The Owasso City Council met in regular session on Tuesday, November 19, 2002 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, November 15, 2001

ITEM 5: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
RESIGNATION BY THE WARD I COUNCILOR.
Mayor Helm read a letter of resignation from Ward I Councilor Randy Brogdon, in which he
resigned as Mayor and as a councilor effective at 5:19 p.m. on Monday, November 18, 2002.
Ms. Kimball moved, seconded by Ms. Armstrong, to accept Councilor Brogdon's resignation, to
declare that a vacancy exists in the Ward I council seat, and to direct the staff to initiate the
adopted process to fill the position by appointment.

The consent agenda included minutes of the November 5, 2002 regular meeting and the
November 12, 2002 special meeting, by reference made a part hereto. Item B on the consent
agenda included the following claims: (1) General Fund $167,507.18; (2) Ambulance Service
Fund $1,755.96; (3) E-911 Fund $2,064.49; (4) Capital Improvements Fund $7,604.40; (5) City
Garage Fund $6,926.17; (6) Workers Comp Fund $30,744.46; (7) Collision Self-Insurance
$1,517.44; (8) Capital Projects Grants $$373.38; (9) Payroll $227,179.75; (10) City Garage
Payroll $4,284.38; (11) Ambulance Payroll $9,832.50; (12) E-911 Payroll $2,673.15; (13)
Workers Comp Payroll $1,553.92. Item C requested approval of Ordinance 4724, modifying the
definition of compensation in the OMRF Master Defined Contribution Plan Joinder Agreement.
Item D requested approval of deferred retirement for two employees who were fully vested in the
retirement program and who left city employment prior to reaching age 65. Mr. Cochran moved,
seconded by Ms. Kimball, to approve the consent agenda.

#725, AN ORDINANCE AMENDING PART 1, CHAPTER 2, OF THE CODE OF
ORDINANCES OF THE CITY OF QWASSO,._ ESTABLISHING WARD
BOUNDARIES.
Mr. Rooney said that State Statute requires that municipalities review wards and ward
boundaries as soon as practical following each federal census. The governing body may then
change the boundaries if necessary, so that the wards are formed of compact and contiguous
territory and are substantially equal in population. Based on staff review, a determination was
made that the ward boundaries should be changed to reflect the changing population density and
better distribute the city's population throughout the five wards. Based on a census tract count
that was updated as of 2002, the wards as proposed contain the following populations: Ward 1
2063; Ward 2 — 3603, Ward 3 — 4011, Ward 4 — 3800, Ward 5 — 5000. The wards containing
smaller population numbers are the wards that show a potential for growth. An effort was made
to keep neighborhoods within the same ward. Ms. Armstrong moved, seconded by Mr. Cochran,
to approve Ordinance 4725, redefining ward boundaries for the City of Owasso.

State statutes allow for the attachment of an emergency clause to ordinances in order to protect
the interest of the citizens. The emergency clause allows the ordinance to become effective
immediately upon passage and publication. Staff believes that the attachment of an emergency
clause is critical to the settlement of the pending legal action. Ms. Kimball moved, seconded by
Mr. Cochran, to approve the attachment of an emergency clause to Ordinance #727.

Mayor Helm's family. Mr. Ray reported that the City has received a grant from the Cherokee
Nation in an amount not to exceed $42,000, in road assistance funds. The grant will be used on
the E. 86`" St. N. and N. 145"' East Ave. intersection project.

Councilor Kimball reported on the dedication of the Oklahoma Statehouse dome. Mayor Helm
thanked City Attorney Steve Cray for taking care of some pending legal matters so quickly after
being appointed as city attorney.

Monday, November 18, 2002
The Owasso City Council met in a special meeting on Monday, November 18, 2002 in the Main
Conference Room at Owasso City Hall per the Notice of Public Meeting and Agenda posted on
the City Hall bulletin board at 4:00 p.m. on Friday, November 15, 2002. The meeting was called
by the Mayor at 9:00 am, on. Monday, November 11, 2002.

Mayor Brogdon called the meeting to order at 5:16 p.m.

Mr. Ray said that the improvements to the wastewater treatment plant have been financed
through the Oklahoma Water Resources Board. Interim construction financing was approved by
the OPWA Trustees in October 2001, and an application was made to OWRB for permanent
financing in October 2002. The construction has now been completed and it is necessary to
replace the construction loan with permanent financing. OPWA Resolution #2002-06 approved
the permanent financing. City of Owasso Resolution #2002-11 approves the action taken by the
OPWA authorizing the loan. Mr. Cochran moved, seconded by Mr. Helm, to approve
Resolution #2002-11, approving acting taken by the OPWA, authorizing a loan from the OWRB.

BACKGROUND-
If the annexation were approved and prior to any development, the applicant would be required
to apply for and receive approval from the City of Owasso. This approval would consist of not
only the Preliminary and Final Plat reviews by the Technical Advisory Committee and Planning
Commission, but also Final Plat approval from City Council. All development that potentially
occurs on the subject property would be required to adhere to all subdivision and zoning
requirements including but not limited to paved streets, sidewalks and stormwater detention
facilities.
The City of Owasso Annexation Committee reviewed the proposal at the October 30, 2002 Special
Meeting and unanimously recommended approval,

ANALYSIS
The applicant is requesting this annexation petition in order to construct single family
homes on the subject parcel. Tract A of the subject property, totaling .03 acre +/® is
currently zoned AG (Agricultural) in Tulsa County. All property annexed into the City is
required to be zoned the lowest zoning classification (AG) or retain the zoning classification
obtained in Tulsa County. However, the current Tulsa County zoning is AG, thereby
leaving the applicant with no option but to accept an AG. zoning classification. Tract B of
the subject property, totaling 15 acres +/® is currently zoned AG (Agricultural) in Tulsa
County and would remain zoned AG if the annexation were approved. A potential
rezoning request to allow for a higher density of single family homes would require
notification to property owners within 300' of the property as well as publication of a legal
advertisement in the Owasso Reporter. Additionally, a rezoning sign would be posted on
the property at such time that a rezoning was requested.

ANNEXATION POLICY
The following annexation policy for the City of Owasso is provided as a guideline and should
not be construed as inflexible requirements for annexation.
1 . While there is no minimum tract size, properties of larger than 20 acres are preferable.
2. All properties should be contiguous to existing City limits.
I All properties should be annexed into the City limits as the lowest zoning classification,
that is, Agricultural (AG). Landowners may then petition for rezoning if they desire
further development of their property. All legal uses annexed into the City will be legal,
but non - conforming, which means that they may continue but cannot be expanded
without proper zoning.
4. All public infrastructures that do not meet City standards will not be improved by the
City until brought to the City standard and accepted by the City Council, Such public
facilities must be improved at owners expense by the establishment of a special
assessment district or some other financing method.
S. Where a City limit boundary ends at a dedicated street, the boundary will not include the
street right -of -way. This policy will establish consistence and allow City employees and
citizens to know where the City boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for a
six month period after rejection by the City Council.

IMPROVEMENT
DATE- November 25, 2002
Subsequent to a meeting with Public Works staff, it was determined that the intersection project
at E. 86" St. N. and N. 145"' East Ave. would be appropriate to submit for grant funding. Ana
Stagg, Engineering Projects Manager for the City of Owasso supplied a materials list and cost
summary for the project, and a request was made to the Cherokee Nation for a grant totaling
$42,000.00. The grant has been approved for the full amount of the request.
The Cherokee Nation requests that three signs be placed at the location of the E. 86"' N. and N.
145"' East Ave. intersection stating that the project was partially funded by a grant from the
Cherokee Nation. The Cherokee Nation will be responsible for manufacturing the signs, and the
signs will be placed by the Owasso Public Works Department.
Staff recommends that the City Council accept the grant from the Cherokee Nation in the amount
of $42,000.00, to be used for the E. 86"' St. N. and N. 145"' East Ave. intersection project.

ROGERS AND TULSA COUNTIES
WHEREAS, the Cherokee ration provides that certain funds available for obligation shall be
used for the construction or improvement of roads /streets that do not qualify for funding under
Indian Reservation. loads guidelines; and,
The work to be performed under this Memorandum of Agreement is on a project subject to
Section 7(b) of the Indian Self-Determination and Education Assistance .Act (25 U.S.C. 450(b).
Section 7(b) requires the following be provided to the greatest extent feasible:
