Mr Rod Alexander Attachment 46 Mr Alexander will request City Council approval for the Owasso Golf & Athletic Club to hold a fireworks display on July 3'd in celebration of Independence Day. 7. Consideration and Appropriate Action Relating to a Request for Council Adoption of Resolution 200207, a Resolution Adopting a FY 2002-2003 Budget for all Funds Administered by the City. Ms Bishop Attachment #7 The staff will recommend City Council adoption of Resolution #2002-07 and that the appropriate filing of the budget occur subsequent to the adoption of the resolution. Owasso City Council June 18, 2002 Page 3 8. Consideration and Appropriate Action Relating to a Request for Council Approval of Budget Amendments and Supplemental Appropriations to Various Funds. Ms Bishop Attachment #8 The staff will recommend City Council approval of the following amendments to the budgets: * Increase the General Fund, sales tax revenue and interfand transfer to the OPWA Sales Tax Fund by $1,386,668; * Increase the Ambulance Service Fund Expenditures by $38,000. 9. Consideration and Appropriate Action Relating to Ordinance #712, an Ordinance Amending Part 7 — Finance and Taxation, of the City of Owasso Code of Ordinances, Increasing the Purchasing and Bidding Limits to $25,000. Mr Rooney Attachment #9 The staff will recommend City Council approval of Ordinance #712, amending Section 7® 105 of the Code of Ordinances increasing the purchasing limit to $25,000, and Section 7- 107 increasing the bidding limit to $25,000. Consideration and Appropriate Action Relating to * a Request for City Council Approval of a Plat Amendment for Elm Creek Commercial Corner Amended, an Addition to the City of Owasso, Tulsa County, State of Oklahoma. Mr Rooney Attachment #I I The Owasso Planning Commission has conducted a hearing on this request and recommends Council approval of the amendment to the plat for Elm Creek Commercial Center Amended, amending the front building line of Lots 6 & 7, Block 2, from 25 feet to 11 feet° The staff concurs with the recommendation. 12° Consideration and Appropriate Action Relating to an Amendment to the Owasso Zoning Code. Mr Rooney Attachment # 12 The Owasso Planning Commission has conducted a hearing on this request and recommends Council approval of a text amendment to the Owasso Zoning Code, Section 610, to permit mini-storage units in CS, CG, and CH Zoning Districts by Special Exception only. Adjournment OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, June 4, 2002 The Owasso City Council met in regular session on Tuesday, June 4, 2002 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, May 31, 2001 ITEM 1: CALL TO ORDER Mayor Brogdon called the meeting to order at 6:35 p.m. ITEM 2: INVOCATION Pastor Andrew Rankin of the Owasso Freedom Baptist Church, offered the invocation. Mayor Brogdon led in the flag salute. ITEM 4: ROLL CALL PRESENT Randy Brogdon, Mayor - 14/1 Michael Helm, Vice Mayor - 14/1 Susan Kimball, Councilor ® 4/0 Gary Cochran, Councilor ® 4/0 STAFF Rodney J Ray, City Manager Marcia Boutwell, City Clerk A quorum was declared present. ABSENT Rebecca Armstrong, Councilor - 12/3 Ronald D Cates, City Attorney ITEM 5: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REOUEST FOR APPROVAL OF THE CONSENT AGENDA. A. Approval of Minutes of the May 21, 2002 Regular Meeting. B. Approval of Claims. The consent agenda included minutes of the May 21, 2002 Regular Meeting, by reference made a part hereto. Item B on the consent agenda included the following claims: (1) General Fund $117,903.61; (2) Ambulance Service Fund $4,456.55; (3) Capital Improvements Fund $1,522.00; (4) Bond Projects Fund $1,306.33; (5) City Garage Fund $12,644.99; (6) Workers Comp Fund $2,467.60; (7) Payroll $185,704.57; (8) City Garage Payroll $5,366.17; (9) Ambulance Payroll $14,02 ).07; (10) E-911 Payroll $877.88; (11) Workers Comp Payroll $756.00. In order to avoid the appearance of any conflict, Ms Kimball recused herself from Owasso City Council June 4, 2002 voting on the item because of a claim on the claims list for items purchased from Kimball's Hardware prior to her being sworn in as a city councilor, Mr Helm moved, seconded by Mr Cochran, to approve the consent agenda, AYE: Helm, Cochran, Brogdon NAY: None Motion carried 3-0. ITEM 6: CONSIDERA,rION AND APPROPRIATE ACTION RELATING]fQA-REQUEST FOR COUNCIL ACCEPTANCE OF A DONATION FROM THE WAL-MART FOUNDATION, AND THE APPROVAL OF A SUPPLEMENTAL APPROPRIATION. AYE: Kimball, Helm, Cochran, Brogdon NAY: None Motion carried 4-0. INNONIN RUXTW494, GUA 1111 Rw�� Pastor Andrew Rankin of the Freedom Baptist Church, requested City Council approval for the Owasso Minister's Fellowship to hold a public fireworks display in celebration of Independence Day. He said all plans have been coordinated with, and approved by, the Police Department and the Fire Department, and all safety concerns have been addressed. Section 10-304 of the Owasso City Code requires City Council approval for a public display of fireworks within the city limits. Mr Cochran moved, seconded by Mr Helm, to approve the request for a public fireworks display. R LL 1-11 I'll � 116321111019 - R an -.1 1 1 MKOMMUMMMUMT RUMM MI MIUR Chief Greene said that the department is requesting the purchase of two vehicles — one the replace a vehicle in poor condition and one because of personnel changes and the need for an additional vehicle. Staff requested quotes from various vendors, including the state contractual bid price. Tulsa Auto Group provided the most competitive price. Tulsa Auto Group has a current contract with the City of Tulsa, and will sell vehicles to other governmental agencies at the City of Tulsa contract price, a practice allowed by state law. They have 2002 Mercury Marquis 4-door sedans available at a cost of $20,701 each. Mr Helm moved, seconded by Ms Kimball, to approve the purchase of two 2002 Mercury Marquis vehicles fi-om Tulsa Auto Group, Tulsa, OK in the amount of $20,701 each, and authorize payment in the total amount of $41,402. Owasso City Council June 4, 2002 ITEM 10: PRESENTATION TO THE CITY COUNCIL OF THE PROPOSED FY2002-03 BUDGET, AND RE-QUEST FOR COUNCIL APPROVAL TO CONDUCT A PUBLIC HEARING TO SOLICIT PUBLIC COMMENTS RELATIVE TO THE PROPOSED BUDGET. Mr Ray made a brief presentation of the proposed budget, and requested that the Council schedule and conduct a public hearing to received questions and comments. Mr Helm moved, seconded by Ms Kimball, to conduct a public hearing on the proposed FY 2002-03 budget on June 11, 2002 at 6:30 p.m. in the Owasso community Center. AYE: Helm, Kimball, Cochran, Brogdon NAY: None Motion carried 4-0. Mr Ray said that the budget will be before the Council for action at their June 18t" regular meeting. ITEM 11: REPORT FROM CITY MANAGER Mr Ray reported that there will be a public hearing at 6:30 p.m. on June 6th at the community center for the purpose of discussing a proposed closing of Cedar St between 11"' St & 76"' St N. He also reported that the painting of the animal control facility was done last week, and commended the animal control offers for their work in transporting animals to other facilities. Mayor Brogdon called the meeting to order at 6:30 p.m. STAFF Rodney JRay, City Manager Marcia Boutwell, City Clerk/Authority Secretary A quorum was declared present. Mr Ray presented the proposed FY 2002-2003 budget, and budget summary. He outlined goals for the coming fiscal year. Following the presentation, opportunity was provided for questions and comments from the public. The proposed budget will be considered for action by the City Council, OPWA, & OPGA at the June 18, 2002 regular meeting. ITEM 3: ADJOURNMENT. B. It is unlawful for any person to willfully use, utter, publish, circulate or distribute any profane, violent, abusive, or insulting language or literature where: I A natural consequence of the language or literature is to cause a breach of the peace or an assault; or 2. The language or literature, in its common acceptance, is calculated to cause a breach of the peace or an assault. (Prior Code, See. 14-58) A. Except as provided in Subsection B of this section the sale, use, display, lighting or discharge of fireworks within the city is unlawful and an offense. B. The following are exceptions to the prohibitions in Subsection A: 1. The firing, igniting or lighting of the following are exempt from the prohibition contained in Subsection A of this section: sparklers, fountains, pinwheels and all such types of fireworks that are not explosive or noise making in character and are stationary. Not included in this exception are Roman candles, bottle rockets and sky rockets; 2. The city council may, for the common good, approve and sponsor a public display of fireworks within the city celebrating Independence Day. The public display of fireworks must meet each of the following requirements: a. The group organizing the event and igniting the fireworks must obtain the city council's specific approval for the event; b. The use, display, firing, ignition, lighting and discharge of the fireworks must be done in the presence of an authorized representative of the city fire department; and d. The group(s) organizing the event and igniting the fireworks must indemnify and hold the city harmless for any damage caused by the event and RMvidL an insurance policy with the citv named as an insured, covering and protecting the city from liability to the extent it is not immune by state law. SECTION 10 -305 STORING OR KEEPING EXPLOSIVES It is unlawful for any person to store or keep within the city any nitroglycerin, dynamite, gunpowder, or any other highly explosive material or substance, except that gunpowder may be kept in quantities of not to exceed five (5) pounds where the same is securely kept. SECTION 10-306 CARRYING WEAPONS- EXCEPTIONS A. It is unlawful for any person, except those persons authorized by law, to carry upon or about his person or in his vehicle or automobile any pistol, revolver, weapon of the kind usually known as air pistol or air gun, or weapon of the kind usually known as slingshot, bowie knife, dirk knife, switchblade knife, spring -type knife, knife having a blade which opens automatically by hand pressure applied to a button, spring or other device in the handle of the knife, loaded cane, billy, metal knuckles, or any other offensive or defensive weapon. B. Notwithstanding the provisions of Subsection A of this section, persons shall be permitted to carry within the city shotguns, rifles or air guns which are not concealed, if within a reasonable time they are carried from the city, or being carried for the purpose of having them repaired, or for the purpose of using the same in a public muster or military drills, or returning from hunting trips. SHE BISHOP FINANCE DIRE cTOR SUBJECT: SUPPLEMENTAL APPROPRIATIONS FISCAL YEAR END DATE. June 14, 2002 The City of Owasso operates under the provisions of the Municipal Budget Act of 1979. In accordance with the Budget Act, all funds of the City with revenues and expenditures are required to have annual budgets. Expenditures may not legally exceed the appropriation or budget within a department or a fund. The City Manager may transfer appropriations between line items within a department without City Council approval. All transfers of appropriations between departments and supplemental appropriations require City Council approval. The trust authorities (OPWA and OPGA) are required to prepare an annual budget and submit a copy to the City as beneficiary of the trust. However, there are no further requirements such as a legal restriction on spending. Staff is requesting year-end appropriations for the OPWA even though it is not a legal requirement. Staff is requesting five supplemental appropriations, two for City Council consideration and three for OPWA. Two supplemental appropriations are to increase revenues and the associated interfund transfers. The other three supplemental appropriations are to increase expenditures in departments that will exceed appropriations. Those requests are as follows: • General Fund -- sales tax revenue & interfund sales tax transfer - $1,386,668; • Ambulance Service Fund — expenditures for personal services - $38,000; • OPWA Sales Tax Fund — interfund transfers in revenue of $1,386,668 and interfund transfers out expenditures of $1,560,740; • OPWA Operating Fund — wastewater collections department expenses - $55,000; • OPWA Operating Fund — recycle center department expenses - $30,000. GENERAL FUND. Under the pledged revenue requirements of the OPWA bond indentures, the City transfers all of its sales tax collections to the OPWA Sales Tax Fund, and then the OPWA transfers two cents of the sales tax back to the General Fund. Because the sales tax revenue in the General Fund is over budget, the transfer to the OPWA will exceed budget also. The final sales tax collection was received on June 10 from the Oklahoma Tax Commission. The total sales tax revenue for the year is $9,246,667.53, which is $1,386,667.53 over budget. The transfer from the General Fund to the OPWA Sales Tax Fund will exceed budget by the same amount. A supplemental appropriation of $1,386,668 is requested for the revenue and the transfer expenditure. OPWA OPERATING FUND, WASTEWATER COLLECTIONS DEPARTMENT. Earlier in the year, OPWA Trustees were informed of damages and subsequent repairs at the Santa Fe lift station. Those expenses were not included in the operating budget for the department. Total cost for those repairs have been approximately $60,000. A supplemental appropriation of $55,000 is requested for expenses. OPWA OPERATING FUND, RECYCLE CENTER DEPARTMENT. Last year when the budget for the recycle center department was prepared, changes were anticipated in the operation and services at the recycle center. Those changes did not occur. The budget has been exceeded for the payments to customers for recyclable materials and the expenses for landfill tipping fees. A supplemental appropriation of $30,000 is requested for expenses. I ILI Staff recommends that the City Council approve the following amendments to the budget: Increase the General Fund, sales tax revenue and interfund transfer to the OPWA Sales Tax Fund by $1,386,668; ® Increase the Ambulance Service Fund expenditures by $38,000. ROONEY ASSISTANT CITY MANAGER SUBJECT- AMENDMENT TO THE OWASSO CODE OF ORDINANCES INCREASING THE SPENDING LIMIT OF THE CITY MANAGER; AND INCREASING THE THRESHOLD FOR BIDDING DATE: June 13, 2002 The Santa Fe lift station failure in January is a good example of just this type of situation. Removal of the $5,000 spending limit and competitive bidding requirement would allow the City to possess greater leverage with vendors in obtaining a fair price to deliver a service, in this case a repair, a leverage that does not exist when any corrective action in excess of $5,000 requires the approval of the City Council at the next regularly scheduled meeting. Additionally, in the event of a major weather related emergency or any disaster (tornado damage, flood damage, or aviation mishap), an increase in the spending limit of the City Manager would allow for swift, efficient management of city resources and obtaining those resources that we do not have without the City Manager being bogged down attempting to have an emergency meeting of the City Council. Finally, and perhaps most importantly, changing the limits and threshold is just good business. The City of Owasso has presented a $42,000,000 budget for FY 2002-03 and an amendment would not only be more efficient in the sense that city business would not have to be stopped in Code of Ordinances Amendment - Spending and Bidding Limits Page 2 of 2 order to wait on a Council decision regarding the expenditure, but it also permits staff to take advantage of any marketplace price break that may be offered. Staff views this item as another step in a effort to implement a more entrepreneurial philosophy regarding the day to day business of the City. COMMENTS: It is also important to note that current purchasing policies relating to large items will not change, The intent to purchase large equipment or contract items in excess of $5,000 will continue to be telegraphed to the City Council and the public in the City Manager's Report prior to the actual purchase. This would afford the opportunity to obtain comment from both before any actual purchase is made and allow for appropriate intervention when needed. EXISTING LAND USE: The subject property is currently undeveloped. APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15 "Amendments" and Chapter 4 "Residential Uses". SITE INFORMATION: No unusual development hardships are noted. SITE HISTORY: The subject property was rezoned to RS-1 in January of 1998, along with the remaining property involved in the Lindsay Management rezoning of the Golf and Athletic Club property. Zoning on that property consists of OM (Office Medium) for the golf course, RM-1 (Residential Multi-Family) for the apartments, and CS (Commercial Shopping Center) for the Albertson's area. The applicant is requesting a rezoning of two tracts of land from RS-1 (Residential Single-Family High Density) to RS-3 (Residential Single-Family High Density) in order to allow for the use of the site for residential development. As mentioned previously, the subject property is already approved for use in a single-family residential manner; however, the applicant is now seeking a higher density of this type of use. While the request is for RS-3 zoning which is a minimum lot width of 65', Mr. Sokolosky has assured staff that no lots will be smaller than 70' in width, and in fact, it is likely that some will be wider than that. If there was a zoning classification requiring a 70' lot width minimum, the applicant would be requesting that zoning. The RS-2 zoning minimum is 75'. Staff has spoken with several nearby or adjacent property owners regarding the request. As stated previously, initially most were concerned as to whether or not the subject property was going to be apartments. Once that issue was addressed, some seemed to understand that the property would develop in a single-family residential nature, but were concerned with lot size, house size, house type, etc. The most common concern expressed was traffic in the area. If approved for development in any zoning classification, the developer is required to install and acceleration/deceleration lane adjacent to entrances off of E. 76' Street North. This will aid and/or assist traffic from this addition into entering on to E. 76`h Street North, as well as traffic turning into this addition while heading west. Please note that this is a City of Owasso requirement, and that additions that develop in Rogers and Tulsa County are not required to make this type of improvement. While staff concurs that traffic on E. 7611 Street North has increased, a denial of this zoning will not improve that problem. In fact, just the opposite, Addressing the traffic volumes and improvements needed to E. 76`h Street North will require joint efforts by the City of Owasso, Tulsa County, and Rogers County as it is not one entities problem to correct, but rather. several. ATTACHMEN'I'S: EM MEMORANDUM SUBJECT- AG RE EMENT FOR GAS FACILITIES RELOCATION =311 EW'A , OR'N�Jg3fival DATE: June 13, 2002 BACKGROUND- Widening and signalization of the intersection at East 86"' Street North and North 145"' East Avenue was one of the projects included in the 1998 bond issue. Engineering design was initiated in early 1998 by CH2M-Hill and finished early this year. All right-of-way (ROW) has been donated to the City and the affected roadway within the project boundary in Rogers County has been annexed. Currently, all of the utility companies are in the process of designing their utility relocations so that the project can be bid. Oklahoma Natural Gas (ONG), American Electric and Power (AEP), Southwestern Bell, Verdigris Electric Company and Cox Cable all have utilities that require relocation so as to not be under the widened pavement, obstruct drainage or cause potential safety problems. All of the utilities, with the exception of ONG, were within the original ROW. Those utilities requiring relocation will be expected to do so at their own expense. ONG, on the otherhand, purchased easements outside the public ROW which now fall within the public ROW. Relocation of the ONG facilities necessitated acquisition of new easements. Costs for relocation are borne by the City, since they were not previously in the public ROW. ONG has finished the gas lines and pressure reducing station relocation design at the intersection. The design includes relocation of 680 feet of 8 inch diameter high-pressure gas line and 200 feet of 6 inch diameter medium-pressure gas line. Additionally, a pressure regulating station will also be relocated from the southwest comcr of the intersection to the east on school Page 2 ONG Agreement n 86`x' & 145`x' Intersection Improvements property. The City portion of the entire relocation work is estimated to be $222,031.00, which includes material, labor, and contract administration. The Agreement (see Attachment 1) contains the following major points of consideration: ® Relocation costs will be based on actual expenditures and are to be reimbursed within 30 days og completion of work (estimate(l to be mad - August). ONG will award and pay for the work based on competitive bids or continuing contract, whichever is deemed most practical and economical by ONG. If the contract is awarded at a higher amount than the estimated $222,031.00 ONG will send the City a written notice, and the City will have the right to terminate the agreement within ten (10) days of receipt of notice. ® ONG easements shall be considered to retain precedence so that any City project in the future requiring additional relocations of the same facilities shall be paid by the City. The City Attorney has review, o� vhis agreement. The most recent engineering estimate for the project is approximately $880,000 (prepared in December 2001). The expense of relocating ONG utilities is estimated to be $222,031. ROW surveying is estimated to cost an additional $2,000. Therefore, total estimated costs for the project are $1,104,000. The amended project budget is $1,150,000. Therefore, sufficient funds are available to construct the project. Staff recommends Council approval of the Agreement for Gas Facilities Relocation between Oklahoma Natural Gas Company and the City of Owasso for the 86"' Street North and 145"' East Avenue Intersection Improvement Project and authorize the Mayor to execute the Agreement. 1. Agreement and cost estimate Oklahoma Natural Gas Company, a Division of ONEOK, Inc., hereinafter called "Company," owns various intermediate- pressure and medium - pressure distribution natural gas pipelines, together with a pressure- reducing station, within the construction limits of the referenced project in the City of Owasso, 'Tulsa and Rogers Counties, Oklahoma, which Company utilizes in the discharge of its duties as a public service corporation. Company proposes to perform the necessary relocation of its facilities in substantial accordance with the five plan sheets and the four -page cost estimate, all dated April 1, 2002, of which four copies each are attached. Company will bear the cost of relocating the portions of the facilities which do not occupy private rights-of-way. The City's share of the estimated cost of the necessary relocation will be $222,031, all of which is to be reimbursed to Company by City. City by accepting the proposal agrees that City shall reimburse Company for its share of the total actual relocation costs, said costs being arrived at in the same manner as used in Company's estimated cost of the project attached hereto. It is further understood, and City by accepting this proposal agrees, that City will reimburse the Company in accordance with this agreement within thirty (30) days after the said relocation work has been completed and Company's statement for City's costs thereof has been submitted. Company agrees that in the event Company should determine prior to commencement of construction that the revised estimated amount of the reimbursement by the City may exceed the estimated cost as stated herein, Company shall notify the City of such determination in writing. June 139 2002 The FYO 1 -02 Budget included various street overlay projects in the Capital Improvement Fund (see Attachment). Projects were included at the following locations: - Roadway overlay in Westport Addition; - Roadway overlay in Elm Creek Addition-, - Roadway overlay in Three Lakes Addition; and - Roadway overlay in El Rio Vista Addition; Each identified project included estimated costs using a private company for paving and alternative costs using Tulsa County. It was believed that Tulsa County could provide equipment and labor that would have a significant impact in reducing costs of the projects. In addition, paving the parking lots at Vehicle Maintenance and Public works were proposed. Therefore, Public Works Department staff met with the Tulsa County Engineer (Ray Jordan) to discuss their possible participation and a letter request for interlocal agreements was sent to Commissioner Collins on September 5, 2001. Tulsa County Engineering was agreeable to participation on all projects. In the Fall 2001 City field personnel performed the work needed to prepare the road for paving. In order to formalize responsibilities, an Interlocal Agreement has been drafted with Tulsa County (see Attachment 1) that includes the following: The City of Owasso shall provide all required materials; Tulsa County shall provide all necessary labor and equipment to complete the projects; and Duration of the Agreement shall be for a period equal to the time necessary to complete the projects. Page 2 Interlocal Agreement — Tulsa County Funding for the materials to be used by Tulsa County for the projects is included in the FYOI -02 Capital Improvements Fund budget. These projects will not be able to be completed prior to the end of the fiscal year-, therefore, Funds will be requested to be carried over° to FY02 =03. RE, COMMENDATION. Staff recommends Council approval of the Interlocal Agreement with Tulsa County for paging assistance and authorize the Mayor to execute the Agreement. ATTACHMENTS- 1. We appreciate the willingness of the Commission to support work that would otherwise been extremely difficult to accomplish. Once again, we would like to request your assistance. We are requesting development of an interlocal agreement for the following projects: Roadway overlay in Westport Addition; Roadway overlay in Elm Creek Addition; E Roadway overlay in Three Lakes Addition; Roadway overlay in El Rio Vista Addition; M Parking lot paving for Vehicle Maintenance Facility; and Parking lot paving for Public Works Building.
