recommended Council approval of OPUD-02-01 on property located at the southwest
corner of E 96th St Nand N Garnett Road, subject to the conditions imposed. The staff
concurs with that recommendation.

Council Approval of a Planned Unit Development.

January 1 the Planning Commission denied a request to rezone a
portion of the Railroad propeliy located immediately west of the Public Works
facility, from IL (Industrial Light) to IM (Industrial Medium). The staff will recommend
that the City Council uphold the decision of the Planning Commission.

The staff has completed the bidding process, and will open bids on March 18, 2002 for
asp halting existing paths between ball fields and in the bleacher areas at the Sports Park, as
well as the road to the Parks Department building and the Parks building parking lot. A
recommendation will be made at the City Council meeting for the award ofthe bid.

Ms Souells said that Gauett Creek Development Company has requested annexation of
approximately 126.05 acres located south of E 116th St N between N 129th East Ave and U.S.
Highway 169. The property is zone AG (Agriculture) and that zoning will remain upon
annexation. The property can be served by sanitary sewer from both the east and west. Rural
Water District #3, Washington County, will provide water service. The applicant plans to
develop both residential and commercial subdivisions on the propeliy. The Technical AdvisOlY
Committee, Annexation Committee, and Planning Commission have all reviewed the requested
annexation and recommended approval. Ms Armstrong moved, seconded by Mr Brogdon, to
approve the annexation.

Owasso City Council
Mr Can discussed a proposed action plan for expansion of the water master plan. Items included
analysis of a regional water supply and treatment facility and initiation of the design of system
improvements for a pump station, transmission main and elevated water tank. He also discussed
an update to the wastewater master plan to be done in four phases.
ITEM 3: DISCUSSION RELATING TO PUBLIC WORKS ISSUES.

Mr Ewing discussed briefly a request for the City Council to hear an appeal of a zoning case that
was denied by the Planning Commission. The appeal will be on the regular City Council agenda
on March 19th for action.
ITEM 2: DISCUSSION RELATING TO THE SKO ZONING APPEAL.
Mr Melvin Koleber & Mr Jim East, representing Atkins Benham engineering filID, presented a
concept for entering into an agreement with area communities and nlral water districts for a
regional water treatment plant. Discussions will continue.

The Owasso City Council met in special session on Tuesday, March 1 2002 in the Main
Conference Room at Owasso City Hall per the Notice of Public Meeting and Agenda posted on
the City Hall bulletin board at 2:30 p.m. on Friday, March 8, 2002, and the Addendum to Agenda
posted on the City Hall bulletin board at on Monday, March 11,2002.

Mr Ray said that a claim for pre-election expenses was received from the Tulsa County Election
Board too late to be processed for the March 5th regular City Council meeting. The Election
Board must receive the expense check no later than March 18th. Although we do not like to
place action items on a Work Session agenda, it is necessary in order to meet the Election Board
deadline. Mr Williams moved, seconded by Ms Armstrong to approve the claim and authorize
payment to the Tulsa County Election Board in the amount of $1243.09 for pre-election
expenses.
ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FOR APPROVAL OF A CLAIM.
Mayor Barnhouse said that there is a vacancy on the Sales Tax Watchdog Committee created
when a member resigned. That vacancy is a senior citizen slot. She is proposing that Mr Bob
Barnes be appointed to the committee, and that item will be placed on the March 19th agenda for
confirmation.

ITEM 6:
Mr Rooney said that bids have been received and opened to provide bleacher covers for Fields 8,
9, 10, & 11 at the Sports Park. Two bids were received, with one being a local vendor.
Although the local vendor's bid was slightly higher than the other, the amount is not significant
& staff will be recommending awarding the bid to the local vendor. Bids for asphalting some of
the walkways and the road to the Parks Depariment building, as well as the building parking lot,
will be opened on March 18th. Those bids will be reviewed and an item is being placed on the
March 19th agenda to award that bid and the bid for bleacher covers.
Ray discussed a proposed agreement between the Owasso Public Works Authority and
Coffee Creek Residential Group for a payback agreement related to the Tech Center
Interceptor. This item will be on the 19th meeting agenda for action.

Staff recommends Council acceptance ofthe Owasso Medical Center water and sanitary sewer
systems.
RECOMMENDATION:
The contractor has provided one-year maintenance bonds for the water and sanitary sewer systems
(see attached).
A final inspection on the sanitary sewer was done in May 2001 and a final inspection on the water
system was done in June 2001. All defects discovered during the inspections have been corrected.
Acceptance has been delayed awaiting the maintenance bonds from the construction contractor.
FINAL INSPECTION:
The subject project is located on 86th Street Norih about ;;z-mile east of 129th East Avenue (see
attached location map). The systems consist of 586 Linear feet of 8-inch water line, 86 linear feet of
6-inch water line and 80 linear feet of 8-inch sanitary sewer line. Designs were reviewed and
approved by the Public Works Depmiment and permitted by the Oklahoma Department of
Environmental Quality (see attached permit letters). Construction inspection was conducted by the
Public Works Department.

On January 31, 2002, letters were mailed to all contractors awarded bids in 2001 requesting that
they execute a Contract Extension Agreement (enclosed with the letter) ifthey were interested in
mowing the same property in 2002. Three (3) contractors representing seven (7) of the ten (10)
contracts responded by executing the agreement. The remaining contracts (U.S. Highway 169
"The contractor awarded this bid in 2001 will be given the option of mowing the
same property during the 2002 mowing season at the 2001 bid price. The
contractor will be contacted by the City early in 2002 and will be required to
execute a new contract ifhe wishes to mow the property in 2002. If the contractor
does not choose to extend his contract in 2002, the property will again be bid. "
In March 2001, the City Council awarded ten (10) contracts for mowing of City properties
during the year 2001 mowing season. Item six under "General Conditions" in the bid
specifications states:
Staff evaluation of the program indicates that it continues to be cost-effective. We have
continued to make progress on other projects (i.e., street repair and maintenance, drainage ditch
renovation and small construction projects). The use of these private sector contracts has
continued to provide the citizens of Owasso with a more efficient delivery of services. The use of
full-time employees to perform seasonal mowing is reduced, allowing for more efficient
response to the needs of both the Streets Division and Parks Department.
For the past twelve years, the City of Owasso has utilized private sector contracts for providing
mowing services in specified areas. The program was developed to reduce seasonal workload so
City crews can attend to other routine maintenance programs that must be performed during the
spring, summer and fall.

The 2002 mowing costs for the easements, medians and right-of-way had an increase of $156.00
to $2,575.95 per mowing. The easements and right-of-way properties require a total of six (6)
mowings each season. The medians, frontage and intersections are mowed more frequently,
The 2002 mowing costs for the parks had a slight increase of $80.00 to $658.95 per mowing
from the 2001 costs. This increase reflects the addition of a contract for mowing McCarty Park
during the 2002 season. The parks require a total of eighteen (18) mowings each season.
Therefore, the total cost for the season is calculated to be $11,861.10.
The low bid for the U.S. Highway 169 Right-of-Way was submitted by Brush Hog Services,
Tulsa, OK at $1,850.00 per mowing. Brush Hog Services has previous mowing experience with
the City and has performed satisfactorily. The low bidder for McCarty Park, Three Lakes
Drainage Easement and Lakeridge Drainage Easement is Lee Bartel, Owasso, OK. Since we
have had no previous experience with this contractor, professional and/or personal references
were requested to verify work history and qualifications. Based on findings, staff believes that
Lee Bartel is capable of performing the work.

picnic tables, and fences; and steep hills and slopes. It is the intent of the City to have the
"mowing contractor" mow as close to all structures, fences, fence corners, trees, and drainage

I tell you this only to say I have carefully evaluated each of the said properties, having
walked each one and measured a lot of it. There is no question in my mind the ability to
perform at the highest level for the city of Owasso.
! grew up on a farm and have been driving tractor since I can remember. I have logged
thousands of hours on farm equipment, including large 4 wheel drives with 60'
implements.
Since I have not done lawn service in Oklahoma before, I cannot provide previous
account names. However I can provide good character references and I can provide
the name of a person from the non-profit ministry in which I oversaw the facility and
property. The facility that I managed was over 150,000 square feet of buildings and
over 600 acres of property of which we actively landscaped and maintained
approximately 45 - 50 acres of.
Because I have lower overhead I am not charging a high rate to mow. While this has a
two fold purpose, first, to teach my son how to do a high quality job and good work
ethic, it also, secondly, provides me hopefully a way in to the job market and a way to
build good references for future bidding.
I believe the purpose of your asking for is use my bids were in
considerably lower than the next bid. I mentioned to you at the end the
meeting on Monday, I am a local man that is desiring to start a lawn mowing
business along with my son. I live in my children attend school here, my
family goes to church here, I buy my groceries here, I bought my lawn equipment here,
! have my car fixed here, I bank here, in other words, my money by enlarge stays in
Owasso.

The staff supports the Planning Commission's recommendation of denial and
recommends the City Council deny this appeal.
RECOMMENDATION:
Pursuant to the receipt of the appeal hearing request, the item has been set for
consideration by the City Council on March 19,2002. The City Clerk's notification letter
is attached. Notices of this hearing have been sent to adjacent property owners as well as
those who signed in at the Planning Commission meeting. No new materials have been
received fi'om W ATCO for inclusion in this the packet.
The Planning Commission' recommendation of denial was based on their concern of
having the proposed heavy industrial use at the 76th ST. "Gateway" to the City. This is
one of two "Gateways" identified in the recently adopted "Downtown District land Use
Plan. This plan also identifies the site as Light Industrial/City Services/Warehousing.
The Plan also promotes "Parks/Open Space/Trails along both sides of 76th Street in this
area. These combined elements are recommended in an effort to reduce the visual impact
of industrial activities at this approach lothe City. The Planning Commissionwas also
concerned about the impact of noise on the residential uses east of the railroad tracks.
This is an appeal by WATCO, Inc, to the Owasso Planning Commission's
recommendation of denial of their request for IH (Industrial Heavy) zoning. The subject
property is located immediately west ofthe Public Works facilities on E. 76th St North.
The area being requested is in the rail yard on the northerly portion ofthe property. The
proposed use is a metal recycling business that is unassociated with the SK&O
operations. The site is presently zoned IL (Industrial Light).

ViA TCO submitted an appeal on Friday, February 1,2002, meeting the 15-day statutory
cut-off date to appeal the Planning Commission decision. The appeal will be placed on
the March 19th City Council meeting agenda. The time, date and location of the appeal
will be provided to the applicant, adjacent landowners and those having spoken at the
Planning Commission meeting. The Staff will provide specific information on the appeal
for your March Ith Work Session in preparation for the March 19th meeting.
There has been an application by W ATCO Companies Inc. requesting rezoning a pOliion
of the SK&O Railroad property west of the Public Works facility. The proposed use of
the property is to process and package waste metal for transportation by rail. The current
zoning is (Industrial Light) which does not permit this use. The applicant has
requested 1M (Industrial Medium) zoning to accomplish their goal. The Planning
Commission denied the application on January 17,2002. Their concern was the negative
visual impact of this use at this important "Gateway" to the City of Ow as so. This
Gateway is identified on the adopted Owasso Downtown Development District Plan.

Notification letters were mailed to sLllTOlmding property owners on December 26,2001 and legal
notification was published in the December 27,2001 edition of the Owasso Reporter. No calls
or comments have been received by staff regarding this request.
The legal description submitted by the applicant, while adequate for legal notification is not, in
staffs opinion, acceptable for the ordinance that will be required if the Planning Commission and
City Council approve this request. Staff has requested the applicant submit a precise, detailed
legal description, including bearings and precise acreage, and anticipates its receipt soon.
Tlu'ough discussions with staff, the applicant has agreed to provide screening of the metals
recycling from E. 76th Street N., the future Sertoma Club to the west and the residences to the
east, if required.
The Owasso 2010 Land Use Master Plan shows the subj ect propeliy as Heavy Industrial.
Therefore, the requested rezoning to IH is in compliance with the comprehensive plan.
SK&O is requesting this rezoning to allow for the operation of a metals recycling business,
unassociated with railroad operations, within the boundary oftheir property. The recycling
operations are planned to occur within the confines of the rail yard, primarily between the two
sets of tracks. Due to the proximity of the proposed rezone area to the existing residential and
agricultural properties, as well as the western "gateway" as defined by the Downtown
Development District Concept Plan, staff has requested the applicant retain IL (Industrial Light)
zoning around the perimeter of the subject area. A plan showing the defined area is attached for
your information and review.
The subject property is bound on the west by vacant, undeveloped nlral property zoned AG
(Agriculture), on the norih and east by the SK&O right-of-way and, further, by a portion of the
Bailey Ranch Golf Course and municipal neighborhoods, primarily residential, zoned RS-3
(Residential Single-Family, High Density), Rt\l1.1 (Residential Multi--Family, Low Density), and

HEARING
Donna presented the case to the Commissioners and described the property location. A
request for rezoning, along with a plat and site plan request were approved at a previous
meeting. It was then discovered that the subject property was never annexed into the
corporate limits of the City of Owasso. A letter was sent to Tulsa Teachers' Credit
Union explaining the issue and the schedule of processes. This property is contiguous to
existing city limits and the Annexation Committee reviewed and approved the request at
their January 10, 2002 special meeting. Donna explained the process and stated that the
City of Owasso will waive the fees for legal notifications which will be republished. No
new action will take place regarding the final plat and the site plan since they did not
require legal notifications. The Plarming Commission will hear the rezoning request at
their regular scheduled meeting on March 12, 2002. It will then be presented to the City
Council at the March 19, 2002 meeting. The building permit will be issued after review
and approval, of the rezoning, by the City Council. Mr. Jerry Emanuel of Sack &
Associates was present to answer questions regarding the annexation. Staff recommends

Donna presented the case and described the location of the property. This rezoning
request is to allow for the operation of a metals recycling business. The operations are
planned to occur primarily between the two sets of tracks. The Owasso 2010 Land Use
Master Plan shows the property as Heavy Industrial. Staff has requested the applicant to
submit a precise legal description, which includes bearings and precise acreage. The
railroad has agreed to a buffer around the perimeter of the property. Notitlcation letters
were mailed and legal notification was published in the Owasso Reporter. No calls have
been received by staff. Staff recommends approval of the rezoning from IL (Industrial
Light) to IH (Industrial Heavy). Several surrounding property owners were present to
express their concerns with the rezoning request. Mr. Jimmy Russell addressed the
Commissioners, stating that he would like the Commissioners to review the type of
business that is requesting approval, he voiced objections to a junkyard on this property.
Mr. Russell advised the Commissioners to tour this type of facility in other cities. He
also stated that he and his family live in Owasso because there is not a lot of industrial in
the area. Mr. Brad Snow, the applicant, was not present to answer questions. Mr.
Randy Noonkester of 404 East 2nc1 Street had concerns with heavy truck traffic in the area.
Dewey Brown would like a better definition of metal recycle, such as, what type of
metal. Charles vVilley had concerns regarding the pollution, noise and the large trucks
that a metal recycle business will create.
5. OZ-02-01 - SK&O Railroad - A request for rezoning approximately 5 acres from IL
(Industrial Light) to IH (Industrial Heavy). The subject property is generally described as

request, another request (02-94-06) was submitted to rezone the property to the west,

BACKGROUND:
The use of a PUD technique is a way to amend a zoning ordinance in accordance with a
complete, coordinated plan of development for a larger parcel, rather than piecemeal the
changes by using variances of the zoning regulations.

property. Perimeter sidewalks must be installed at the time of overall development, while
the internal walks may be constructed as individual lots/sites are developed.

RECOMMENDATIONS

The Owasso Planning Commission reviewed the requested partial easement closure at the March
12,2002 regular meeting and unanimously recommended approval.
The Owasso Technical AdvisOlY Committee reviewed the closing request at the Februaty
2002 regular meeting. No comments regarding the easement closing were recorded. Each public
utility provider has provided signed certificates stating they have no objection to the closing.
Copies of the certificates of approval are attached for your information and review.
The subject existing mutual access easement, recorded April 1995, was established to ensure
future access through CoventIy Gardens along . 1 02"d E. Avenue to a 15 acre tract reserved for
a future school site. The school site has now been relocated westward to front along N. Mingo
Road and the subsequent platting of the first phase of Honey Creek at Bailey Ranch has rendered
the easement obsolete.
Pittman Poe & Associates is requesting review of a closing of a mutual access easement as
recorded in the office of the Tulsa County Clerk in Book 5709, Page 611..614 and generally
described as a portion of the East Half of the Southwest Quarter (E/2 SvV/4) of Section 18,
Tmvnship 21 Range 14E, Tulsa County, State of Oklahoma. The subject property is located
