Garnett Rd. to Owasso_2004.08.17WHEREAS, a section of North Garnett roadway (old US 169) was previously removed from the State Highway System January 3, 1989, with Oklahoma Transportation Commission approval and has been maintained by the City of Owasso since that time; WHEREAS, the City of Owasso is planning to upgrade North Garnett Road from an existing two lane to a five lane facility, including partial realignment near East 86th Street North on North Garnett Road, by October of 2005; WHEREAS, this transportation improvement is part of an agreement with the developers of a planned Super Target and other planned developments to be located east of North Garnett Road between E. 86th Street North and E. 96th Street North; WHEREAS, this land transfer will save the citizens of the City of Owasso tax dollars and provide for future economic development opportunities; WHEREAS, the Oklahoma Department of Transportation will not participate in the cost of the reconstruction of North Garnett Road as it is dedicated as a local city street; WHEREAS, the City of Owasso must negotiate with property owners for required new right -of -way and may use this currently state owned property in the negotiations; WHEREAS, the City of Owasso agrees that it will protect and save and keep the Oklahoma Department of Transportation forever harmless and indemnified against and from any penalty or damage or charges imposed for any violation of any laws or ordinances, whether occasioned by the neglect of the City of Owasso or those holding under the City of Owasso, and that the City of Owasso will at all times protect, indemnify and save and keep harmless, the Oklahoma Department of Transportation against and from any and all loss, cost, damage, or expense, arising out of or from any accident or other occurrence on or about said premises, causing injury to any person or property whomsoever or whatsoever and will protect, indemnify and save and keep harmless the Oklahoma Department of Transportation against and from any and all claims and against and from any and all loss, cost, damage or expense arising out of any failure of the City of Owasso in any respect to comply with and perform all the requirements and provisions hereof. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Owasso, xlzjl S i� Section 1: The City of Owasso approves the concept of reconstructing North Garnett Road for the proposed commercial developments; and, Section 2: The City of Owasso requests the Oklahoma Department of Transportation to provide the title of the State Owned property and/or parcels of land along North Garnett Road from East 86th Street North to East 96th Street North within the City of Owasso.
