Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, October 11, 2002 and the
Addendum to Agenda posted on the City Hall bulletin board at 11 :00 a.m. on Monday, October

Mr. Wiles said that on October 8th, representatives from the City met with representatives from
the group of Citizens for Responsible Rural Development. The meeting centered on drainage
conditions in the Ranch Creek basin generally from the intersection of Memorial and 1 1 6th St. N.
to the intersection of Mingo and 106th St. N. The citizens discussed how past developments near
their properties in Tulsa County have increased the amount of drainage onto their property.
DUling the meeting, the staff discussed the concept of No Adverse Impact. No Adverse Impact
peltains to developments that occur in the floodplain. The concept is that floodplain
developments should not adversely impact other property by increasing flood depths or
velocities. The City will examine existing floodplain development regulations to determine
whether changes that could better protect existing propelties within the floodplain might be
advisable. The staff recommended that the City Council consider the topics raised at the meeting
and adopt a statement of policy that affirms the City's desire to control drainage in a responsible
manner and that directs the staff to focus on issues of drainage for all new developments. A
Policy Statement Relating to Drainage of Water Through the Basins in and Around the City was
presented to the Council. The statement contains three points: (1) New development should not
have a water-drainage impact on other propelty; (2) The staff is directed to provide detailed
review of all submitted drainage plans for any development; and (3) The staff is directed to
initiate the development of a master drainage plan subsequent to the receipt of data from the
current study being accomplished by the Corps of Engineers and funded by Tulsa County.

Mr. Moore said that the City has received a request from David Charney for the review of a
rezoning application and planned unit development application for approximately lO acres
located at the northwest comer of 96th St. N. and N. 9ih East Ave. The zoning and PUD will be
reviewed together, but voted on as separate items. The proposal is to rezone from CS
(Commercial Shopping) and CG (Commercial General) to PUD/RS-3 (Planned Unit
Development/Residential Single Family) in order to locate 50 single-family residential garden
homes. The Technical Advisory Committee reviewed the request at their September 25, 2002

Mr. Rooney presented the item. Noble Sokolosky has presented a request for annexation of
acres of land lying within Sections and 13, generally located between 116th St. Nand
96th St. N between memorial Dr. and Mingo Rd. Tract contains 160 acres and is currently
zone RE (Residential Estates) in Tulsa County. Tract B contains 132.07 acres and Tract C
contains .15 acres, and both are currently zoned AG (Agriculture). The Annexation Committee
and Planning Commission have recommended approval. Several property owners attended the
Planning Commission meetings to voice concerns regarding the request. Their concerns center
on stormwater run-off and the adverse effects it would create on surrounding properties, how the
property would develop, and the City "fast-tracking" the annexation request. The Planning
Commission listened to the concerns, but made it clear that the item before them was simply an
annexation request. Ms. Jan Thomas, representing Citizens for Responsible Rural Development
asked if this would be considered spot annexation since there are two large tracts connected only
by a thin strip of land. Staff explained that there is no such things as spot annexation. Anything
within the city's fenceline may be annexed since the fenceline itself is a part of the city.
Councilor Atmstrong asked if the policy statement adopted in the previous item would apply to
development on this land. Staff assured her that it wilL Ms. Atmstrong moved, seconded by
Mr. Helm. to approve the requested annexation with the stipulation that Items I and II of the
water drainage policy be followed.

Mr. Moore said that this request was initiated by the Community Development Department in an
effort to alleviate the non-conforming status of the health-related businesses within Ram Plaza.
This request will amend only the language included in the PUD requirements and not the
language as approved per the subdivision plat. Any amendment to the subdivision plat that
would allow health-related facilities to remain would require approval of the property owners.
The request was heard by the Planning Commission at the October ih meeting, and the Planning
Commission did not make a successful recommendation. Staff recommended approval of the

Mr. Moore presented the item. Michael Roark has requested a review of a minor amendment to
OPUD<" 11, to amend the protective covenants to allow for a retail pet store that raises, breeds, or
keeps animals. This request is to amend only the planned unit development requirements that the
City has been appointed to enforce, not the covenants as approved as a patt of the subdivision
plat. Even if this amendment is approved by the Council, property owners within Ram Plaza
would still have an avenue to allow or not allow the proposal through the association's covenant
enforcement powers. The Technical Advisory Committee heard the request on September 24,
2002, and offered no comments. The Planning Commission unanimously recommended
approval at their October 7, 2002 meeting. Ms. Kimball moved, seconded by Mr. Helm, to
approve the requested amendment to the protective covenants of Ram Plaza.

Mr. Wiles presented the item. The City has received a request from Lance Preston for the review
of a minor amendment to OPUD-ll to amend the PUD requirements of Ram Plaza to allow for a
billiard parlor, interpreted in the requirements as a recreational use. Initially the applicant
requested that City staff review a proposal that, in addition to allowing a billiard parlor, would
also allow for on"premise alcohol consumption. The applicant has amended his application,
striking the language pertaining to alcohol. The Planning Commission heard the request at their
November ih meeting, and did not make a successful recommendation. Mr. Wiles said that
recreational uses are typically significantly more intensive in nature than other commercial uses.
The physical layout of the Ram Plaza development provides for separate commercial sites that
are distinct from each other and have separate service areas rather than a shared service area.
The layout of the development does not lend itself to having the service capacity necessary to
handle a recreational use. The staff finds that, as a recreational use, a billiard parlor would be
too intensive a use for the Ram Plaza planned unit development, and the staff recommended
denial of the request. The applicant, Mr. Preston, asked why the issue of high intensity use
wasn't brought up prior to the Planning Commission hearing. He said he could find no language
in the PUD that refers to low intensity use. He said the building meets all of the city zoning
requirements and he has received and county and state licenses. He has removed the request to
serve beer, but wants to reserve the right to revisit the issue of serving beer in the future. Several
citizens were present and spoke in favor of having a billiard hall as a place for children to go for
recreation. Ram Plaza property owners spoke against the placement of a billiard parlor in the
area because of the traffic and lack of sufficient parking spaces, and the fact that the serving of
alcohol or 3.2 beer could become an issue in the future. After much discussion, mostly related to
the issues of high intensity use and the serving of 3.2 beer, Mayor Brogdon moved, seconded by
Ms. Armstrong, to approve the requested amendment to OPUD-ll to allow recreational and/or
entertainment use.

Mr. Carr presented the item. The Three Lakes Channel improvement project is one of three
Supplemental Environmental Projects submitted to, and approved, in compliance with the
Consent Order conditions with the Oklahoma Department of Environmental Quality. The
consent order requires the City to construct an improvement with a minimum cost of $100,000
and with construction beginning no later than November 2002. The proposed project segment
included in this construction contract is the first phase of a total project which will provide a
concrete channel extending north to 86th Street North in the area of Goldie's Restaurant. Bid
documents were prepared and advertised, and bids were opened on September 19th. Four bids
were received, with the apparent low bid being submitted by Horizon Construction Company,
Inc., Owasso, OK, in the amount of $119,667.26. Funding in the amount of $100,000 was
included in the FY02-03 Capital Projects budget for this project. The remaining amount of
$19,667.26 will come from some of the lower priority items on the Capital Projects list.

ML Wiles said that the City of Owasso is a "census-designated" place. An urban area refers to a
census..designated place having a population of 5000 or more and not within any other urbanized
area. Based on that definition, is classified as an urban area. Owasso is a small urban
area it has a population greater than 5000 and is physically separated from the four
urbanized areas: Tulsa, Oklahoma City, Norman, and Lawton. Bird Creek separates Owasso
from the Tulsa area. This classification makes Owasso eligible for federal funds through the
Surface Transportation Program. The Oklahoma Department of Transportation is coordinating
an adjustment to the boundary of Owasso' s urban area. Freeways, arterials, collector streets, and
local roads are eligible for varying amounts of funds based upon the total number of road miles
within Owasso's adjusted urban area boundary. Staff has proposed to enlarge the adjusted urban
area boundary, thus increasing the total number of road miles that are eligible for improvement
through the STP. The process is for the Mayor to sign the proposed Adjusted Urban Area
Boundary map, which will then be forwarded to ODOT. ODOT will seek approval from the
Federal Highway Administration. Once that approval has been given, the staff will work with
ODOT officials to re..classify all roads within the Owasso urban area. Ms. Armstrong moved,
seconded by Ms. Kimball, to approve the adjusted urban area boundaries, and authorize the
Mayor to execute the official map.

Attached is a copy of Ordinance No. 718 which formally adopts the City Council's action of
October 15, 2002.
BACKGROUND:
At the October 15, 2002 meeting, the Owasso City Council unanimously approved a request for
annexation of property totaling approximately 292.22 acres described as portions of land located
within Sections 12 and 13, Township 21 North, Range 14 East. The subject properties are
generally located between Memorial and Mingo and E. 96th Street North and 116th Street
North. A location map is attached for your information and review.

RECOMMENDATION:
The staff believes that the rezoning ordinance for the property was never brought forward to the
Council because of a staff error and finds no peculiarities in the case file that might suggest a reason
for not submitting the rezoning ordinance. The staff requests approval of Ordinance #723, thus
effecting the rezoning approved by the City Council last year.
REQUEST:
The Planning Commission unanimously recommended approval of the rezoning in September,
2001. An adjacent 13 acres located immediately west of the site (more specifically at the southeast

Ms Sorrells presented the item. D M Sokolosky has re~uested rezoning a 12.95 acre tract ofland
located east of N Mingo Rd and 530' north of E 106t St N, from CG to RS-3. The Owasso
Planning Commission reviewed the request at a meeting on September 17, 2001 and
recommended approvaL Several citizens residing in the area attended the City Council meeting
and expressed concerns over potential drainage issues arising from development. Citizens
addressing the Council were Jan Fallew, Earl Worley, Jan Thomas, Don McLaughlin, Sue
Piggett, Harold Ledbetter, & Carol Seim. They discussed general flooding in the area and the
amount of new flooding caused by development. Ms Sorrells and Mr Carr addressed the issues.
Mr Carr said that the City of Owasso is working with Tulsa County to try to resolve some of the
problems. Following discussion, Mr Brogdon reminded everyone that the only issue before the
Council at this time is that of rezoning. He said the issues raised concerning drainage will be
addressed during the platting stage. Mr Brogdon moved to approve the requested rezoning. Mr
Helm requested an amendment to the motion to direct the staff to hold meetings with the
developer and the concerned citizens in order to address the citizens' concerns before a final plat
is brought to the City Council for approval. Mr Brogdon agreed to the amended motion,
seconded by Mr Helm.

Ms SorTells said that the City has received a request for approval of a final plat for Exchange
Bank Owasso I, located at the northeast comer of E 86th St Nand N Mingo Rd. The plat
contains one commercial lot of approximately .91 acres. No permits are required for this
development. Planning Commission recommended approval at their meeting on September
17, 2001. Mr Helm asked who would be supplying water, and Ms Sorrells responded that the
development will be on City of Owasso water. Mr Helm moved, seconded by Mr Williams, to
approve the final plat for Exchange Bank Owasso 1.

Ms Sorrells presented the item. Mansur Daubeli Strella, on behalf of the First Baptist Church of
Owasso, has requested the closing of a 15' sanitary sewer easement and a 15' water easement,
which was recorded on a plat. The entrance drive to the property has been shifted slightly,
necessitating the closing of the platted easement, and subsequently the recording of a new
easement. The Owasso Planning Commission reviewed the request on September 17, 2001, and
recommended approval. Mr Brogdon moved, seconded by Mr Williams, to adopt Ordinance
#687 approving the requested easement closing. Mr Helm abstained which, by virtue of law,
must be counted as a no vote.

Letters were mailed to surrounding property owners on August 21, 2001 and legal notification of
the proposed rezoning was published in the August 23, 2001 edition ofthe Owasso Reporter.
Staff received one e-mail message fi'om a citizen opposing, and one letter supporting this
application. Copies of the correspondence are attached for your information and review.
As the request currently before the Planning Commission represents a use less intense than that
reflected on the comprehensive plan, staffis supportive. If, however, the requested rezoning is
approved, the corresponding Planned Unit Development, OPUD-OI-01, shall subsequently
require amendment or abandonment prior to the processing of any plat associated with the
subject property.
The Owasso 2010 Land Use Master Plan designates the subject property as light industrial. The
Owasso Planning Commission and City Council approved rezoning of the subject property to IL
(IndustIial Light) in Pebmary 2001 and April 2001, respectively.

Jehovah's Witnesses, zoned AG (Agriculture); on the east by railroad right-of..way and further by

RECOMMENDATION:
Staff recommends Council acceptance ofthe Owasso First Baptist Church Water and
Sanitary Sewer Line Extensions.
The contractor has provided one-year maintenance bonds for the utilities (see attached).
A water system final inspection was conducted on January 25,2002 and the sanitary
sewer final inspection occurred on November 19,2001. All items identified at the final
inspection requiring correction to meet city standards have been completed.
FINAL INSPECTIONS:
BACKGROUND:
The subject facility is located on 96th Street and 133rd East (see attached location
map). The sanitary sewer system was constructed in one phase which totals 824 LF of 8-
inch lines. The water system consists of 1169 LF of 12-inch lines, and 547 LF of 6-inch
lines. Designs for these systems were approved and construction inspected by the Public
Works Department and pelmitted by ODEQ (see attached pelmits). Acceptance ofthis
improvement was delayed pending receipt of the maintenance bond.

MAINTENANCE BOND
Mr. Gray and I have met twice and further discussed terms of an agreement by telephone. Also
included in those discussions were Ms. Bishop and Mr. Rooney. On Wednesday, October 30,
2002, Mr. Gray and I resolved all issues relating to the agreement. Therefore, the purpose of this
memorandum is to communicate to the City Council the terms of the proposed agreement and
recommend its approval.
AGREEMENT NEGOTIATIONS:
On October 15, 2002, the City Council, in executive session, interviewed three of the four
applicants (Mr. Jerry Williams, withdrew his name from further consideration). After returning
to open session and, pursuant to a listed agenda item, the City Council authorized the City
Manager to enter into negotiations with Mr. Stephen P. Gray to determine if an acceptable
agreement for legal services could be reached between the two parties.
On October 8, 2002, the City Council met for the purpose of reviewing those applications and
selecting applicants who would be asked to interview for the position. Based on their review of
the submitted applications and on input from the City Manager, the City Council elected to offer
an interview to three applicants. Those asked to interview were Mr. David Pauling, Mr. Jerry
Williams, and Mr. Stephen Gray. Subsequent to that decision, a thirteenth applicant (and interim
City Attorney) Jay Baker, submitted his application for the position and, as a result of a request
by the City Manager, was also included among those to be interviewed.
On September 17, 2002, Mr. Ron Cates submitted his resignation as Owasso's City Attorney.
Subsequently, the City Council authorized the advertisement of a vacancy in that position and
solicited resumes from qualified applicants. Twelve applications for the position were received
and transmitted to the City Council for review.

1. Proposed Contract for Legal Services
ATTACHMENT:
The staff recommends City Council approval of the "Contract for Legal Services" between the
City of Ow as so and Mr. Stephen P. Gray.
RECOMMENDATION:
Funding for the proposed Contract for Legal Services is contained in the FY 2002-03 General
Fund Budget and FY 2002-03 OPWA Budget. Specifically, line item 01-150-53001 on page 19
of the budget document and in line item 61-400-53001 on page 65 ofthe budget document.
FUNDING:
NOTE: The proposed agreement is anticipated to extend through the end ofthe fiscal year (June
30, 2002), at which time the City Council and Mr. Gray will have opportunity to revisit
the agreement, as well as determine the interest either party has in continuing the
relationship.
F or all matters not covered by the base retainer, Mr. Gray will be paid $100 per hour (the same
amount as was paid to the previous City Attorney). However, this agreement also dictates a
lower level of pay for services provided by others in Mr. Gray's office ($65 per hour for an
associate attorney and $25 for paralegal staff work). It is believed that this arrangement will
provide a sound business approach to the provision of legal services and serve as a basis for a
long-term relationship.
The proposed agreement (attached) is designed to be easily administered and, generally, reflects
the same level of compensation as the City had with its previous legal counsel. The agreement
contains a retainer clause that requires the City to pay Mr. Gray $1400 per month regardless of
what services are provided. However, as a condition of that retainer, Mr. Gray will attend all
regularly scheduled meetings of the City Council, any special meetings of the Council
requested), review all contracts of which the City is a party and draft all ordinances requested by
the City. Additionally, Mr. will, as a condition of the retainer, respond to telephone calls
from City personnel relating to routine requests for information and questions. a part of the
retainer clause, the City will provide medical insurance to Mr. Gray and his family, however, the
cost ofthat insurance will be deducted from the retainer amount of $1400.

3. Both patties agree that this contract operates on a fiscal year basis. The Owasso
fiscal year ends June 30, 2003. Furthermore, this contract is conditioned upon
money being appropriated by the City of Owasso to fund the same. Owasso does
represent to Gray, however, that the monies are encumbered to cover said
contract.
