Mr Can said that requests for proposals for engineering services were sent to several firms for
intersection and roadway projects and water system improvements. Firms were selected
following an established process, and staff recommends that engineering agreements be awarded
between the City of Owasso and C H Guernsey & Co in the amount of $273,661 for widening E
86th St N (N129th East Ave to N 145th East Ave) and for widening E 96th St N (N 119th East Ave
to N Garnett Rd); between the City of Owasso and CH2MHill in the amount of $274,986 for E
96th St N & 129th East Ave Interchange and for widening N 129th East Ave (E 76th St N to E 96th
St N); and between the City of Owasso and Atkins-Benham in the amount of $431 ,840 for Phase
I Water System Improvements; and authorization for the Mayor to execute the agreements. Mr
Carr commented that the total cost for the engineering agreements is $300,000 less than what
was budgeted. Ms Kimball moved, seconded by Mr Helm, to approve the engineering
agreements as recommended by staff.
ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FOR COUNCIL APPROVAL OF ENGINEERING AGREEMENTS FOR

SYSTEM IMPROVEMENTS.

Ms Bishop presented the item. The General Fund has a total of $887,822 in budgeted but
unexpended funds remaining from the FY 2001-02 budget. Of that amount, $568,734 is eligible
carryover budget requests. Requests from 16 depmiments are included in the
recommendation for the carryover budget supplement of $338,835 in the General Fund. The E-
911 Fund request for a $60,000 canyover budget supplement for radio and communications
center improvements is recommended. Five existing projects budgeted in the Capital
Improvements Fund for FY 2001-02 are expected to continue into FY 2002-03. Requests in the
Capital Improvements Fund of$406,774 are recommended in the canyover budget supplement.
The new ambulance was budgeted in the Ambulance Capital Fund for FY 2002, but was
delivered dming FY 2003. The request in the Ambulance Capital Fund for a $160,000 carryover
budget supplement is recommended. The Bond Projects Fund request for a $10,000 carryover
budget supplement to finalize outstanding contracts on the City hall construction project is
recommended. Mr Cochran moved, seconded by Ms Kimball, to approve the requested
carryover from FY 2001-02 and a supplemental appropriation to the FY 2002-03 General Fund
budget of $338,835, to the E-911 Fund of $60,000, to the Capital Improvements Fund of
$406,774, to the Ambulance Capital Fund of $160,000, and to the Bond Projects Fund of
$10,000.

Mr Ray noted that there is an error in the dates on the maintenance bond for the paving of Coffee
Creek (Item #4-D), and that the City will not complete those bonds until that error has been

Councilor Kimball thanked Pete Kourtis and David Charney for their land donation and their
willingness to work with the City in the development of Centennial Park.

Mr Rooney said that for approximately 18 months, the City has been in negotiations with Preston
Lakes, LLC in order to allow for the donation of 59+ acres of land to the City for use as a
regional park. The agreement would not only allow for the donation of land, but would also
allow for the City to purchase improvements made to the park by the developers, establish a
schedule for the repayment of the improvements, and provide a funding source for a large
portion of the improvements. The scheduled park improvements would cost approximately
$323,500. The City of Owasso would pay $150,000 to the developers upon completion of the
improvements, and the remaining $173,500 would be paid on July 1,2003. Funding is available
in the Park Development Fund. Ms Kimball moved, seconded by Mr Helm, to approve the
Preston Lakes Centennial Park Agreement, allowing for the donation of 59 acres, more or less,
for public park use, and defining scheduled improvements and a payment schedule for those
improvements; and authorization for the Mayor to execute the agreement.
ITEM 17: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FOR CITY COUNCIL APPROVAL OF A REAL EST ATE PURCHASE
CONTRACT FOR PRESTON LAKES CENTENNIAL PARK, SUCH
AGREEMENT PROVIDING FOR THE DONATION OF APPROXIMA TEL Y
59.47 ACRES OF LAND FOR PARK USE, OUTLINING A SCHEDULE FOR
IMPROVEMENTS, AND DEFINING A PAYMENT SCHEDULE FOR THOSE
IMPROVEMENTS.

Another item of concem is the ability of Washington County Rural Water District #3 to provide
adequate fire flow protection to the restaurant. Fire flow tests have been conducted at the
QuikTrip site and have indicated substandard fire flow protection. In order to address the
concern at QuikTrip, an additional fire hydrant is being installed. As this problem is also likely
to repeat itself at the restaurant site, no building permit for the Eggberts Restaurant will be issued
until this concern is adequately addressed. Mr Cochran moved, seconded by Ms Kimball, to
approve the final plat for Eggbelis Restaurant, subject to the conditions listed.

Attached is a copy of Ordinance No. 716 which formally adopts the City Council's action of
August 20,2002.
BACKGROUND:
At the August 20, 2002 meeting, the Owasso City Council unanimously approved a request for
annexation of property totaling approximately 1.019 acres described as a portion of land located
within Section 30, Township 21 North, Range 14 East. The subject property is located north of
E. 76tl1 Street North and west of the of the Atchison, Topeka, and Santa Fe right-of-way. A
location map is attached for your information and review.

OWASSO, OKLAHOMA,
WHEREAS, on the 20th day of August, 2002, said Petition was duly considered by the
City Council and was determined to have complied with the provisions of Title 11, Section 21-
103, et seq., of the Oklahoma Statutes, and further, that proper legal notice of presentation of
said petition had been given; and
WHEREAS, notice of the presentation of said Petition was given by the Petitioner by
publication in the Owasso Reporter, a newspaper of general circulation published in the City of
Owasso, Oklahoma, and notice was given that said Petition would be considered by the City
Council of the City of Owasso, at a meeting to be held on August 20,2002 at 6:30 PM at the
Community Center, Owasso, Oklahoma; and
WHEREAS, pursuant to the provisions of Title 11, Section 21-103, et seq., of the
Oklahoma Statutes, the City of Owasso is permitted to annex additional territory providing a
petition in writing, signed by not less than three-fourths of the legal voters and owners of not less
than three-fourths (in value) of the property hereinafter described, the same being contiguous to
the corporate limits of the City of Owasso, requesting that said property be annexed and added to
the City of Owasso is submitted; and
AN ORDINANCE ACCEPTING, ADDING, AND ANNEXING TO THE CITY
OF OWASSO, OKLAHOMA, ADDITIONAL LANDS AND TERRITORY IN
SECTION 30, TOWNSHIP 21 NORTH, RANGE 14 EAST, PROVIDED THAT
FROM AND AFTER THE PASSAGE AND PUBLICATION OF THIS
ORDINANCE THAT ALL OF THE REAL PROPERTY WITHIN SAID
TERRITORY HEREIN DESCRIBED SHALL BE A PART OF THE CITY OF
OWASSO, OKLAHOMA, AND FURTHER DECLARING THAT ALL

Section 3. That there be fIled in the office of the County Clerk of Tulsa County,
Oklahoma, a true and correct copy of this Ordinance, together with an accurate map of the
territory hereby annexed.
Section 2. That from and after the passage and publication of this Ordinance, the real
estate and territory described in Section 1 hereof shall be a part of the City of Owasso,
Oklahoma, and in Ward Four thereof, and all persons residing therein, and all property situated
thereon, shall be and are hereby declared to be subject to the jurisdiction, control, laws, and
ordinances of the City of Owasso, Oklahoma, in all respects and particulars.

RECOMMENDATION:
Staff recommends Council acceptance of the Tulsa Teachers Credit Union water and
sanitary sewer systems.
The contractor has provided a one-year maintenance bond for the utilities (see attached).
A water system final inspection was conducted on April 29, 2002 and the sanitary sewer
final inspection occurred on June 13,2002. Recommendation for acceptance was
delayed pending completion of minor surface corrections on the water system. All items
identified at the final inspection requiring correction to meet city standards have been
completed.
FINALINSPECTIONS:
BACKGROUND:
The subject facility is located on 96th Street immediately west of the Owasso Market (see
attached location map). The sanitary sewer system was constructed in two phases which
totals 957 LF of 8-inch lines. The water system consists of 267 LF of 6-inch lines.
Designs for these systems were approved and construction inspected by the Public Works
Department and pelmitted by ODEQ (see attached permits)

ATTACHMENT:
Providing all approvals are obtained, the staff will recommend City Council approval of the
fireworks display.
RECOMMENDATION:
A representative of the bank will address the Council on September 3rd relative to the display,
and request Council approval. They have visited with representatives of the Fire Department and
Police Department to address safety concerns, and have received permission from school
officials for the display. Letters documenting these actions will be presented to you at the
Council meeting.
Staff has received a request from Exchange Bank for the City Council to consider approval for
the bank to sponsor a display of fireworks at the high school stadium prior to each home football
game. City Code requires approval from the City Council for any public display of fireworks
within the city.

RECOMMENDATION:
Staff recommends acceptance of the FYOI-02 Street Repair contract and authorization for final
payment to JLT Corporation in the amount of$9,470.00.
The contractor has provided a one-year maintenance bond to become effective on the date of project
acceptance (see attached).
FINAL INSPECTION:
Inspections were conducted for groups of sites in a geographical area following completion and
final sealing ofthe repair perimeter. An overall inspection was done on June 25th resulting in the
rework of five sites. All repairs and rework areas are complete. Recommendation for acceptance of
the total contract work was delayed awaiting the contractor's final pay request.
li'UNDING AND PAYMENTS:
Funding was originally provided in the FY01-02 Streets Division Capital Outlay line item. The
contractor has submitted a final pay request for release of retain age in the amount of $9,470.00 (see
attached certification for payment). Previous contract payments amounting to $179,930 plus the
retainage now requested total $189,400.
.BACKGROUND:
The construction contract was awarded to JLT Corporation, Cushing, Oklahoma, in September 2001
for an amount not to exceed $189, 400. The contract was an indefinite delivery contract written to
allow various methods of repair. The base bid included 36 sites (see attached list) with provision
that the number of sites could vary as a result of site surveys with the contractor to determine the
best use of available repair methods. Based on the surveys, it was possible to add 38 sites, primarily
using asphalt rejuvenator and mastic overlays (see attached site maps).

Ordinance No. 704 contained a scrivener's error within the legal description of the mutual access
easement. Ordinance No. 704-A corrects that legal description. The original memo submitted
by Mr. Ewing is also attached for your information and review.

Staff recommends approval of Ordinance No. 704.
Staff recommends approval of the closing of the recorded mutual access easement (Book 5709,
Page 611-614).
RECOMMENDATIONS
If the requested closing is approved by Council, Ordinance No. 704 will fonnally adopt that
action.
The Owasso Planning Commission reviewed the requested partial easement closure at the March
12,2002 regular meeting and unanimously recommended approval.
The Owasso Technical Advisory Committee reviewed the closing request at the February 27,
2002 regular meeting. No comments regarding the easement closing were recorded. Each public
utility provider has provided signed certificates stating they have no objection to the closing.
Copies of the certificates of approval are attached for your information and review.
The subject existing mutual access easement, recorded April 27, 1995, was established to ensure
future access through Coventry Gardens along N. 102"d E. Avenue to a 15 acre tract reserved for
a future school site. The school site has now been relocated westward to front along N. Mingo
Road and the subsequent platting of the first phase of Honey Creek at Bailey Ranch has rendered
the easement obsolete.
Pittman Poe & Associates is requesting review of a closing of a mutual access easement as
recorded in the office of the Tulsa County Clerk in Book 5709, Page 611-614 and generally
described as a portion of the East Half of the Southwest Quarier (E/2 SW/4) of Section 18,
Township 2lN, Range 14E, Tulsa County, State of Oklahoma. The subject propeliy is located
north ofE. 96th Street N. and west ofN. Garnett Road.

TO THE PUBLIC USE A PORTION OF A MUTUAL ACCESS
EASEMENT LOCATED WITIDN SECTION 18, TOWHSIP 21 NORTH,
RANGE 14 EAST, TULSA COUNTY, STATE OF OKLAHOM, AND
RETAINING UNTO SAID CITY OF OW ASSO, OKLAHOMA, THE
ABSOLUTE RIGHT TO REOPEN SAME WITHOUT EXPENSE TO THE
MUNICIPALITY, AND REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH.

Section 3, That all ordinances or parts of ordinances in conflict herewith be,
and the same, are hereby expressly repealed.
Section 2. The municipality shall retain the absolute right to reopen the public
way or easement without expense to the municipality. Closing of the public
way or easement shall not affect the right to maintain, repair, reconstruct,
operate or remove drainage facilities of service therein, nor shall a closing
affect private ways existing by operation of law unless released in writing by the
owners thereof.
