The Owasso Public Works Authority met in regular session on Tuesday, November 19, 2002 in
the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and
Agenda posted on the City Hall bulletin board at 4000 p.m. on Friday, November 15, 2001

The Owasso Public Works Authority met in a special meeting on Monday, November 18, 2002
in the Main Conference Room at Owasso City Hall per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, November 15, 2002. The meeting
was called by the Mayor at 9;00 a.m. on Monday, November 11, 2002.

COVENANTS; APPROVING AND AUTHORIZING PAYMENT OF FEES AND
EXPENSES; ESTABLISHING THE AUTHORITY'S REASONABLE
EXPECTATIONS WITH RESPECT TO THE ISSUANCE OF TAX - EXEMPT
OBLIGATIONS IN CALENDAR YEAR 2002• AUTHORIZING DOCUMENTS
PERTAINING TO A YEAR -TO -YEAR PLEDGE OF CERTAIN SALES TAX
REVENUE-, AND CONTAINING OTHER PROVISIONS RELATING THERETO.
Mr. Ray said that the improvements to the wastewater treatment plant have been financed
through the Oklahoma Water Resources Board. Interim construction financing was approved by
the OPWA Trustees in October 2001, and an application was made to OWRB for permanent

financing in October 2002. The construction has now been completed and it is necessary to
replace the construction loan with permanent financing. OPWA Resolution #2002 -06 approves
the permanent financing and authorizes the loan. It approves the issuance of two promissory
notes, approves and authorizes payment of fees and expenses, and approves and authorizes
various other documents and actions necessary to complete the financing. Ms. Kimball moved,
seconded by Mr. Cochran, to approve Resolution #2002No6, authorizing a loan from the OWRB.

Motion carried 4-0.

76TH STREET WIDENING (TULSA COUNTY)

The 76"' Street Widening project is part of the Tulsa County 664 to Fix the County" program. In order
to provide space for the roadway widening in the area of the Public Works Department Administration
Building, it is necessary that the Authority dedicate to the county an additional fifty (50) feet of right-
of-way along the roadway frontage (see attached Deed of Dedication and Donation Certificate).
In order to provide working areas to install drainage structures at the two Public Works Department
driveways, it is also necessary for the Authority to provide two fifteen (15)-foot temporary
construction casements (see attached Temporary Construction Access Easement).
Staff recommends Trustee approval of the Deed of Dedication, the Donation Certificate and the
Temp6rary Construction Access Easement for the 76th Street North Widening project and authorize the
Chair to execute the documents.

or parcels of land for the purpose of establishing thereon a public highway or facilities

provided, however, that any explorations or development of said reserved mineral rights shall not directly or indirectly interfere with
the use of said land for the purposes herein granted; and reserving unto said Grantors the right of ingress and egress to said public
highway from the remaining lands of the Grantors, except as may be provided otherwise herein.
To have and to hold said above - described premises unto the said County of Tulsa, Oklahoma, free, clear and discharged from any and
all claims of damages or injury that may be sustained directly or indirectly to the remaining lands of the Grantors by reason of the
construction and maintenance of a public highway and all highway excavations, embankments, structures, bridges, drains, sight
distance or safety areas and other facilities that may now or hereafter be, in the discretion of the grantee, necessary for the construction
and maintenance of a public highway and incidental facilities over, across or along the above - described real estate, the supervision and
control of said public highway to be in such municipality, county or other agency of the State of Oklahoma as has or may have
jurisdiction thereof by the laws of the State of Oklahoma; and such municipality, county or other agency of the State of Oklahoma,
their officers, agents, contractors and employees are hereby granted free access to said property for the purpose of entering upon,
constructing, maintaining or regulating the use of said public highway and incidental facilities.
Said Grantors hereby covenant and warrant that at the time of the delivery of these presents they are the owners in fee simple of the
above- described premises and that same are free and clear of all liens and claims whatsoever except:
