment to the building lines as presented within the
"Amendment to Deed of Dedication of the Willows of Silver Creek."

Staff proposes a change in the existing Zoning Code that is two-fold. The first change, which
would occur on all future zoned or rezoned commercial property, would permit mini-storage
units in CS, CG, and CH districts by Special Exception only. The second change, would allow a
2 year window on all property that is currently zoned commercial for the current regulations to

apply. In short, the Special Exception requirement would not go into effect on all property that
is currently zoned CC or CH until 2 years from the date of publication of the ordinance.
The proposed amendment, in a slightly different form, was reviewed by the Owasso Planning
Commission at its regular meeting on June 10, 2002 and was unanimously recommended for
approval. If the proposed amendment is approved by the City Council, an Ordinance will be
presented to the City Council at its August 6, 2002 regular meeting to formally adopt the
amendment,
RECOMMENDATION:
Staff recommends Council approval of a text amendment to the Owasso Zoning Code, Section.
610 to permit mini-storage units in CS, CCU, and CH Districts by Special Exception on all future
CS, CG, or CH zoned property while all existing commercially zoned property would not have
to adhere to this requirement for two additional years.
